Debaran samada bekas pembantu Exco Selangor, Teoh Beng Hock di bunuh atau sebaliknya mungkin akan terjawab apabila pakar forensik Thailand, Dr Pornthip Rojanasunand dijangka mendedahkan laporan autopsi kedua beliau apabila prosiding inkues bersambung di Mahkamah Majistret Shah Alam.
Dr Pornthip membuat pendedahan yang mengegarkan negara apabila membuat kesimpulan bahawa kemungkinan 80 peratus Beng Hock dibunuh dan hanya 20 peratus sahaja beliau membunuh diri.
Jelas beliau tanda bulat pada leher mendiang Teoh menunjukkan dia 'dicekik' manakala retakan pada tengkorak mangsa bukan satu kecederaan akibat terjatuh lantas menyanggah pakar forensik kerajaan yang mendakwa Teoh membunuh diri.
Dr Pornthip adalah pengarah dan pengasas bersama Institut Pusat Sains Forensik Kementerian Keadilan Thailanad dan dianggap pakar dalam siasatan kes-kes pembunuhan yang rumit.
Pakar forensik itu membuat kesimpulan tersebut berdasarkan kepada tiga faktor penting termasuk laporan bedah siasat yang menyatakan mangsa masih hidup ketika jatuh di tanah, tetapi beliau tidak menemui kecederaan untuk melindungi diri.
Dr Pornthip juga menemui luka-luka yang kelihatan berlaku sebelum mangsa jatuh serta kecederaan pada bahagian dada adalah akibat impak awalan.
Kerajaan negeri Selangor menggunakan khidmat serta kepakaran Dr Pornthip bagi membantu siasatan ke atas kematian Beng Hock.
Bekas setiausaha politik berusia 32 tahun itu ditemui mati di bahagian koridor tingkat lima bangunan Plaza Masalam, Shah Alam, Selangor dipercayai akibat terjatuh dari tingkat 14, bangunan itu.
Mayat mendiang ditemui dalam keadaan terlungkup .
Beng Hock datang ke pejabat Suruhanjaya Pencegahan Rasuah Malaysia Selangor yang terletak di tingkat 14, Plaza Masalam pada 5 petang hari Rabu 15 Julai 2009 untuk memberi keterangan berhubung dakwaan penyalahgunaan peruntukan negeri Selangor.
Sehari sebelum kematian Teoh SPRM menyerbu pejabat majikannya, Exco Selangor Ean Yong Hian Wah di bangunan Sekretariat Negeri di Shah Alam untuk mencari dokumen berhubung cara peruntukan negeri dibelanjakan.
Mayat Beng Hock digali semula pada 21 November 2009 bagi menentukan punca sebenar kematian setelah pengumuman Dr Pornthip mengenai kesimpulan beliau menimbulkan keraguan pada keluarga mendiang.
Namun rumusan Pornthip itu disanggah oleh Dr. Shahidan Md Noor dari Hospital Sungei Buloh memberitahu inkues siasatan kematian Beng Hock bahawa kecederaan pada tubuh badan mendiang konsisten dengan mangsa yang jatuh dari tempat tinggi.
Dr. Shahidan juga bersetuju dengan hasil penemuan bedah siasat kali pertama yang dilakukan Dr. Khairul Azman Ibrahim dan Dr. Prashant Naresh Sambekar bahawa kecederaan yang dialami Beng Hock konsisten dengan mangsa yang jatuh dari tempat tinggi.
Peguam keluarga mendiang, Gobind Singh menegaskan pihaknya akan mencabar keterangan Dr Shahidan, khususnya mengenai kesam lebam di leher Beng Hock.
Inkues bagi mengenal pasti punca kematian Beng Hock hari ini bertumpu kepada laporan bedah siasat kedua mendiang yang di lakukan pada akhir tahun lalu.
"Itu pendapat pada masa kini dan kita akan melakukan pemeriksaaan balas terhadapnya, kita ada versi dan pendirian sendiri beberapa penemuan yang telah beliau jumpa. Tetapi apa yang penting bagi saya adalah untuk kita beri perhatian bahawa bukti dia pada hari ini seolah-olah mencadangkan terdapat tekanan pada bahagian leher,"katanya.
Gobind juga berkata apa yang jelas daripada keterangan shahidan ialah beberapa fakta penting tidak dimasukan dalam laporan bedah siasat pertama.
"Saya tidak akan membuat kenyataan lanjut kerana saya belum melakukan pemeriksaan balas terhadapnya, tetapi ia sesuatu yang memberi sinar dari bedah siasat pertama kerana ia tidak menyatakan fakta itu. Saya tidak akan beri komen mendalam mengenai perkara ini kerana ia tidak adil, bair kami lakukan pemeriksaan balas terhadap saksi pada 1 Mac ini. Kami akan mengajukan teori kami kepadanya dan dengar apa yang dia akan katakan, kita perlu adil kepada saksi,"katanya.
Gobind akan menyoal balas Shahidan pada 1 Mac.

PM's Facebook Fans Now More Than 100,000
KUALA LUMPUR, Feb 19 (Bernama) -- Prime Minister Datuk Seri Najib Tun Razak was delighted and moved by the response from the rakyat who have joined in his Facebook page, which has today recorded more than 100,000 fans.
Created in November last year, the page has until now reached 101,237 fans, who include not only Malaysians, but also foreign citizens.
"I am delighted and moved by this response, and by the interest you continue to show in my posts through leaving comments," he said in his latest Facebook status, updated as at 4pm Friday.
The Prime Minister also thanked everyone for becoming his fans and for helping to make the page an engaging forum for discussion.
"Let's continue this upward momentum," he added.
About an hour later, he received more than 200 comments from his fans, whom among others had pledged support and hoped that he would always be on the right track to bring peace and prosperity to the country ever after.
Not long after Najib took over the premiership from Pak Lah, he said, 'Give Me A Chance And Evaluate My Leadership Positively.' (Bernama report on April 06, 2009)
Why would Najib make such a plea - to give him a chance? Was it because deep in the recesses of his soul, he knew (and he still knows!) that he was merely the Umno-appointed PM who was without the 'stamp of approval' from the rakyat?

For 53 solid years, we have successfully managed to septumize the races. For 53 good years, we changed-our-mode enough times, so that the rakyat stayed confused and dumb enough NOT to challenge us. We have ensured that the peasants stayed poor and stupid enough so that they did not know of any alternatives, and were fighting hard just to feed themselves just to survive. The "clang" of your mental Ball-and-Chains delight us with orgasmic thrill.
We habitually showcase over TV all the poor Orang Aslis to reassert that "malays" are poor, even though they are NOT "malay". Then we dump them back into deep Jungle and tell them to wait "Insyallah" for another 53 years maybe for us to provide them with electricity. They believe us. We also made it illegal for anyone to talk to them, to guarantee that they remain that way; so that we can showcase them on TV again, the next time we need to show poor people.
We successfully told the rakyat that PAS is an Extremist Party. And you silly serfs believed us. You are so dumb. You are also dumb enough to believe that your "gods" are powerful enough to defeat us. Trust me. Your "gods" are useless. They are useless against our Ketuanan. You can scream. You can shout. The less "smart" the peasants are, the better. Best of all, you don't even know that you are deteriorated squabs. The less you know, the better. We have crippled your ability to speak to foreigners. We happily built vernacular schools specifically for that purpose. We simply cannot lord over those with brains.
And don't you dare tell anyone about this .... Our Ketuanan depends on Stupid Malaysians.

i went to visit one of my primary school teachers this chinese new year with some of my friends. puan giam , guru kelas when i was in standard 4. catching up n a whole lot more. it reminds me of my primary years ; lotsa sweet memories, being the head prefect n all. n i realized, its different now, the way we talk to her n the topics. n mun khea, actually mentioned, 'dulu, rasa pendek sangat, now, macam same height jer'. n yes, i agreed. ;P
we discussed about current issues, unity, MGS n mostly, our future. i can see how happy she is when we arrived n talk about how berjaya we are today. sebak rasanya.
we have grown up n its been more than 10 years, but, teacher, we will still be ur student.

Time flies, and it has been more than one month since my last post on 31 Dec 2009; and by the time I am in the mood to blog again it's Chinese New Year (CNY)!
Today is already the 6th day of the CNY but it's not too late for me to wish you Gong Xi Fa Cai (or Kong Hee Fatt Choy in my native Hakka). This is because the Chinese celebrate their New Year for 15 days; culminating in Chap Goh Mei (the 15th day) on 28 Feb which happens to be my birthday, yahoo! So this month alone I will have two double-celebrations - the other being 14 Feb which is both Valentine's Day and Day 1 of CNY.
So how did I celebrate my CNY which is Year of the Tiger? Well, first of all as usual we had our family reunion dinner on 13 Feb which is CNY Eve; except that this year instead of going back to my brother's in Tamparuli we just had a simple dinner here in KK; just the 5 of us - myself, my wife, our two sons, and my mother-in-law.This was because we had a morning flight on Saturday the 14th and therefore did not want to take any chance of missing the flight. Nonetheless, simple though as our dinner was, it was not without the Hakka dishes one would expect during CNY like Kiu Nyuk and Steamed Chicken.
Coming back to the flight, although it was CNY Day 1, we (my wife & I) had to send my mum-in-law to her son's place in Ipoh, Perak where he works - something which we had promised her for some time and so we took advantage of the week-long school holiday (my wife is a teacher).
After spending two nights in Ipoh and leaving my mum-in-law behind as requested, we moved south to Kuala Lumpur where we spent 3 nights before coming home (sweet home) in KK a few hours ago. The first nite in KL was spent in Mutiara Damansara which is quite a distance from downtown KL. There was a reason for that but I will only elaborate in my next posts.
Most of our 2-day stay in KL city proper was spent along Jalan Tuanku Abdul Rahman (TAR), known in the pre-Merdeka (Independence) days as Batu Road. The reason was simple - my wife wanted to buy from the traditional Indian textile shops which are aplenty along TAR road and they are all next to each other. Another beauty of TAR road (especially the stretch nearer Merdeka Square) is that once one has finished shopping at the textile shops, there is also the ultra-modern Sogo Shopping Complex selling more luxurious and branded items. If I am not mistaken, Sogo is a Japanese emporium chain just like Yao Han which was popular in the 1980s both in KL and KK but has since 'disappeared'. And both the Monorail and RapidKL are within walking distance too so you don't have to depend on the blood-sucking taxis.
Another characteristics of Jalan TAR is that it is one of the oldest parts of KL so that most 2 or 3-storey shops were built between the late 1940s and the early 1950s after the 2nd World War. Infact, standing at what used to be Batu Road and looking at the old shophouses (some of which look as if they can collaspe any time), one may start wondering if he is actually in the middle of a city. Batu means stone in the Malay language. I am not sure why it was called such but a good guess would be it was one of the first, if not the first, KL streets to be paved after the War.
Most men would not trail their wives when the latter shop for obvious reasons. So while my wife shopped and shopped, I had plenty of opportunity to explore Batu Road and surrounding areas on my own for two days, on foot. When I had walked far enough and was tired, I returned to the hotel by the nearest light-rail transit train.
One of the old shops I managed to explore, rather frequent, was an old Hainanese-style coffee shop while waiting for my wife. By the time we had to go back to Sabah, I had already made friends with the owner of the shop - the Capital Cafe. I did not ask the owner why it was called Capital but my suspicion is that it was because KL was the first Capital of Malaya (later Malaysia) and everybody was proud of the Self-Rule (1955) and Independence (1957) gained from the British then. It must be remembered that the Merdeka (Independence) mood filled the air around that period.
Another reason why I decided to write about this coffee shop is that after a few visits over two days for lunch and high-tea, I realised that it was unique in the sense that although it was a Chinese-owned coffeeshop and the cook (who fries noddles and rice) at the right entrance of the shop is also Chinese; the Muslims including Malays would not hesitate to eat there, including what the 'Chinaman' cooked. Now this is something very rare in KL. I know because I worked in KL in the 1980s for 3 years.

To complete the cafe's services or products, there was also a stall offering Indian-style fast food at the centre of the entrance and then an Indonesian-style Nasi Padang stall occupying the left entrance of the shop. So you have Chinese, Indian and Malay stalls all under one roof - this is not easy to find in KL and this is what I call a true 1Malaysia Cafe!

However, although the middle-aged Chinese cook only fries Hainanese-style noddles, neither he nor the shopowner are Hainanese. Infact, they are both Foo Chows. The cook, a Mr Tan (Ting to most Foo Chows) was born in China, came to KL as a young man, and has been standing there frying mee for the last few decades! The owner, a Mr Ling, who is now in his 60s was born in British Malaya and his son is assiting him in the shop. In other words, it's already 2nd generation running the shop. But the younger Ling said he wasn't too sure if his children would want to take over one day for obvious reasons.
(Pix above) The senior Ling, in his 60s, still makes the drinks in his cafe although he is assisted by Indian workers. I suppose it's not easy for him to give up something which he has been doing for the past few decades and having built up the clientele over half-a-century some of whom have either retired or even died. But the younger Ling has already been groomed to take over him any time.
The Capital Cafe is also popular with guests staying in the many budget hotels along Jln TAR, so much so that the younger Ling called it "the coffee house of the budget hotels", in an obvious reference to the absence of coffee houses in budget hotels and the Capital Cafe's popularity with such hotel guests.

The day may finally come, may be another couple of decades from now, when even the younger Ling retires and if his children refuse to succeed him, the future of Capital Cafe may be at stake and with it a piece of KL history may be gone. I certainly hope not, for I look forward to visiting the coffee shop many more times, God-willing.

(Pix above) Uncle Tan has been practically standing like this frying noodles and rice over the last few decades. Note the notice on the wall - it's the menu which has been there since 1956! Uncle Tan is no longer young and it's a pity if there is no one to replace him. By the way, the noodles and fried rice are much cheaper than in Sabah, although the price has of course gone up compared to the 1980s when I worked in KL.

BANGKOK, Feb 19 — Stateless Rohingya refugees who fled oppression in their native Myanmar are being beaten and driven from their makeshift homes in neighbouring Bangladesh, rights and humanitarian groups said today.
Thousands of Rohingyas, who are not recognised in their homeland, are packed into camps run by the United Nations in Bangladesh. Another 300,000 live illegally in the country and face attacks by the authorities and destruction of their homes, according to medical charity Medecins Sans Frontieres (MSF).
The group says it has been treating the Rohingyas at makeshift camps in Kutupalong, southeastern Bangladesh, for trauma wounds as a result of beatings by police.
Some had been forced into a river and told to swim back to Myanmar. (MAY BE THEY TOOK THE CUE FROM ONE OIC LEADER, EX_PM WHO ADVISED THE THAI NEWSPAPER and now working as the head of Islamic Think Tank)
"They claimed they've been living in Bangladesh for a number of years and their neighbours have turned on them," said the head of MSF's mission in Bangladesh, Paul Critchley.
Every year, thousands of minority Muslim Rohingyas flee Myanmar in wooden boats, embarking on a hazardous journey to Thailand or Malaysia in search of a better life.
Some find work as illegal labourers, others are arrested, detained and "repatriated" to a military-ruled country that washed its hands of them decades ago.
Rohingyas say they are deprived of free movement, education and employment in their homeland. They are not recognised as an ethnic minority by Myanmar and say they suffer human rights abuses at the hands of government officials.
Many have sought refuge in neighbouring Bangladesh, living in mud huts covered in plastic sheets and tree branches, which provide poor shelter during monsoon rains that cause mudslides and expose them to waterborne diseases.
Bangladesh says there are about 28,000 registered Rohingya refugees in two UN camps near the southeastern resort of Cox's Bazaar.
Since October last year, a makeshift camp in Kutupalong has grown by more than a quarter, or 6,000 people, with 2,000 of these arriving in January alone.
As the numbers swell, the cramped and unsanitary living conditions pose significant health risks, MSF said.
Three months earlier, Bangladeshi authorities demolished shelters and forcibly removed their inhabitants in an attempt to clear a space around the Kutupalong camp, MSF said.
"MSF witnessed first-hand violence against the unregistered Rohingya, and provided medical care for some of the consequences," it said in a statement.
MSF said it continued to treat more Rohingyas in the months after for injuries inflicted when they were forcibly evicted.
"MSF has treated patients for beatings, for machete wounds, and for rape. This is continuing today," it said.
Refugee groups say many impoverished Bangladeshis resent Rohingyas for the pressure they are putting on scarce local services and resources.
David Mathieson, a researcher for Human Rights Watch, said the Rohingyas had been victims of a "pattern of abuses" in Bangladesh for more than 30 years and the government had made it clear it wanted rid of them.
"It's not as if these incidents came out of the blue. They're part of a very long-running brutal process of making life so uncomfortable for the people in the camp that they'll return to Burma," he said, referring to Myanmar by its former name.
"They fled some absolutely horrific human rights violations in their own country. They're justifiably too frightened to return."

Dua anggota Jabatan Imigresen cedera terjatuh dari bumbung ketika cuba menahan dua pendatang asing tanpa izin warga Indonesia yang mahu melarikan diri dengan meniti titi sebatang kayu daripada bumbung rumah sewa mereka ke rumah lain.
Ketua Unit Tindakan Imigresen Putrajaya, Mohd Azmi Mohd Isa, berkata ia berlaku kira-kira 1 pagi ini ketika mereka membuat operasi di Kampung Pasir Pantai, di sini.
Katanya, kedua-dua lelaki itu bertindak demikian setelah dua jam duduk di atas bumbung rumah tersebut apabila gagal melarikan diri setelah dikepung.
Mohd Azmi berkata, setelah usaha memujuk kedua-dua lelaki itu gagal, dua anggota Imigresen cuba untuk naik ke bumbung tetapi pendatang asing itu cuba melarikan diri dengan meniti titi kayu itu.
"Dua orang pegawai Imigresen cedera setelah jatuh dari bumbung. Bagaimanapun, mereka hanya cedera ringan," katanya ketika dihubungi.
Kedua-dua lelaki itu akhirnya dapat ditangkap bersama tujuh lagi pendatang wanita dari Indonesia yang semuanya berumur dalam lingkungan 30an.
Mohd Azmi berkata, selain Kampung Pasir Pantai, Imigresen turut membuat operasi di sekitar Bukit Kemuning, Shah Alam kira-kira jam 3.30 pagi dan menahan 10 warga Indonesia, termasuk lima wanita yang tiada dokumen perjalanan yang sah.
Mereka kini ditahan di Depot Tahanan Imigresen Lapangan Terbang Kuala Lumpur (KLIA) untuk tindakan lanjut dan disiasat mengikut Seksyen 6(3)Akta Imigresen 1959/63 dan Seksyen 56(1)(l) Akta Imegresen 1956/63 kerana tidak mempunyai sebarang dokumen yang sah. - Bernama

Ahli Parlimen Australia Michael Danby menganggap perbuatan Datuk Ibrahim Ali yang menggelar beliau peliwat sebagai "bodoh" dan "jahil"
Dalam komen beliau kepada Suara Keadilan, anggota Parlimen daripada Parti Buruh Australia (ALP) itu berkata tindakan Presiden Pertubuhan Pribumi Perkasa hanya memalukan Perdana Menteri Najib Razak dan Umno di mata dunia.
Semasa demonstrasi di hadapan Suruhanjaya Tinggi Australia yang dianjur bersama oleh Perkasa, Pergerakan Pemuda Umno dan Barisan Nasional Rabu lalu, Ahli Parlimen Pasir Mas itu mendakwa Danby sebagai "homosexual" (peliwat).
Ibrahim memetik peribahasa Inggeris, "birds of a feather flock together" sambil berkata, "Saya dengar Danby adalah peliwat!," pada demonstrasi tersebut.
"Menyerang secara peribadi dengan melabelkan saya sebagai "homosexual" adalah menjijikkan dan perbuatan hina.
"Berbeza dengan negara ini, kami menilai seseorang di atas kekuatan peribadi dan tidak menghakimi seseorang itu berdasarkan kepada peribadi mahupun kaum, agama ataupun orientasi seks mereka.
"Kenyataan bodoh daripada Ahli Parlimen yang menyokong kerajaan seperti Ibrahim Ali bukan sahaja membuktikan pemikiran yang lemah dan jahil tetapi juga memalukan Perdana Menteri Najib Razak dan parti pemerintah Umno.
"Kenyataan tersebut membuktikan kepada rakyat dan masyarakat antarabangsa bahawa kerajaan Malaysia tidak mempunyai apa-apa asas kukuh untuk mempertahankan pertuduhan terhadap Anwar Ibrahim melainkan menggunakan taktik melempar gelaran hina kepada orang lain," kata Ahli Parlimen Melbourne Ports berusia 55 tahun itu.
Perkasa bersama anggota Pergerakan Pemuda Umno dan BN berdemonstrasi di hadapan Suruhanjaya Tinggi Australia di Jalan Yap Kwan Seng bagi membantah tindakan sekumpulan Ahli Parlimen Australia yang mendesak pertuduhan tidak berasas ke atas Ketua Umum KEADILAN Datuk Seri Anwar Ibrahim digugurkan.
Pada 11 Februari lalu Danby serta 50 Ahli Parlimen Australia menghantar surat rasmi kepada Pesuruhjaya Tinggi Malaysia di Australia Datuk Salman Ahmad bagi mendesak tuduhan tersebut digugurkan. -SK

The long Chinese New Year (CNY) break is almost over. Most places were closed for nearly a week and the crowd is expected back in droves over the weekend. One thing I really like about the long CNY break is the traffic or rather lack of traffic on the roads.
It's really one of the best times to drive around the capital hassle free. I did take a drive into the heart of town on purpose just to enjoy the traffic-less situation but surprisingly the traffic was heavier than I thought it would be.
I guess not many people go back to their hometowns for the CNY celebrations these days. I remember back in my younger days, whenever the Chinese New Year comes along, the town would practically be a dead town for the entire week with all the shops and businesses being closed.
There would be hardly any cars on the road and we even managed to go and lie flat on the federal highway in the middle of the afternoon and live to tell the tale :D If we tried that today, we'd be flattened in no time! Back then, when things closed down for the CNY break, it REALLY closed down.
Trying to even find a place that was open just to eat would be like finding a needle in a haystack. I use to hangout with my buddies during the entire CNY break back then and we would always have to resort to going to 7-11 and buying canned stuff or instant noodles to eat cos there really wasn't a single shop that would be open.
And we would welcome the day when the celebrations were over and things got back to normal cos we'd get to eat our favourite foods again. But that was all in the past. These days there would always be some shops that would be open though they would charge a little higher than normal.
In fact I think they're still charging even higher than normal cos this afternoon wifey and me went out for some business dealings and had lunch at this Chinese restaurant and the food was a lot more pricey than normal. I don't think we'll be eating at that shop anymore!
I actually wanted to write this post about this wrinkle cream that I saw today but am too tired to type out one of my usual long winded postings. Being your own boss does tend to make you work even harder cos now I cannot afford to slip up since it's my own company now :D
I'm going to call it an early night so you guys have a great weekend now you hear.

Presiden Pas selar Ahli Parlimen Australia - Bernama
KUALA TERENGGANU: Presiden Pas, Datuk Seri Abdul Hadi Awang, hari ini menyelar tindakan beberapa Ahli Parlimen Australia untuk campur tangan dalam kes liwat membabitkan Penasihat Parti Keadilan Rakyat, Datuk Seri Anwar Ibrahim.
Katanya, beliau mahu perkara itu diselesaikan mengikut sistem kehakiman negara ini tanpa dipengaruhi oleh anasir luar.
"Dari segi campur tangan asing, saya sebagai rakyat Malaysia, saya mahu negara kita menjadi sebuah negara yang berdaulat dan tidak perlulah kepada campur tangan asing apatah lagi dari negara Barat, negara bukan Islam," katanya kepada pemberita selepas merasmikan himpunan pemuda Islam Kuala Terengganu di Kuala Ibai dekat sini.
Baru-baru ini, 50 penggubal undang-undang Australia itu telah meminta Malaysia menggugurkan pertuduhan liwat terhadap Anwar.
Tindakan mereka ini dikecam hebat pelbagai pihak di negara ini kerana dilihat cuba mencampuri urusan dalaman Malaysia.
Abdul Hadi, bagaimanapun, berkata Pas tidak bercadang untuk mengemukakan sebarang bantahan berhubung campur tangan Ahli Parlimen Australia itu.
Beliau mencadangkan badan kehakiman negara ini diletakkan di bawah Parlimen atau Majlis Raja-raja bagi mengelak badan itu dipengaruhi mereka yang berkepentingan.
Mengenai cadangan Pas untuk menjalin kerjasama dengan Umno dalam isu keselamatan, ekonomi, agama dan politik, Abdul Hadi berkata Pas sentiasa terbuka untuk mengadakan sebarang bentuk muzakarah dengan Umno.
"Kita bersikap positif sepanjang masa dalam perkara yang positif, yang baik dan kita akan bekerjasama," katanya.
Bagaimanapun, Abdul Hadi berkata kerjasama untuk membentuk kerajaan perpaduan seperti yang pernah dicadangkan dahulu tidak akan berlaku.
Ya itu persoalannya: benarkah Haji Hadi berkata demikian?
Jika benar nampaknya ia selari dengan suara para pendemo tempohari oleh Ibrahim Ali dari Perkasa, UMNO dan BNBBC yang dikatakan membantah campurtangan Australia di dalam urusan kehakiman di dalam negara ini. Dan sewajarnya Presiden PAS telah menyertai demo berkenaan.
Sedangkan ahli-ahli Parlimen Pakatan Rakyat (PR) sebelum ini telah mengecam tindakan Ahli-ahli Parlimen daripada juak Umno-Barisan Nasional (BN) yang membuat demonstrasi di hadapan pejabat Suruhanjaya Tinggi Australia itu, sebagai tidak wajar dan tidak mewakili hati dan pemikiran mereka.
Malah demonstrasi itu jelas menunjukkan ketakutan pihak Umno-BN yang mendapat tekanan daripada 50 Ahli Parlimen Australia baru-baru ini, meminta kerajaan Malaysia mengugurkan pertuduhan kes liwat terhadap Ketua Umum KEADILAN, Datuk Seri Anwar Ibrahim.
Ahli-ahli Parlimen PR sepakat akan menghantar memorandum kepada Peguam Negara, Tan Sri Abdul Gani Patail agar menggugurkan pertuduhan ke atas Anwar secepat mungkin.
Malah mereka akan memohon satu tarikh bagi mesyuarat tergempar kepada Speaker Dewan Parlimen, Tan Sri Datuk Seri Utama Pandikar Amin Mulia sebelum Parlimen bersidang Mac depan.
Sementara itu menurut Ahli Parlimen Pokok Sena, Datuk Mahfuz Omar kes itu perlu ditarik balik kerana tidak mahu Malaysia dan badan kehakiman secara keseluruhannya dianggap sebagai raja lawak.
Jika kenyataan Hj Hadi itu tidak benar dan diputarbelitkan oleh media arus perdana, sekali lagi Presiden PAS perlu membuat "pembetulan" setelah pembetulan dilakukan terhadap satu kenyataannya yang lain sebelum ini yang dikatakan telah diputarbelit oleh Utusan Malaysia.
Yang bertanda merah itu, dipertikaikan oleh kebanyakan oleh ahli-ahli PAS sendiri. Apakah benar sudah berlaku anjakan paradigma di kalangan ahli UMNO seperti yang disuarakan oleh Presiden PAS? Apakah benar tidak ada gangguan-gangguan dari segi semangat federalisma?

Seorang pegawai Suruhanjaya Pencegah Rasuah Malaysia (SPRM) mengaku tidak bersalah di Mahkamah Sesyen Shah Alam pagi ini, terhadap tuduhan meminta dan bersetuju menerima rasuah daripada seorang suspek siasatan kes rasuah, pada Oktober tahun lalu.
M Mohan, 37, yang merupakan Penolong Penguasa SPRM Selangor didakwa mengikut Seksyen 16 (a)(B) Akta Suruhanjaya Pencegahan Rasuah Malaysia 2009.
Dia dituduh meminta bagi dirinya suapan RM250,000 daripada A Sinnaiah sebagai dorongan tidak meneruskan siasatan terhadap suspek yang disyaki memberi rasuah kepada pihak Jabatan Pendaftaran Negara dan Jabatan Imigresen Malaysia.
Tertuduh yang sudah berkhidmat selama 15 tahun turut didakwa mengikut Seksyen 17 (a) akta sama, iaitu bersetuju menerima suapan RM200,000 daripada Sinnaiah untuk tujuan sama.
Mohan didakwa melakukan kesalahan itu antara 11 pagi hingga 1 tengahari pada 22 Oktober 2009 di pejabat SPRM, Tingkat 14, Plaza Masalam, Shah Alam.
Hakim Azhariz Teh Azman Teh membenarkan tertuduh dibebaskan dengan jaminan RM7,000 dan menetapkan 23 Ogos ini untuk perbicaraan kes itu.

All of us are investors, in one way or another. I am sure most of us have unpleasant experiences of investing mistakes. That includes me. Mistakes are certainly costly, but they can be minimised by way of learning from lessons. Alternatively, we may heed the advice of certain experts who are smarter than us.

Burton G. Malkiel, Princeton economics professor and author of 'A Random Walk Down Wall Street,' and Charles D. Ellis, author of 'Winning the Loser's Game,' have teamed up to write 'The Elements of Investing.'
We're both in our seventies. So is Warren Buffett. The main difference between his spectacular results at Berkshire Hathaway and our good results is not the economy and not the market, but the man from Omaha. He is simply a better investor than just about any other in the world. Brilliant, consistently rational, and blessed with a superb mind for business, he has managed to avoid the mistakes that have crushed so many portfolios. Let's look at two examples.
In early 2000, Berkshire Hathaway's portfolio had underperformed funds that enjoyed spectacular returns by loading up on stocks of technology companies and Internet startups. Buffett avoided all tech stocks. He told his investors that he refused to invest in any company whose business he did not fully understand - and he didn't claim to understand the complicated, fast-changing technology business - or where he could not figure out how the business model would sustain a growing stream of earnings. Some said he was an old fuddy-duddy. Buffett had the last laugh when Internet-related stocks came crashing back to earth.
In 2005 and 2006, Buffett largely avoided the mortgage-backed securities and derivatives that found their way into many investment portfolios. Again, his view was that they were too complex and opaque. He called them "financial weapons of mass destruction." When they brought down many a financial institution (and ravaged our entire financial system), Berkshire Hathaway avoided the worst of the meltdown.
At our two favorite universities, Yale and Princeton, psychologists are fond of giving students questionnaires asking how they compare with their classmates. For example, students are asked: "Are you a more skillful driver than your average classmate?" Invariably, the overwhelming majority answer that they are above-average drivers. Even when asked about their athletic ability, where one would think it more difficult to delude oneself, students generally say they're above average. They see themselves as above-average dancers, conservationists, friends, and so on.
And so it is with investing. In recent years, a group of behavioral psychologists and financial economists have created the important new field of behavioral finance. Their research shows that we are not always rational. We tend to be overconfident. If we do make a successful investment, we confuse luck with skill. It was easy in early 2000 to delude yourself that you were an investment genius when your Internet stock doubled and then doubled again.
To deal with the pernicious effects of overconfidence, think about amateur tennis. The player who steadily returns the ball, with no fancy shots, is usually the player who wins. And the prudent buy-and-hold investor who holds a diversified portfolio through thick and thin is the investor most likely to achieve his long-term goals.
2. Following the Herd
People feel safety in numbers. Investors tend to get more and more optimistic, and unknowingly take greater and greater risks, during bull markets and periods of euphoria. That is why speculative bubbles feed on themselves.
But any investment that has become a widespread topic of conversation among friends or has been hyped by the media is very likely to be unsuccessful. Throughout history, some of the worst investment mistakes have been made by people who have been swept up in a speculative bubble. Whether with tulip bulbs in Holland during the 1630s, real estate in Japan during the 1980s, or Internet stocks in the United States during the late 1990s, following the herd - believing that "this time it's different" - has led people to make some of the worst investment mistakes.
Just as contagious euphoria leads investors to take greater and greater risks, the same self-destructive behavior leads many to sell at the market's bottom when pessimism is rampant.
More money went into equity mutual funds during the fourth quarter of 1999 and the first quarter of 2000 - the top of the market - than ever before. Most of that money went to high-tech and Internet investments, the ones that turned out to be the most overpriced and then declined the most during the subsequent bear market. And more money went out of the market during the third quarter of 2002 than ever before, as mutual funds were redeemed or liquidated - just at the market trough. Later, during the punishing bear market of 2007-09, new record withdrawals were made by investors who threw in the towel at record lows just before the first, and often best, part of a market recovery.
It's not today's price or even next year's price that matters; it's the price you'll get when you sell. For most investors, that's in retirement - and even at age 60, chances are you will live another 25 years and your spouse may live several years more. So don't let the crowd trick you into either exuberance or distress. Remember the ancient counsel, "This too shall pass."
3. Timing the Market
Does the timing penalty - the cost of second-guessing the market - make a big difference? You bet it does. The stock market as a whole has delivered an average rate of return of 9.6% over long periods of time.
But that return measures only what a buy-and-hold investor would earn by putting money in at the start of the period and keeping his money invested through thick and thin. The average investor's actual returns are at least two percentage points lower because the money tends to come in at or near the top and out at or near the bottom.
In addition to the timing penalty, there is also a selection penalty. When money poured into equity mutual funds in late 1999 and early 2000, most of it went to the riskier funds - those invested in high tech and Internet stocks. The staid "value" funds, which held stocks selling at low multiples of earnings and with high dividend yields, experienced large withdrawals. During the bear market that followed, these same value funds held up very well while the "growth" funds suffered large price declines. So the gap between overall market returns and an investor's actual returns is even larger than those two percentage points.
4. Assuming More Control Than You Have
Psychologists have identified a tendency in people to think they have control over events even when they have none. That can lead investors to overvalue a losing stock in their portfolio. It also can lead them to imagine trends when none exist or believe they can spot a pattern in a stock chart and thus predict the future. In fact, the changes in stock prices are very close to a "random walk": There is no dependable way to predict the future movements of a stock's price from its past wanderings.
The same holds true for supposed seasonal patterns, even if they appear to have worked for decades. Once everyone knows there is a Santa Claus rally in the stock market between Christmas and New Year's Day, the "pattern" will evaporate. Investors will buy one day before Christmas and sell one day before the end of the year to profit from the supposed regularity. But then investors will have to jump the gun even earlier, buying two days before Christmas and selling two days before the end of the year. Soon all the buying will be done well before Christmas and the selling will take place right around Christmas. Any apparent stock market pattern that can be discovered will not last as long as there are people around who will try to exploit it.
5. Paying Too Much in Fees
There is one piece of investment advice that, if you follow it, can dependably increase your returns: Minimize your investment costs. We have spent two lifetimes thinking about which mutual fund managers will have the best performance year in and year out. Here's what we now know: It was and is hopeless.
That's because past performance is not a good predictor of future returns. What does predict investment performance are the fees charged by the investment manager. The higher the fees you pay for advice, the lower your return. As our friend Jack Bogle, founder of mutual fund company the Vanguard Group, likes to say, "You get what you don't pay for."
We looked at all equity mutual funds over a 15-year period and measured the rate of return produced for their investors, as well as all the costs charged and the implicit costs of portfolio turnover - the cost of buying and selling portfolio holdings. We then divided the funds into quartiles. The lowest-cost-quartile funds produced the best returns.
If you want to own a mutual fund with top-quartile performance, buy a fund with low costs. If we measure after-tax returns, recognizing that high-turnover funds tend to be tax-inefficient, our conclusion holds with even greater force.
6. Trusting Stockbrokers
The stockbroker's real job is not to make money for you but to make money from you. Brokers tend to be friendly for one major reason: It gets them more business. The typical broker "talks to" about 75 customers who collectively invest about $40 million. (Think for a moment about how many friends you have and how much time it takes you to develop each of those friendships.) Depending on the deal he has with his firm, your broker gets about 40% of the commissions you pay.
So if he wants a $100,000 income, he needs to gross $250,000 in commissions charged to customers. Now do the math. If he needs to make $200,000, he'll need to gross $500,000. That means he needs to take that money from you and each of his other customers. Your money goes from your pocket to his pocket. That's why being "friends" with a stockbroker can be so expensive. A broker has one priority: getting you to take action, any action.
We urge you not to engage in "gin rummy" behavior. Don't jump from stock to stock or from fund to fund as if you were selecting and discarding cards in a game. You'll run up your commission costs - and probably add to your tax bill as well.

Angkatan Muda Keadilan (AMK) menggesa semua pihak, terutama Pemuda Umno, menghentikan demonstrasi bagi membantah sokongan masyarakat dunia supaya memastikan Ketua Umum KEADILAN, Datuk Seri Anwar Ibrahim mendapat keadilan.
"Sebaliknya mereka perlu memberikan tumpuan dan berusaha untuk memastikan negara mampu menjadi warga dunia yang bertanggungjawab dengan keadilan ditegakkan dan mahkamah tidak diperalatkan," kata ketuanya Shamsul Iskandar Md Akin (gambar).
Bercakap kepada pemberita di luar Mahkamah Tinggi Kuala Lumpur semalam ketika menghadiri perbicaraan tuduhan liwat terhadap Ketua Umum KEADILAN Datuk Seri Anwar Ibrahim beliau berkata, "Tindakan tidak ambil peduli terhadap tuntutan dan bantahan masyarakat dunia ini memberi impak yang akan menjejaskan kedudukan Malaysia di mata dunia."
Shamsul menegaskan, "tuntutan agar negara-negara lain tidak ambil peduli dengan segala kezaliman yang berlaku di Malaysia akan mengasingkan Malaysia daripada komuniti demokratik dunia.
"Risikonya Malaysia mungkin terjerumus ke dalam kelompok negara-negara yang terpinggir dan dipulaukan," ujar beliau.
Beliau menjelaskan perjalanan 'kangaroo court' yang membicarakan kes Anwar ini secara tidak langsung menyebabkan kredibiliti sistem kehakiman negara terjejas dengan teruk.
Kesannya, syarikat-syarikat asing tidak yakin untuk melabur dan berurusan dengan Malaysia sekiranya tiada keyakinan mereka boleh mendapat perlindungan yang adil dari mahkamah-mahkamah.
Menurut beliau, perbicaraan terhadap Anwar dan skandal pelantikan hakim dalam kes V K Lingam menimbulkan kepercayaan bahawa mahkamah di Malaysia boleh dimanipulasi dan diperkudakan mengikut telunjuk pemerintah.
"Lihat sahaja keterangan tidak masuk akal yang dilemparkan serta usaha menghalang Anwar daripada mendapatkan bukti dan senarai saksi menyebabkan bukan sahaja rakyat malah dunia melihat perbicaraan tersebut sebagai sandiwara atau 'sham trial'.
"Maka masyarakat dunia yang berpegang kepada nilai keadilan akan terus mengecam kezaliman dan menuntut dihentikan," jelas beliau.
Beliau berkata, "ini dapat dilihat apabila ulama terkenal, Dr Yusof Qaradawi mengkritik perbicaraan yang penuh dengan fitnah ini.
Ahli-ahli Parlimen Australia menuntut perbicaraan ini dihentikan.
Pengerusi Jawatankuasa Senat Amerika Syarikat, John Kerry menuntut Anwar diberi keadilan yang sewajarnya."
Shamsul turut menyifatkan tindakan Perdana Menteri Datuk Seri Najib Tun Razak dan Barisan Nasional cukup terdesak kerana terpaksa mengharapkan fitnah dan konspirasi untuk terus bergayut kepada kuasa di negara ini.

PARIS, Feb 18 — A French fast food chain's decision to serve only halal meat in eight restaurants with a strong Muslim clientele has sparked a wave of criticism from politicians decrying the step as unacceptable.
A far-right leader said the 350-branch Quick chain was imposing "an Islamic tax" on its customers. A Socialist mayor has threatened a law suit for discrimination against customers who do not want to eat according to Muslim dietary laws.
The uproar, like France's drive to ban Muslim face veils and its state-led debate on national identity, has come just ahead of regional elections next month even though Quick began what it calls a six-month marketing test in late November.
The €5.5 billion (RM27.5 billion) halal market in France is growing strongly, according to a survey in December 2009, citing increasing demand among young Muslims for halal produce.
Marine Le Pen, vice president of the far-right National Front, launched the accusations on Sunday, saying clients "are forced because of halal meat to pay a tax to Islamic organisations" that certify the food was produced according to Muslim dietary laws. Socialist Mayor Rene Vandierendonck in Roubaix, a town near Lille with many Muslim residents, threatened a law suit. Lionnel Luca, a conservative parliamentary deputy, called for a boycott to restore "freedom of choice" in the Roubaix Quick.
Agriculture Minister Bruno Le Maire told the daily Le Figaro: "When they remove all the pork from a restaurant open to the public, I think they fall into communalism, which is against the principles and the spirit of the French republic."
Escalating her attack, Le Pen said yesterday that President Nicolas Sarkozy supported a "forced Islamisation of France" because an arm of the state-owned savings bank, the Caisse des Depots et Consignations, held 99.63 per cent of Quick's capital.
At issue is meat slaughtered according to the dietary laws of Islam, which shuns pork. The US fast food chain McDonald's, which has about 1,150 branches in France, does not serve halal meat. Another US chain, Kentucky Fried Chicken, says it does.
Abbas Bendali, director of the Paris marketing firm Solis, said Quick's decision simply responded to growing competition from smaller halal restaurants. France's five million Muslims make up about eight per cent of the overall population.
"Large companies have become aware of Muslim consumers and the market they represent," he told Europe 1 radio, adding that several leading food companies and supermarket chains had also added or expanded halal product lines recently.
According to a Solis study, French Muslims will spend about €4.5 billion on halal food — mostly meat and cold cuts — in shops and another billion euros on halal fast food this year.
"The halal sector … is a real growth factor in this crisis year," it wrote. Younger Muslims born in a baby boom in a growing Muslim community in the 1980s and 1990s were driving the demand, Solis said.

Ghairah mahu menikmati hidup bersuami isteri selepas bertemu kekasih ketika sama-sama menuntut di menara gading, namun pada masa sama tidak mahu perbuatan itu diketahui ibu bapa mendorong segelintir pelajar di sebuah institusi pengajian tinggi awam (IPTA) ternama di pinggir ibu negara terjerumus dengan amalan 'pernikahan dalam dorm (asrama)'.
Perkahwinan adalah fitrah manusia, namun amalan di kalangan mahasiswa terbabit nyata meragukan apabila upacara pernikahan pasangan pengantin terbabit hanya disempurnakan sesama rakan sekuliah selaku kadi, wali dan saksi - tidak ubah seperti pernikahan koboi.
Seperti pasangan normal, kumpulan terbabit juga mempunyai kadi yang menikahkan pasangan berkenaan secara berjabat tangan dengan pengantin lelaki sebelum diperakui sebagai sah oleh saksi. Cuma yang berbeza ia dilakukan pada waktu malam dan semua yang hadir hanya rakan sekuliah.
Sehingga kini, tujuh pasangan di IPTA berkenaan dikesan melangsungkan pernikahan yang didakwa mereka sah dan halal mengikut mazhab dianuti, sedangkan umat Islam di negara ini berpegang kepada Mazhab Syafie yang mengamalkan cara pernikahan berbeza.
Selepas berlangsung majlis akad nikah di asrama lelaki dalam kampus IPTA berkenaan, 'pasangan pengantin' baru dibenarkan menjalani kehidupan sebagaimana suami isteri yang diijabkabulkan mengikut amalan Ahli Sunnah Wal Jamaah.
Bagaimanapun, kegiatan songsang itu akhirnya terbongkar apabila satu daripada pasangan yang bernikah mengikut kaedah meragukan itu menemui Pengerusi Pertubuhan Kebajikan Sahabat Insan dan Iman Malaysia (Sidim), Hanafi Abdul Malek, untuk mendapatkan pandangan.
Sarat mengandung bayi hasil pernikahan itu, gadis berusia 23 tahun berkenaan serta pasangannya berusia sebaya menemui Hanafi kerana tidak sanggup lagi menyorokkan perkahwinan mereka daripada pengetahuan ibu bapa.
"Saya didatangi pasangan terbabit baru-baru ini. Saya ingatkan mereka mungkin datang kerana terjebak masalah sosial, tapi alangkah terkejut apabila mereka mendakwa berkahwin di asrama lelaki IPTA berkenaan.
"Kadi, wali, saksi dan tetamu semuanya terdiri pelajar. Mereka mendakwa menganut mazhab yang membenarkan perkahwinan dengan cara sedemikian.
"Semua kes pernikahan itu tidak diketahui ibu bapa pasangan terbabit. Pelajar berkenaan yakin pernikahan itu sah semata-mata dengan alasan mereka mempelajari segala hukum-hakam dalam mazhab berkenaan yang membolehkan upacara pernikahan pelik itu dijalankan," kata Hanafi ketika ditemui di pejabatnya di sini, baru-baru ini.
Menurutnya, berdasarkan pengakuan pasangan terbabit, mereka yang mendakwa sudah 'sah' sebagai suami isteri menyewa tempat tinggal sama ada rumah atau bilik di luar kampus universiti sejurus majlis akad nikah disempurnakan bagi mengelakkan pernikahan diketahui pihak pentadbiran universiti.
Katanya, pasangan berkenaan memaklumkan, setakat ini tujuh pasangan 'suami isteri' di kalangan pelajar yang bernikah mengikut amalan mazhab berkenaan, menyewa kediaman yang diubah suai dan dipecahkan menjadi beberapa bilik di kawasan penempatan tidak jauh dari universiti itu.
"Kemungkinan jumlah pasangan yang melakukan pernikahan pelik di asrama lelaki di universiti itu lebih daripada yang diketahui.
"Malah, mungkin juga fahaman yang dipegang mereka turut membabitkan pelajar universiti lain di negara ini," katanya.
Hanafi berkata, kegiatan yang semakin mendapat sambutan itu perlu dibanteras segera bagi mengelak lebih ramai pelajar pusat pengajian tinggi mengambil jalan mudah untuk merasai dunia bersuami isteri dengan mengenepikan hukum syarak dan pihak keluarga.
"Lebih memburukkan keadaan jika kegiatan mereka tersebar kepada pelajar yang cetek ilmu agama. Pemikiran golongan pelajar ini lebih mudah dipengaruhi walaupun secara terang-terangan 'pernikahan mahzab lain' menyalahi hukum.
Menurutnya, Sidim mengadakan sesi kaunseling kepada pasangan terbabit dengan menasihatkan mereka tidak membelakangkan ibu bapa dalam segala hal terutama membabitkan pemilihan pasangan hidup.
"Saya nasihatkan remaja khususnya pelajar universiti tidak membuat keputusan terburu-buru dan terjebak dengan pujukan segelintir rakan mereka yang kononnya dianggap bijak. Ingatlah keredaan Ilahi bersangkut paut dengan keredaan ibu bapa," katanya. -hmetro

Syarikat minuman Yassa Sdn Bhd gagal dalam tuntutan saman RM1 juta yang difailkan terhadap Mawi World Sdn Bhd selepas Mahkamah Tinggi menolak saman itu atas alasan ia tidak berasas.
Hakim Datuk Azahar Mohamed berkata Yassa sebagai plaintif dalam kes ini tidak menunjukkan keterangan mengenai kerugian dialami hasil penggunaan butiran maklumat lesen Yassa yang digunakan oleh Mawi World bagi pengeluaran air mineral berjenama "Mawi World".
"Dengan alasan-alasan itu, saya tidak ada pilihan lain, tetapi untuk menolak tuntutan plaintif dengan kos," katanya.
Pada 31 Okt, 2006, Yassa menyaman Mawi World kerana mendakwa ia melanggar hak harta Yassa dengan memasarkan air galian berjenama "Mawi World", menggunakan butiran maklumat milik syarikat itu seperti lesen pengeluaran minuman air mineral dan alamat kilang minuman pada botol minuman tanpa memperoleh kebenaran syarikat itu.
Ia juga mendakwa botol minuman air galian yang menggunakan gambar penyanyi Mawi atau nama sebenarnya Asmawi Ani, 29, mengandungi maklumat mengenai sumber dan kandungan yang sama dengan air mineral jenama "Streamline" keluaran Yassa.
Mawi World selaku defendan, dalam pernyataan pembelaan berkata syarikat itu tidak pernah melanggar mana-mana hak harta sebagaimana didakwa syarikat Yassa.
Dalam keputusannya, Hakim Azhar berkata mahkamah menerima keterangan saksi defendan kedua, Ahmad Rathi Mohd Mohyodin, bekas pengurus syarikat Johtaw Corporation iaitu syarikat yang dilantik Mawi World untuk mengeluarkan dan membekalkan air mineral berjenama "Mawi World" bahawa syarikat Johtaw diberi kebenaran menggunakan butiran maklumat lesen yang dipegang Yassa pada botol air mineral "Mawi World" itu.
Hakim Azhar berkata mengikut keterangan Ahmad Rathi yang ketika itu berurusan dengan pengurus Yassa, arwah Bahari Othman bahawa dia (Ahmad Rathi) mendapat kebenaran menggunakan butiran maklumat itu oleh arwah Bahari bagi pihak Yassa.
"Berdasarkan keterangan saksi defendan kedua, saya tidak nampak alasan untuk menolak keterangannya," katanya.
Hakim Azahar berkata dalam hujahan hari ini peguam Adnan Seman yang mewakili Yassa berasaskan kepada "tort of conversion" iaitu melanggar atau menggunakan hak milik orang lain, tetapi Adnan tidak menggunakan autoriti yang jelas bagi menyokong sama ada butiran maklumat lesen yang dipegang Yassa itu adalah hak harta Yassa.
Beliau berkata dalam satu kes undang-undang yang diputuskan mahkamah di negara ini yang dirujuk oleh peguam Adnan, maklumat sulit seseorang itu ialah hak hartanya tetapi dalam kes ini butiran maklumat dan lesen yang dipegang Yassa bukan sulit kerana lesen boleh ditarik bila-bila masa jika berlaku percanggahan.
Lesen pengeluaran air mineral itu dikeluarkan oleh Kementerian Kesihatan Malaysia.
Hakim Azhar membuat keputusan itu selepas mendengar hujahan kedua-dua pihak.
Terdahulu, Adnan dalam hujahannya berkata kesan daripada penggunaan butiran maklumat lesen oleh pihak ketiga tanpa kebenaran akan menyebabkan pemegang lesen mengalami kesusahan, antaranya jika berlaku keracunan dalam air mineral itu, lesen akan ditarik.
Semasa diminta Hakim Azhar mengemukakan bukti seperti penyata akaun, jumlah keuntungan bagi menyokong jumlah gantirugi RM1 juta yang dituntut Yassa, Adnan berkata kerugian Yassa tidak dialami secara terus tetapi hasil penggunaan butiran maklumat di lesen itu menyebabkan pihak Mawi World mendapat keuntungan dengan cara salah.
Hakim Azhar meminta penjelasan Adnan sama ada Yassa mengetahui keuntungan yang diperoleh oleh Mawi World hasil daripada penjualan air mineral jenama "Mawi World" itu, Adnan berkata mengikut rekod syarikat Johtaw, Mawi World ada membuat tempahan air mineral minimum sebanyak 300 kotak.
"Ambil kira jumlah tempahan minimum itu dan promosi yang dibuat Mawi World itu, membuatkan kerugian pada plaintif," katanya.
Peguam Juliana Mohamed, yang mewakili Mawi World, berhujah bahawa butiran maklumat pada lesen adalah maklumat awam dan ia tidak boleh dimiliki.
Beliau berkata tidak wujud perlanggaran hak harta kerana keterangan daripada Ahmad Rathi membuktikan bahawa Yassa membenarkan Johtaw menggunakan butiran maklumat pada lesen yang dipegang Yassa bagi mengeluarkan air mineral "Mawi World".
Perbicaraan kes itu mengambil masa sehari iaitu pada Rabu, dengan memanggil tiga saksi.
Pengarah Yassa, Muhammad Nizam Bahari, yang mengambil alih perniagaan syarikat Yassa selepas kematian bapanya Bahari, pada 22 Okt 2006, merupakan saksi tunggal plantif dan saksi pertama memberi keterangan.
Kemudian diikuti keterangan daripada Mohd Azhar Arifin, saksi defendan pertama, iaitu pegawai pemasaran di Mawi World yang bertanggungjawab mencari peluang bagi mengembangkan perniagaan Mawi World. Ahmad Rathi adalah saksi defendan kedua.
Ketika ditemui selepas keputusan itu, Adnan berkata pihaknya akan memfailkan rayuan terhadap keputusan hari ini.
