This festival is also known as the Moon Cake Festival because a special kind of sweet cake (yueh ping)prepared in the shape of the moon and filled with sesame seeds, ground lotus seeds and duck eggs is served as a traditional Chung Chiu delicacy. Nobody actually knows when the custom of eating moon cake of celebrate the Moon Festival began, but one relief traces its origin to the 14th century. At the time, China was in revolt against the Mongols. Chu Yuen-chang, and his senior deputy, Liu Po-wen, discussed battle plan and developes a secret moon cake strategy to take a certain walled city held by the Mongol enemy. Liu dressed up as a Taoist priest and entered the besieged city bearing moon cake. He distributed these to the city's populace. When the time for the year's Chung Chiu festival arrived, people opened their cakes and found hidden messages advising them to coordinate their uprising with the troops outside. Thus, the emperor-to-be ingeniously took the city and his throne. Moon cake of course, became even more famous. Govt lawyer seeks to block senior MACC officers from testifying - nizar nizar nizar najib altantuya teoh beng hock

SHAH ALAM, Oct 1 – The Attorney General (AG) appears to be closing doors today in an attempt to bring a quick end to the high-profile inquest of a DAP political aide, Teoh Beng Hock, which started three months ago.

A private lawyer hired to act on behalf of the AG raised more than eyebrows today when he tried to limit the witnesses which lawyers representing Teoh's family and the state government want to bring in.

Former deputy public prosecutor, Tan Hock Chuan who is assisting the coroner's court, had argued that there was no need to call senior graft busters, Hishamuddin Hashim and Hairul Ilham Hamzah, into the witness box, despite testimonies from the MACC rank-and-file that they had got their instructions from the two.

Gobind Singh Deo and Malik Imtiaz Sarwar, lawyers for the Teoh family and Selangor respectively, were outraged at what they claimed was a gross injustice preventing them from finding out what had really happened to Teoh.

Malik stressed that both Hishamuddin and Hairul Ilham were the most senior MACC officers involved throughout the investigation and would be the best men to shed light on several puzzles, especially as their junior officers had clearly said they got orders from the duo.

The argument went back and forth, with voices getting progressively louder.

It was not the first time Tan tried to shut the door on further questioning of the MACC.

He first made the indication last Tuesday, when he told magistrate Azmil Muntapha Abas, who is acting as coroner, that he would not be calling any more MACC men into the witness box.

The last MACC officer who testified was senior assistant enforcer, Raymond Nion John Timban, said to be the last man to see Teoh alive.

In his statement given before the inquest took a two-week break for Aidilfitri, Raymond said he saw Teoh sleeping on a sofa in the MACC office about 6am on July 16.

He added that an unknown Chinese man who was not part of the MACC had sat with Teoh earlier, about 1am the same day.

The magistrate finally said he would decide on the matter when the inquest resumes tomorrow morning.
Tan had earlier told the court that the mystery of the unknown male DNA found on Teoh's coat and belt had been solved.

Government DNA expert, Dr Seah Lay Hong, will be recalled to the witness box to reveal the identity of the mystery man.

The 30-year-old political secretary to state executive councillor Ean Yong Hian Wah, was mysteriously found dead on a 5th-floor landing outside the Malaysian Anti-Corruption Commission's (MACC) Selangor office at Plaza Masalam here on July 16, after being questioned overnight into claims his boss abused state money.

His family and employer claim foul play was involved.

"He's a very loving and helpful person," Teoh's elder brother, Meng Kee, 33, told the coroner's court today when he stepped into the witness box.

He is the first in the family to testify.

And when lawyer Gobind asked him point-blank if he knew of any reason that would push his baby brother to suicide, Meng Kee said: "No, sir!"

Two pathologists who carried out the autopsy on Teoh had previously said that the signs point to suicide.

MACC lawyer, Datuk Abdul Razak Musa, who crossed-examined Meng Kee after Gobind, hinted that Teoh,who was pressed to hold a shotgun wedding because his girlfriend was two months pregnant then, may have faced money woes.

He suggested that traditional Chinese weddings were costly affairs running into the tens of thousands, and Teoh could have hardly afforded it on his political secretary pay of only RM1,800 a month.

But Meng Kee disagreed. He said his brother had savings and that Chinese weddings could cost under RM20,000. He added that the siblings would also help Teoh out financially.

Teoh's friend, Woo Chuan Sing, who had been invited to be the best man at the wedding planned for Oct 3 that will now never be, told the court that he was unaware that his best friend had faced any recent problems.

He had last spoken to Teoh over the phone on the morning of July 15.

Lawyer Malik has been struggling for the past month to bring in a Thai forensic pathologist to support their theory of possible homicide in Teoh's inquest. He finally succeeded today.

Magistrate Azmil fixed Oct 20 and 21 to hear Dr Pornthip Rojanasunand's testimony.

No need to call senior graft busters, Hishamuddin Hashim and Hairul Ilham Hamzah, into the witness box, despite testimonies from the MACC rank-and-file that they had got their instructions from the two???

Can close case just like the Altantuya case. Azilah and Sirul obviously had no motive to kill. Like the MACC rank-and-file, they only received instructions from their superiors.

Woman lures 40 loan sharks into police dragnet - nizar nizar nizar nizar najib altantuya

KUALA LUMPUR, Oct 2 – On the pretext of settling her massive debts with 40 "Ah Longs" (loan sharks), a woman lured them into a police dragnet.

Upon arriving at the 42-year-old woman's office at separate times in Sungai Besi yesterday, she politely asked the loan sharks to wait at the second floor of her office to enable her to pay them their dues.

When the "Ah Longs" did as they were requested, they walked straight into the waiting arm of the law.

In the six-hour operation, a team of policemen from the Bukit Aman Commercial Crime Department arrested the suspects.

Seized from the 40 loan sharks were bank books and automated teller machine cards, among others.

Today, the police obtained a three-day remand from a magistrate's court to detain the suspects aged between 25 and 42 to facilitate investigations.

The 40 "Ah Longs" are being held at the Brickfields police headquarters.

A police officer told Bernama that the woman, who is involved in the printing business, had taken loans of between RM5,000 and RM10,000 from each of the loan sharks to help sustain her business.

"However, when she was constantly harassed by the loan sharks, the woman filed several police reports against them.

"Following our advice to trap the illegal financiers, she contacted them on the pretext of settling all her debts," said the police officer.

He said that more loan sharks were expected to be rounded up from the Sungai Besi area.– Bernama

1. Tahun ini kita akan sambut Hari Merdeka dengan menyebat seorang wanita Melayu kerana minum beer.

2. Cerita hukum sebat telah disebar luas di seluruh dunia. Saya tak tahu apakah ini akan memberi imej baik atau tidak baik kepada agama Islam. Sebagai orang Islam kita tidak harus ambil berat pandangan orang lain terhadap Islam dalam melakukan suruhan agama.

3. Tetapi benarkah hukuman ini tepat bagi jenayah minum arak? Apakah hukuman ini terdapat dalam undang-undang syariah di Malaysia.

It may be a harsh sentence, says Mahathir

PETALING JAYA: Former prime minister Tun Dr Mahathir Mohamad has expressed concern that the caning sentence ordered on part-time model Kartika Sari Dewi Shukarno might be too harsh.

Among the questions he posed in his blog were whether the punishment might not have been appropriate given the differences of opinion stemming from the issue.

"Is not Islam merciful to first-time offenders?" Dr Mahathir asked, adding that fairness and consideration were the main tenets in Islam.

"We will be celebrating our independence this year by flogging a Muslim woman for drinking beer under Syariah law," he said.

"Although the story has gone across the globe, Muslims should not worry about other people's perceptions when dealing with matters of our religion despite the negative or positive image it might bring," he added.

Era Najib Altantuya : Musa Aman Seludup Wang Di Hong Kong?

Ketua Angkatan Muda Keadilan (AMK), Shamsul Iskandar Md Akin ke Badan Pencegah Rasuah Hong Kong untuk mendesak supaya soal siasat dijalankan ke atas sekutu Ketua Menteri Sabah yang ditahan menyeludup wang sejumlah RM16 juta.

Michael Chia Tien Foh, sekutu kepada Ketua Menteri Sabah Musa Aman ditahan berhubung penyeludupan dan pengurupan wang haram pada 14 Ogos tahun lalu.

Chia ditahan di Lapangan Terbang Antarabangsa di Hong Kong apabila cuba berlepas dari wilayah China itu menuju Kuala Lumpur dengan membawa wang berkenaan.

Shamsul ke Hong Kong untuk membuat laporan berkenaan hal terbabit dan meminta bantuan daripada pihak Badan Pencegah Rasuah Hong Kong untuk menyiasat konco pemerintah BN itu.

Sementelah ianya isu besar yang membabitkan wang rakyat dan laporan ke atasnya telah dibuat kepada Suruhanjaya Pencegahan Rasuah Malaysia (SPRM),namun tiada tindakan yang diambil.

Badan Pencegah Rasuah Hong Kong dikatakan memberi layanan baik dan meminta Shamsul menjelaskan tentang hubungan Chia, Musa Aman dan pembalakan haram di Sabah.

"Saya telah diminta untuk memberikan pandangan dan penerangan serta penjelasan terhadap dokumen yang telah kita berikan kepada ICAC di Hong Kong berkaitan dengan penahanan Datuk Michael Chia di Lapangan Terbang Antarabangsa Hong Kong pada 14 Ogos lalu" ujarnya.

Wang yang diseludup oleh Chia itu dikatakan mempunyai hubung kait dengan lesen membalak di Sabah yang membawa pulangan lumayan kepada ahli politik Barisan Nasional di negeri itu.

Blog-blog di Sabah telah memberikan liputan meluas berkenaan isu tersebut sejak tahun lalu. Malah hubungan Chia dan Musa Aman tidak menjadi satu rahsia lagi kini.

"Saya juga telah menerangkan bagaimana hubungan Datuk Michael Chia dan Musa Aman dan saya juga meminta pihak ICAC meneliti kesemua dokumen tersebut dan memulakan penyiasatan. Sekiranya benar wang-wang yang haram yang diambil dari hasil pembalakan haram di Sabah itu berada di Hong Kong termasuk kemungkinan untuk membekukan akaun-akaun yang berkaitan dengan penyimpanan wang haram ini" tambahnya lagi.

Shamsul dalam laporannya turut menamakan empat pihak lain yang terlibat dalam kes seludup wang tersebut iaitu kerajaan negeri Sabah, Innoprise Corporation Sdn Bhd, Rakyat Berjaya Sdn Bhd dan Kumpulan Yayasan Sabah.

Menurut sumber rapat, Polis Hong Kong dan Interpol telah memantau kegiatan haram Chia sejak tiga tahun lalu dan akhirnya berjaya menangkap Chia bersama bukti wang tunai bernilai RM16 juta yang diseludup keluar daripada Hong Kong di dalam beg pakaiannya.

Setelah disoalsiasat, Michael merayu agar dibebaskan kerana wang berkenaan milik Musa Aman dan beliau hanyalah agen membawa keluar wang berkenaan ke Kuala Lumpur bagi membantu meringankan beban kewangan Barisan Nasional dalam proses penamaan calon di Permatang Pauh dan sebahagiannya untuk kegunaan pilihanraya kecil berkenaan.


Shamsul dalam laporannya meminta kerjasama dari pihak Badan Pencegah Rasuah Hong Kong untuk membantu menyiasat perkara ini kerana ia melibatkan wang rakyat dan ianya harus dikembalikan kepada rakyat Sabah.

"Saya jelaskan kepada mereka pentingnya kes ini kerana ianya melibatkan wang rakyat dan kita pertikai bagaimana ada seorang individu yang boleh membawa wang sejumlah Rm16 juta yang dibawa keluar daripada Hong Kong. Ini merupakan wang keuntungan yang sepatutnya kembali kepada rakyat Malaysia".

I've got a lot of strength to ignore and pretend. Too much strength in fact. Yet, the same strength is eating me inside.

Era Najib Altantuya : MP Kapar Kesal Hanya Seorang Didakwa Dalm Kes Kugan (updated)

Ahli Parlimen Kapar, S Manikavasagam, menyatakan kekesalan hanya seorang dari 11 anggota polis yang dituduh membunuh mendiang Kugan Ananthan tidak didakwa di mahkamah.

Pemimpin PKR itu berkata adalah tidak munasabah hanya seorang anggota berpangkat rendah diheret ke muka pengadilan walhal 10 lagi dari pelbagai pangkat dikatakan terbabit dalam pembunuhan itu.

"Mengapa seorang sahaja dihadapkan? dan dia seorang India. Perihal dia hanya seorang konstabel? Perihal ada pegawai yang OCPD ada, Chief Inspektor ada. Sebanyak 11 orang ada. Ditukar dari balai ke pejabat, kerja pejabat. Tapi sekarang saya tengok, satu orang sahaja yang didakwa" soalnya.

Manikavasagam menambah kerajaan tidak harus membedakan undang-undang untuk orang-orang kecil dan orang-orang besar termasuk polis. Sekiranya perbicaraan kes bunuh ini didapati tempang, maka rakyat akan melihat pemerintah menghalalkan penderaan dan keganasan polis.

"Ini saya rasa sepatutnya 24 jam mereka melakukan siasatan ke atas Kugan dan sekarang nampak seorang sahaja yang didakwa.Tetapi dalam kes di Batu Cave perhimpunan Hindraf, mereka baling batu tetapi didakwa kes bunuh, peguam negara dakwa kes bunuh tapi di sini seksyen lain pula. Yang ringan. Maksudnya anggota polis boleh bunuh sesiapa sahaja, tapi denda dia RM 10, 000 dia boleh keluar" ujarnya lagi.

Semalam, seorang dari 11 anggota polis yang membunuh mendiang A Kugan diheret ke Mahkamah Sesyen Petaling Jaya.

Konstabel Navindran Vivekanadan dibicarakan untuk dua kesalahan menyebabkan kecederaan semasa memeras pengakuan dari mangsa, 16 Januari lalu.

Anggota polis itu didakwa di bawah Seksyen 331 Kanun Keseksaan kerana memeras mangsa sehingga mendatangkan kecederaan dan Seksyen 330 Kanun Keseksaan kerana menyebabkan mangsa mengalami cedera parah.

Jika disabitkan kesalahan, Navindran menghadapi 10 tahun penjara dan denda bagi Seksyen 331 dan tujuh tahun penjara bagi Seskyen 330. Navindran mengaku tidak bersalah dan minta dibicarakan.

Hakim Aslam Zainuddin menetapkan ikat jamin RM10,000 dan 5 November untuk sebutan kes.

Kugan telah ditahan pihak polis pada 15 Januari lalu kerana dikatakan terlibat dalam kes curi kereta mewah.

Beliau mati setelah lima hari berada dalam tahanan polis dengan keadaan badan cedera parah.

Navindran adalah anggota di Balai Polis Taipan, namun dipindahkan ke Ibu Pejabat Kontinjen Shah Alam selepas kejadian.

Menurut Peguam Negara Abdul Gani Patail, empat dari 92 saksi yang disoalsiasat polis mengenalpasti konstabel itu yang mencederakan Kugan pada waktu-waktu kejadian. Mangsa dikatakan dibelasah dengan hos getah sebelum ditemui mati empat hari kemudian.

Peguam Negara menambah polis terbabit tidak akan didakwa di bawah kesalahan bunuh atas alasan mangsa mati empat hari kemudian selepas dibelasah.

"Double standard. Orang awam satu dakwaan, pegawai polis satu dakwaan. Bagi kita, kita tidak puas hati. Pada hari Selasa ini kita akan hantar 1 memorandum kepada tatatertib Bukit Aman dan juga mendesak Musa Hassan untuk letak jawatan. Dan pada 10/10, kita akan hantar memorandum ke istana, untuk desak dakwa yang 10 orang lagi".

Era Najib Altantuya : Kahar Minta Pengikutnya Insaf Dan Bertaubat

Abdul Kahar Ahmad yang mengaku dirinya sebagai "Rasul Melayu" hari ini membuat pengakuan taubat nasuha di Mahkamah Tinggi Syariah Shah Alam.

Abdul Kahar turut menyeru individu yang terpengaruh dengan ajaran sesatnya supaya bertaubat serta kembali kepada ajaran Islam yang sebenar, dia turut memohon maaf kepada semua umat Islam serta pihak berkuasa kerana mencetuskan provokasi, kekeliruan serta fitnah terhadap Islam.

Dia yang menulis dan menandatangani pengakuan tersebut turut mengekalkan pengakuan bersalah terhadap lima pertuduhan menyebarkan doktrin palsu, menghina Islam serta pihak berkuasa dan memuat dakwaan palsu.

Terdahulu, Fakta kes menyebut tertuduh mendapat pendidikan sehingga darjah lima di sekolah Melayu telah ditangkap pada 23 Jun 2005 oleh pegawai penguatkuasa JAIS berhubung semua kesalahan itu dan dia didapati telah menyebarkan pendapat serta ajaran yang bercanggah dengan ajaran Islam, lebih-lebih lagi ajaran 'Kahar Bin Ahmad' telah diwartakan sebagai ajaran salah oleh Mufti Selangor pada 23 Mei 1991.

Pada 8 April 1991, Abdul Kahar pernah didakwa mengikut Seksyen 150 Enakmen Pentadbiran Agama Islam Selangor 1952 kerana tidak bersolat Jumaat dan dikenakan denda RM300 atau dua bulan penjara.

Tertuduh yang merupakan bekas pekerja Zoo Negara, pertama kali dihadapkan ke mahkamah pada 17 Ogos 2005 serta dibebaskan dengan ikat jamin RM8,000 dan sepatutnya dibicarakan pada 21 Sept 2005.

Dia bagaimanapun beberapa kali gagal hadir untuk dibicarakan pada tarikh-tarikh yang ditetapkan walaupun waran tangkap dikeluarkan, sehinggalah pada 16 Sept lepas apabila dia ditahan pasukan penguatkuasa Jais kira-kira pukul 9.45 pagi, di tempat persembunyian barunya di Sungai Long, Kajang sebelum dibawa ke mahkamah untuk mendapat perintah tahanan ke atasnya.

Era Najib Altantuya : Peguam Bantah Ahli Keluarga, Rakan Beng Hock Ditemuduga Ahli Psikiatri (Updated)

Peguam mewakili keluarga Teoh Beng Hock, Gobind Singh Deo dalam prosiding inkues hari ini, membantah ahli keluarga dan rakan Teoh menjalankan ujian temuduga oleh ahli forensik psikiatri.

Menurutnya, perkara ini tidak releven kerana keterangan yang diberikan kepada ahli psikiatri tidak dapat dipastikan kesahihannya dengan pemikiran Teoh, sebelum beliau ditemui mati.

Gobind berkata,"Kita tidak tahu siapa yang akan menemuduga. Kita juga tidak tahu apa yang mereka katakan. Mereka itu bukan di bawah sumpah,".

Beliau berkata, adalah tidak adil untuk membenarkan ahli psikiatri menemuduga pegawai-pegawai SPRM secara sulit dan selepas itu memberi keterangan di mahkamah.

Katanya, keterangan dan maklumat yang diberikan kepada ahli psikiatri yang akan menilai pemikiran Teoh sebelum kematiannya, tidak boleh diterima.

Sementara itu, Koroner Azmil Muntapa Abas, memberitahu jika ahli psikiatri dipanggil untuk membentangkan laporan mengenai pemikiran Teoh, ia akan menghadkan skop saksi-saksi yang pernah dipanggil memberi keterangan.

Era Najib Altantuya : Larangan Bendera, SPR Dibidas

DAP Negeri Sembilan menempelak tindakan Suruhajaya Pilihan Raya (SPR) melarang parti yang tidak bertanding daripada mengibarkan bendera, logo dan gambar pemimpin mereka sepanjang tempoh berkempen.

Pengerusinya Loke Siew Fook menyifatkan larangan SPR itu sebagai tidak masuk akal dan diluar batas kuasa suruhanjaya berkenaan.

"Larangan meletak bahan kempen dan bendera saya rasa itu adalah sesuatu di luar batasan SPR. Tugas dan tanggungjawab SPR sepatutnya mereka perlu memberikan tumpuan kepada tanggungjawab untuk mengendalikan proses penamaan calon, proses pengundian dan proses pengiraan undi.

"Itu adalah fungsi dan tugas utama mereka soal kempen biarlah parti-parti politik berkempen secara bebas jangan terlalu banyak kekangan dan halangan," katanya ketika dihubungi TV Antara sebentar tadi.

Menurutnya DAP Negeri Sembilan akan tetap meneruskan kempen untuk memberi sokongan kepada calon Pas bahkan sanggup membayar deposit sekiranya ia menjadi pertikaian SPR.

Katanya SPR kini dilihat seolah-olah gentar dengan kerjasama dan kesepaduan yang ditunjukan parti komponen Pakatan Rakyat.

"Apa yang susah sangat dengan SPR seolah-oleh mereka fobia dengan parti-parti komponan Pakatan Rakyat bersatu. Kalau itu menjadi masalah kita akan membayar deposit RM3000.

"Memang kita akan teruskan kempen kita. Kita akan naikkan bendera Pas, hanya bahan kempen seperti papan tanda dan banner, atas semangat Pakatan Rakyat ada lambang PKR dan DAP," katanya

Timbalan Pengerusi SPR Datuk Wan Ahmad Wan Omar semalam mengumumkan larangan kepada mana-mana parti yang tidak bertanding pada pilihan raya kecil DUN Bagan Pinang mengibarkan bendera, dan gambar pemimpin sepanjang kempen.

Menurutnya larangan berkenaan dibuat kerana parti-parti berkenaan tidak membayar deposit untuk berkempen.

Wan Ahmad menjadikan juga menjadikan alasan Pakatan Rakyat tidak berdaftar sepertimana Barisan Nasional yang mempunyai 14 parti gabungan dan berdaftar. Maka PKR dan DAP tidak boleh memasang bahan kempen bersama Pas.

Siew Fook berkata walapun Pakatan Rakyat belum didaftarkan namun ia bukan satu kesalahan sekiranya parti-parti komponennya berkempen untuk Pas.

Menurutnya, larangan berkenaan merupakan kekangan yang dicipta SPR untuk membantutkan sistem demokrasi negara.

"Saya rasa itu bukan satu kesalahan dan kenapa perlu diletakakan pelbagai kekangan dan halangan untuk membantutkan sistem demokrasi di negara kita ini.

"Saya rasa tidak patut SPR mengenakan pelbagai sekatan ini. Selagi kempen dilakukan dengan berhemat dan semua perkara berjalan lancar saya tidak nampak mengapa SPR perlu campur tangan dan menghalang parti-parti lain untuk membantu calon pas," katanya.

Beliau turut mempersoalkan sama ada SPR akan berlaku adil dalam kempen pada kali ini dengan menguatkuasakan larangan-larangan kepada semua parti bertanding.

Katanya SPR juga perlu memastikan larangan mendirikan pondok panas dan merayu undi dipatuhi Umno-Barisan Nasional.

"Yang menjadi masalah dia kata tidak boleh letak pondok panas. Sama ada peraturan ini dapat dikuatkuasakan pada semua pihak termasuk Barisan Nasional.

"Ada parti lain bukan BArisan Nasional akan berkempen untuk BArisan Nasional seperti Makkal Sakthi dan KIMMA. Kita tidak menentang kerana itu hak mereka. Jadi untuk pihak Pakatan Rakyat kalau PKR dan DAP berkempen untuk calom Pas itu adalah hak kami," katanya. -TVA

Last week, three dictators — from Iran, Libya, and Venezuela — delivered lunatic hate-speeches at the General Assembly of the United Nations.Why do these anti-Semitic dictators feel so free to damn America from downtown New York? Why do their abettors spurn our requests for help? And why do creepy regimes plot to get nukes, and fund terrorists? Easy. They do not fear, much less listen to, an indebted and energy-hungry America that either needs their cash or oil — or both.

Libya's Muammar Qaddafi raved for 90 minutes. He railed about everything from the Kennedy assassination to his own jet lag. He trashed the United States and the Jews. Even Qaddafi's translator collapsed from exhaustion trying to keep up with the stream-of-consciousness insanity.Iran's Mahmoud Ahmadinejad offered his usual madness. Once again, he libeled the Jews. Venezuela's Hugo Chávez may have delivered the strangest monologue. He mostly idolized left-wing filmmaker Oliver Stone for making a fawning documentary about revolutionary Venezuela. Inkues Teoh Beng Hock : Peguam Bantah Ahli Keluarga, Rakan Beng Hock Ditemuduga Ahli Psikiatri

Peguam mewakili keluarga Teoh, Gobind Singh Deo dalam prosiding inkues hari ini, membantah ahli keluarga dan rakan Teoh menjalankan ujian temuduga oleh ahli forensik psikiatri.

Menurutnya perkara ini tidak releven kerana keterangan yang diberikan kepada ahli psikiatri adalah tidak dapat dipastikan kesahihan dengan keputusan yang akan dibuat berkenaan keadaan fikiran Teoh sebelum beliua ditemui mati.

Gobind berkata,"Kita tidak tahu siapa yang akan menemuduga. Kita juga tidak tahu apa yang mereka katakan. Mereka itu bukan di bawah sumpah,".

Beliau berkata, ia adalah tidak adil bagi membenarkan ahli psikiatri untuk menemuduga pegawai-pegawai SPRM secara sulit dan selepas itu memberi keterangan di mahkamah

Katanya, keterangan dan maklumat yang diberikan kepada ahli psikiatri yang akan menilai keadaan fikiran Teoh sebelum kematian adalah tidak boleh diterima.

Sementara itu Koroner Azmil Muntapa Abas, memberitahu Jika ahli psikiatri dipanggil untuk membentangkan satu laporan berkenaan keadaan fikiran Teoh, ia akan dihadkan kepada skop saksi-saksi yang pernah dipanggil.

Mahkamah ditangguhkan pada 14 Oktober sehingga ahli psikiatri itu menyerahkan laporan keadaan fikiran Teoh berdasarkan testimoni pegawai-pegawai SPRM di mahkamah dan laporan temuduga ahli-ahli keluarga Teoh.

Inkues Teoh Beng Hock : DNA Milik Orang Yang Sudah Meninggal Dunia

Inkues kematian Teoh Beng Hock hari ini diberitahu bahawa sample DNA lelaki misteri yang ditemui pada blazer dan tali pinggang mendiang Teoh disahkan adalah milik mayat seorang lelaki Gopala Muniam.

Perkara ini disahkan oleh, ahli kimia, Dr Seah Lay Hong yang merupakan saksi ke 9, beliau menjelaskan perkara itu milik Gopala yang telah meninggal dunia dalam kemalangan jalan raya.

Dr Seah yang dipanggil semula memberi keterangan dalam inkues tersebut berkata pemindahan DNA itu mungkin berlaku ketika bedah siasat ke atas Teoh dilakukan di Hospital Klang dalam keadaan yang sesak.

Gopala mati dalam satu kemalangan jalan raya dan DNAnya ditemui pada blazer Teoh.
Bagaimanapun, terdapat satu lagi kesan DNA yang ditemui pada talipinggang Teolh tetapi belum dapat dikenalpasti.

Dr Seah memberitahu mahkamah bahawa beliau diminta menjalankan bedah siasat ke atas dua mayat, sebelum mayat Teoh, pada hari tersebut di hospital berkenaan.

Beliau memberitahu perkara itu berlaku melalui pencemaran akibat meja pembedahan yang tidak distrill dengan baik.

Seorang lagi mayat adalah L Jeganathan, yang juga mati akibat cedera parah di bahagian kepala akibat kemalangan jalan raya namun Dr Seah berkata, ujian menunjukan DNAnya tidak sama dengan DNA yang ditemui pada bahagian talipinggang Teoh yang terkoyak.

DNA Gopala dikenalpasti selepas Dr Seah melakukan siasatan kali ketiga kerana dua siasatan sebelum itu, gagal mengenal pasti pemilik DNA berkenaan pada talipinggang dan blazer tersebut.

Dalam siasatannya itu, Dr Seah menganalisa profail DNA 157 individu sebagai perbandingan, dan mereka terdiri daripada 14 pegawai dari Jabatan Patologi Forensik di Hospital Tengku Ampuan Rahimah Klang, Pusat Perubatan Universiti Malaya dan Hospital Kuala Lumpur.

Turut diuji ialah 49 pegawai polis, 81 pegawai Suruhanjaya Pencegahan Rasuah Malaysia (SPRM), dua pekerja pencuci, lapan kakitangan penyelenggaran dan seorang anggota keselamatan, serta tiga saksi.

Dua siasatan pertama gagal mengesan pemilik DNA yang ditanda sebagai 'Lelaki 1'.

Howdy peeps?

My current city now is Chiang Mai, Thailand. Quick update if you don't mind. I am not able to upload any photos as now because I am currently at some restaurant that provides internet service.

I won't be in Chiang Mai for long. Currently I am surfing while waiting for my bus to Chiang Rai, another 3-4 hours of ride. It's been a long day today since 6AM. Thanks to Roy Lim who fetched me all the way to KL Sentral.

From KL Sentral, I took the KLIA transit to Salak Tinggi before commuting via bus to LCCT. I would say the package is worth of it. The whole journey took me slightly less than an hour. Reached LCCT about 8ish. The flight was @ 1020hrs and reached Chiang Mai @ 1230hrs local time.

So, I guess I will be off from the blogosphere and internet world for at least a week because the internet facilities in Thailand are pretty poor.

So I would like to take this opportunity to wish every readers of mine a very happy Mid-Autumn day tomorrow ya! Enjoy the mooncakes, light up more tang-lungs.

And not forgetting too, let's pray for the victims of the earthquake that we Malaysian felt a couple of days ago. The death toll had since increase to an estimated 1,100 deaths. My prayers to them.

Gonna miss you all.

POLITICS AND CORPORATE GOVERNANCE

I have received a email from a friend who is a practitioner in Corporate Governance, who wishes to share with us his views and comments concerning the Port Klang Free Zone (PKFZ) financial scandal that is dubbed by the opposition as 'the mother of all scandals'. Appended below is the full text of the email.


1. Being a practitioner in Corporate Governance, I have observed that the financial failures that occurred during the past decade were not solely attributable to failures in the audit profession.
They also represents fundamental failures at the very heart of the organization i.e. government/government agencies and/or corporations - failures of the corporate governance structure. The failures in ethical standards and corporate governance continue with new issues every year. Nor were the failures limited to Malaysia. On the contrary, similar failures occurred in major companies located in the United States, France, Italy, U.K., as well as in other parts of the world. Greed simply overwhelmed all parts of the system.

2. In the case of PKFZ, the warning signs were present, but the company's management ignored them, and the auditing profession ( the Audit Report 2004 that was prepared by the Auditor General did highlight the serious irregularities in PKFZ's financial management, but the company management did not assumed the risks, nor did they take appropriate action to remedy/rectify the situation at that point of time) recognized them.

3. There was not much of regulation then to quickly response to financial failures to address the fundamental problems in corporate governance, but allowed it to continue further only to be blown out of proportion in 2009.

4. What happened to the Malaysian Oxley ( MOX ) which was enacted much later after Sarbanes-Oxley Act of 2002 (SOX) due to the Enron fraud of the late 1990's and early 2000's, represents almost everything that was wrong with corporate governance, accounting, financial analysts, banking and the accounting profession.

5. Little is known as to whether or not the Board of Directors (BOD) of PKFZ had enough power, time and resources to provide proper oversight of the management. It is quite apparent that there was no accountability and responsibility on their part in protecting PKFZ interests which were of paramount importance. The BOD were merely appointed to serve their political masters and have not acted in good faith by exercising their fiduciary roles efficiently and effectively as were expected of them. As such, they are to be blamed and rightly punished for their gross oversight for allowing the previous General Manager to singularly make decisions, and went above BOD without questioning the integrity and providing check and balance on the previous management.

6. Again after the event, political governance too fared no better, and they started pointing fingers and as usual chose to remain in denial.

7. I don't know how the PM 1 Malaysia is going to handle this situation, and whether he is in consonance with the 1 Malaysian Concept " Rakyat didahulukan dan Pencapaian diutamakan " or just plain rhetoric. At the end of the day, the rakyat suffers or covered up with the 6 N-KRAs and KPIs.

8. In the final analysis, PKFZ is 'where everything bad came together'. Why did it happened? What were the failures that allowed it to occur?

9. Unfortunately, the obvious answer is that the failures were widespread i.e. Management Accountability, Governance, Accounting, The Financial Analyst Community and many more which I cannot remember.

10. There were too many parties at fault, and we only have to wait and see whether our PM 1 Malaysia has the political will to take whatever action necessary against those found guilty of creating the 'mother of all scandals'.


CRUSADE AGAINST CORRUPTION


IS OUR NATIONAL DISASTER RELIEF ORGANISATION COMPETENT ENOUGH TO HANDLE A NATIONAL DISASTER?

I visited Padang, Sumatra a few years ago, and later proceeded to Bukit Tinggi in search of my lost relatives whom I have never met, but knew of their existence. My late father had once said to me that my grandfather still has a number of his siblings left in Padang and the Bukit Tinggi region whose inhabitants are predominantly of the Minangkabau clan.

Upon my father's death, the only person to whom I could refer to with regards to my ancestry is my uncle who died several years after my father's death. He did say to me that my grandfather still has a 'Rumah Gadang', literally meaning a 'Grand House' or in our sense, a large family home at a place called Simaung. I never got to Simaung because the people whom I had enquired in Bukit Tinggi knew off the place, but they needed me to be more specific for them to identify exactly where the 'Rumah Gadang' is located. I don't even have the names of my grandfather's siblings and that made the search even more complex.

The news that Padang was struck by a massive earthquake a few days ago, once again reminds me of my lost relatives. And sure enough, I received a call from my brother last night to say that the entire home of a relative of my mother in Padang, who had come to visit her a few years ago, has been badly affected by the earthquake. We do not know if anyone were injured or had lost their lives in the rubble, because the news had been told by some relatives residing in Malaysia, and there is no means that my brother can talk to them.

We Malaysian are indeed a fortunate lot and the only natural calamity hitting us are the floods, landslides and the occasional thunderstorms. There has never been a tornado, an earthquake or a direct impact of the tsunami on a scale that lashed out at Acheh and some coastal areas of Thailand. What we got was only a 'residue' of an earthquake and the tsunami, and that had caused considerable confusion among Malaysians.

A friend of mine who has performed volunteer work in a number of natural disasters and calamities in this country has once said to me that our country deserves a better, more organised and dedicated volunteer force to meet future natural calamities. He claims that the existing government organisations established to handle national disaster situation is haphazard, lacking control and coordination, and appears to be having too many bosses giving too many instructions, and with too little hands to execute the instructions.

It seems that there is an obvious lack of a dedicated central coordinating body to actually monitor, report and make spot decisions and to response quickly to the immediate needs of those affected by the calamity. At the end of the day, each volunteer organisation is left to act on their own, and this results in a disproportionate relief effort that falls short of meeting actual needs. As an example, a place that requires food staffs is handed with too many clothing materials, and where medical support is urgently needed, there is only first aid kit available.

To add to the confusion, political parties with their party flags and posters get into the 'fray', and claims that the support and assistance they provide is in the name of their party. We saw such a thing happened during the Bukit Antarabangsa landslide disaster early this year. It has now become political where the actual needs of those affected people are not properly addressed. It is a kind of an election and popularity gimmick.

Clearly, there is some serious rethinking needed to address the failures so obvious during a disaster relief operations. I suppose there is already an existing national body responsible for national relief operations, but what need to be tightened up is the coordination of responsibilities, method of response, command and control of operations, liaison and possibly a planned prepositioning of support equipments and various immediate logistical needs in identifiable disaster prone areas.

The only way to address the above failures is to conduct periodical exercises and training, both at the state and national levels incorporating all government agencies involved, and including volunteer organisations and NGO's. This can be a costly and difficult affair, but it is only through such exercises and training that can assure success during the conduct of a disaster relief operations.

Disasters knows no limits and does not recognised a friend or a foe. It just destroys everything along its path, and if we are not ready with measures to defend and protect our lives and properties, then it is only us to blame; not the Creator, as some have said and claim it to be.

Era Najib Altantuya : Kes Kugan, Manicka Kesal Cuma Seorang Didakwa

Ahli Parlimen Kapar, S Manikavasagam, menyatakan kekesalan hanya seorang dari 11 anggota polis yang dituduh membunuh mendiang Kugan Ananthan tidak didakwa di mahkamah.

Pemimpin PKR itu berkata adalah tidak munasabah hanya seorang anggota berpangkat rendah diheret ke muka pengadilan walhal 10 lagi dari pelbagai pangkat dikatakan terbabit dalam pembunuhan itu.

"Mengapa seorang sahaja dihadapkan? dan dia seorang India. Perihal dia hanya seorang konstabel? Perihal ada pegawai yang OCPD ada, Chief Inspektor ada. Sebanyak 11 orang ada. Ditukar dari balai ke pejabat, kerja pejabat. Tapi sekarang saya tengok, satu orang sahaja yang didakwa" soalnya.

Manikavasagam menambah kerajaan tidak harus membedakan undang-undang untuk orang-orang kecil dan orang-orang besar termasuk polis. Sekiranya perbicaraan kes bunuh ini didapati tempang, maka rakyat akan melihat pemerintah menghalalkan penderaan dan keganasan polis.

" Ini saya rasa sepatutnya 24 jam mereka melakukan siasatan ke atas Kugan dan sekarang nampak seorang sahaja yang didakwa.Tetapi dalam kes di Batu Cave perhimpunan Hindraf, mereka baling batu tetapi didakwa kes bunuh, peguam negara dakwa kes bunuh tapi di sini seksyen lain pula. Yang ringan. Maksudnya anggota polis boleh bunuh sesiapa sahaja, tapi denda dia RM 10, 000 dia boleh keluar" ujarnya lagi.

Semalam, seorang anggota dari 11 anggota polis yang membunuh mendiang Ananthan Kugan diheret ke Mahkamah Sesyen Petaling Jaya.

Konstabel Navindran Vivekanadan dibicarakan untuk dua kesalahan menyebabkan kecederaan semasa memeras pengakuan dari mangsa, 16 Januari lalu.

Anggota polis itu didakwa di bawah Seksyen 331 Kanun Keseksaan kerana memeras mangsa sehingga mendatangkan kecederaan dan Seksyen 330 Kanun Keseksaan kerana menyebabkan mangsa mengalami cedera parah.

Jika disabitkan kesalahan, Navindran menghadapi 10 tahun penjara dan denda bagi Seksyen 331 dan tujuh tahun penjara bagi Seskyen 330. Navindran mengaku tidak bersalah dan minta dibicarakan.

Hakim Aslam Zainuddin menetapkan ikat jamin RM10,000 dan 5 November untuk sebutan kes.

Kugan telah ditahan pihak polis pada 15 Januari lalu kerana dikatakan terlibat dalam kes curi kereta mewah.

Beliau mati setelah lima hari berada dalam tahanan polis dengan keadaan badan cedera parah.

Navindran adalah anggota di Balai Polis Taipan, namun dipindahkan ke Ibu Pejabat Kontinjen Shah Alam selepas kejadian.

Menurut Peguam Negara Abdul Gani Patail, empat dari 92 saksi yang disoalsiasat polis mengenalpasti konstabel itu yang mencederakan Kugan pada waktu-waktu kejadian.

Mangsa dikatakan dibelasah dengan hos getah sebelum ditemui mati empat hari kemudian.

Peguam Negara menambah polis terbabit tidak akan didakwa di bawah kesalahan bunuh atas alasan mangsa mati empat hari kemudian selepas dibelasah.

" Double standard. Orang awam satu dakwaan, pegawai polis satu dakwaan. Bagi kita, kita tidak puas hati. Pada hari Selasa ini kita akan hantar 1 memorandum kepada tatatertib Bukit Aman dan juga mendesak Musa Hassan untuk letak jawatan. Dan pada 10/10, kita akan hantar memorandum ke istana, untuk desak dakwa yang 10 orang lagi".
