UMNO Lepas Tangan Dalam Tragedi Natrah

Walaupun mengajak semua pihak bersatu dengan mengambil tragedi Natrah sebagai contoh, pimpinan Umno sebenarnya lepas tangan dalam memperjuangkan akidah gadis Belanda itu.

Bekas Ketua Pengarang Utusan Melayu sebelum diambil alih Umno, Said Zahari berkata, Umno tidak mengambil peduli isu berkenaan sebaliknya membiarkan tokoh pembangkang lain memainkan peranan.

"Umno sebagai parti tidak terlibat. Kecuali adalah beberapa orang pemimpin kelahiran Singapura antaranya (Tun) Saadon Zubir," katanya kepada TV Selangor hari ini.

Beliau mengakui Perdana Menteri pertama, Tunku Abdul Rahman terlibat dalam perjuangan berkenaan tetapi Presiden Umno kedua itu pada masa berkenaan, belum menyertai Umno.

Said berkata demikian ketika diminta mengulas kenyataan Timbalan Perdana Menteri, Tan Sri Muhyiddin Yassin yang kononnya meminta umat Melayu-Islam di negara bersatu dengan mengambil contoh tragedi Natrah.

Sebaliknya Utusan Malaysia dengan memetik kenyataan Muhyiddin cuba memutar belit sejarah kononnya semua parti termasuk Umno mendukung perjuangan terhadap Natrah.

Kenyataan itu dibuat pada pelancaran buku Natrah: Cinta, Rusuhan dan Air Mata, kononnya Umno bersama-sama Hizbul Muslimin dan Pertubuhan Kebangsaan Melayu Malaya (PKMM) bersatu mempertahankan kesucian Islam Natrah.

Tragedi Natrah atau nama sebenarnya Maria Hertogh di Singapura pada tahun 1950 hingga kini menjadi simbol perjuangan Islam dinegara ini.

Gerakan memperjuangkan akidah Natrah, bukan gerakan bersepadu parti politik sebaliknya didominasi tokoh parti pembangkang termasuk bekas Presiden PAS, Dr Burhanuddin Helmy.


Mengikut buku 'Tragedi Nadra', Umno tidak membuat apa-apa sebagai sebuah parti malah mengambil sikap berkecuali berikutan hubungan baiknya dengan penjajah, Inggeris yang ketika itu terikat dengan Perjanjian Inggeris-Belanda.

Malah, Presiden Umno ketika itu, Datuk Onn Jaafar dipetik sebagai berkata beliau 'enggan campur tangan kerana ia bukan isu politik, sosial mahupun keagamaan.'

Sehingga kini, tragedi yang menimpa Natrah dipadamkan dari lipatan sejarah tanah air lantaran ia tidak terkandung dalam skema pembelajaran sejak dulu lagi.

Malah, sebuah lagu berjudul Natrah yang mengisahkan tragedi menyayat hati yang didendang sebuah kumpulan rock sekitaar tahun 80-an, diharamkan penyiarannya. -TVS

Nik Aziz Mahu PAS Anjur Seminar Hak-hak Bukan Islam Sebelum Muktamar

Mursyidul Am PAS Datuk Nik Aziz Nik Mat mengesyorkan seminar menyentuh hak-hak bukan Islam dalam pemerintahan berteraskan Islam sempena Muktamar PAS pertengahan tahun ini dalam usaha memantapkan Pakatan Rakyat.

Kata beliau, melalui seminar sedemikian PAS boleh melakukan pendekatan yang baik dalam menghubungkan kefahaman antara pemimpin Islam dengan bukan Islam.

"Demi mengukuhkan lagi Pakatan Rakyat dan bagi mempersiapkan diri mendepani banyak lagi cabaran mendatang, maka PAS sewajarnya mengadakan satu seminar atas isu hak-hak bukan Islam di dalam pemerintahan berteraskan Islam bersempena Muktamar PAS akan datang," kata beliau dalam perutusannya sempena ulang tahun kedua Pakatan Rakyat.

Dalam pilihan raya umum ke-12 Mac 2008, Pakatan Rakyat menguasai lima negeri termasuk Kelantan yang dimenangi PAS pada 1999. Bagaimanapun Perak berpindah tangan awal tahun lalu.

Pakatan Rakyat yang dianggotai PAS, DAP dan PKR juga memperoleh satu pertiga kerusi di Parlimen — kali pertama dalam sejarah pilihan raya negara ini.

Nik Aziz yang juga Menteri Besar Kelantan memberitahu bersempena dengan dua tahun usia Pakatan Rakyat ini beliau berharap para pemimpin dan pendukung perjuangan ikatan itu dapat menguatkan lagi tekad ke arah membina perpaduan dan persefahaman serta keyakinan agar terus utuh di atas prinsip keadilan untuk semua rakyat.

"Ini kerana prinsip tersebut adalah sejajar dengan ajaran Islam yang mengutamakan keadilan untuk semua kaum di negara," katanya.

Sehubungan itu kata beliau, ada baiknya seminar itu dapat menjadikan tulisan As-Syeikh Dr. Yusoff al-Qaradhawi, bertajuk "Ghairul muslimin fil mujtama'ul-Islami" sebagai bahan rujukan penting untuk perbincangan.

"Mungkin dengan penganugerahan tokoh Maal Hijrah oleh kerajaan Malaysia kepada as-Syeikh Dr. Yusoff tahun lalu adalah suatu titik persetujuan awal bagi menerima idea-idea baik daripada beliau untuk difahami dan diamalkan dalam kerajaan.

"Sekali gus ia boleh diajak bersama para pemimpin politik bukan Islam menyertai seminar tersebut," katanya.


Gobind Persoal Mengapa Kecederaan Teoh Tidak Ada Di dalam Laporan Pertama (updated)

Peguam mewakili keluarga mendiang Teoh Beng Hock berkata kecederaan yang dialami bekas Setiausaha Politik kepada Exco Selangor itu adalah sebelum mangsa terjatuh, seraya mengundang beberapa ersoalan penting.

Gobind Singh Deo berkata dua patologis kerajaan tidak menjawab bagaimana, mengapa dan untuk apa kecederaan-kecederaan ini dalam laporan bedah siasat pertama mereka.

"Pertama sekali, laporan bedah siasat pertama tidak menyebut secara terperinci kecederaan pada leher mangsa, dan saya berpendapat kesaksian dari (pakar patologi kedua) Dr. Shahidan Md Noor telah menonjolkan betapa pentingnya kecederaan pada leher mangsa dalam kes ini," kata Gobind.

"Ini kerana kecederaan ini berlaku sebelum mangsa jatuh. Maka, seseorang perlu bertanggungjawab kerana mencederakan mangsa. Ini mengundang persoalan bagaimana dua pakar patologi sebelum ini tidak perasan atau tidak menonjolkan kecederaan ini dalam laporan mereka," tambah beliau.

Namun sebelum mencapai kesimpulan, Gobind berkata semua pihak perlu menunggu pendapat dari pakar-pakar patologi lain.

"Kita biarkan mahkamah untuk tentukan perkara ini, lagipun kita ada dua lagi pakar patologi iaitu Dr Pornthip Rojanasunand dan Prof Vanezis. Tuan Majistret telah meminta mereka untuk hadir, dan dengar penemuan mereka dahulu, sebelum kita panggil doktor-doktor dari bedah siasat pertama untuk menjelaskan kedudukan mereka," tegas beliau.


Ahli Patologi Nafi Teoh Dijerut Sebelum Terjatuh

SHAH ALAM 10 Mac - Ahli patologi yang melakukan bedah siasat kedua ke atas Teoh Beng Hock, Dr Shahidan Md Noor memberitahu mahkamah bahawa tidak mungkin mendiang dipukul atau dijerut sebelum jatuh dari tingkat 15, Plaza Masalam tersebut.

Menurut Dr Shahidan walaupun ada kesan tekanan pada leher namun lebam kebiruan pada bibir dan kuku serta bintik-bintik merah pada muka tidak ditemui bagi mencadangkan bahawa mangsa dibunuh.

"Mungkin terdapat tekanan yang digunakan di bahagian leher. Kesan lebam di leher tidak ada kesan asphyxia. Malah bintik-bintik merah di leher itu bukan penyebab kematian Teoh." katanya ketika disoal balas oleh Ketua Pendakwa dan Bahagian Perundangan Suruhanjaya Pencegahan Rasuah Malaysia Abdul Razak Musa.

Tambah Dr Shahidan lagi kecederaan di kawasan dubur Teoh bukan atas sebab diliwat namun ia konsisten dengan kecederaan akibat terjatuh.

"Kawasan tulang pinggul retak sebelum patah semasa si mati jatuh dan mengakibatkan ia tertusuk di belakang. Kecederaan adalah sebahagian daripada peringkat yang didapati ketika si mati jatuh," katanya lagi.

Malah tiada sebarang kesan atau bukti yang menunjukkan Teoh dipukul atau dilemaskan kerana tiada sebarang tanda seperti lebam di bibir, bintik kemerahan pada muka dan lebam kebiruan di hujung jari.

Dalam pada itu Dr Shahidan yang melakukan bedah siasat kedua pada 22 November lalu menolak laporan oleh ahli patologi Thailand yang mewakili kerajaan negeri Selangor Dr Pornthip Rojasunanand bahawa kepala Teoh dipukul dengan objek yang tumpul.

Ini kerana melalui siasatannya retak yang ditemui di bahagian kanan badan dan tengkorak Teoh menunjukkan konsistensi dengan kesan jatuh.

Jelas beliau keadaan "jatuh" juga boleh diklasifikasikan sebagai satu pukulan objek yang tumpul.

"Kesan retak di kanan tubuh mangsa dan tengkorak konsisten dengan jatuh. Bahkan, jatuh juga boleh ditakrifkan sebagai dipukul objek tumpul," katanya.

Sementara itu Abdul Razak turut memohon pihak Mahkamah Majistret Shah Alam memanggil semula dua ahli patalogi Dr Khairul Azman Ibrahim dan Dr Prashant Naresh Samberkar yang melakukan bedah siasat pertama untuk tampil memberi keterangan.

Namun Malik Imtiaz Sarwar yang mewakili kerajaan Selangor membantah permintaan itu kerana dilihat memberi peluang kepada mereka memperbetulkan kenyataan awal.

Majistret Azmil Muntapha Abas kemudiannya menangguhkan inkues dan memberi ruang kepada Dr Pornthip memberi keterangan pada 20 April ini.

Manakala ahli patologi yang mewakili SPRM Dr Peter Venezis menyusul pada 26 dan 27 April bagi memberi keterangannya pula. - SK

Feeling Bad

Sometimes I end up doing some really crazy things like this comparisons thing by Foong. I was actually too lazy to do an actual blog post about this and ended up putting my answers in his comment box but then I looked back and thought it was a pretty amusing thing to do.

I also felt bad cos there will be a lucky draw to pick three winners. Those who took part and posted this stands a chance to win. Even though I didn't actually write a post about this, he said he'll still put me in the running for this contest.

Aiyyyaaaa Foong, why did you have to be such a nice fellow and still put me in the running for the lucky draw? Now I feel so bad about it that I'm going to post it here. A DAP member, a PKR member & an UMNO died & all went straight to hell. There's where politicians go, right?

The DAP member said "I miss my party. I want to call my party and see how everybody is doing there." She called and spoke with Lim Guan Eng for about 5 minutes, then she asked "Well, devil how much do I need to pay for the call? The devil says "Five million dollars". The DAP member said "What, so expensive-lah???" but wrote him a cheque and went to sit back in her chair.

The PKR member was so jealous, he starts screaming, "My turn! I wanna call Anwar, I want to see how his so-do-me trial is going" He called and talked for about 2 minutes, then he asked "Well, devil, how much do I need to pay for the call???? The devil says "Ten million dollars". The PKR member said "What the fuck! Bloody rip-off" but he got no choice and made a cheque and went to sit back in his chair.

The UMNO member was even more jealous & starts screaming, "I want to call my party leaders", He called the UMNO headquaters and he talked for twenty hours about the Port Klang issue, the Allah issue, the pig head issue, the church issue, the missing jet issue, teoh beng hock issue, perak takeover issue, he talked & talked & talked, then he asked "Well, devil how much do I need to pay for the call????

The devil says "Twenty dollars".

The UMNO member was stunned & said "What !!?? Only twenty dollars??? So cheap ??!!"

The Devil says "calling from Hell to UMNO headquarters is only a LOCAL CALL."


Charge N H Chan for contempt or resign, CJ?

The integrity of the judiciary has been badly mauled by a legal lion who does not mince his words no matter how high or mighty a judge thinks he is. He has called a spade a spade and certain members of the judiciary an "incompetent" and even an "idiotic" bunch! All the Chief Justice (CJ) and the judges in the Palace of Justice have managed to do is remain mum, mute and mumble amongst themselves as N H Chan methodically makes them out for who they really are and the mockery they have made of the law!

The respected, renowned and retired Justice N H Chan is very frustrated, fed-up and furious at how the judiciary which he had served so faithfully has been reduced to a farce run by those who are legal and intellectual frauds or what he has called "imposters"! With each passing compromised judgment N H Chan unhesitatingly hits out at judges with an increasingly sharper sting. He leaves no stone unturned, no errant judge uncovered. They can "no longer mask their hyperbole judgments with unintelligible garbage".

"Fools on the bench"

In his latest scathing critique, he said the rakyat is "stunned by the ignorance of our judges of the highest court in the land", as seen in the recent Federal Court's decision not to review Anwar Ibrahim's application to review its previous decision dismissing his application for disclosure of documents for his second sodomy trial. N H Chan said the Federal Court's approach to Rule 137 of the Rules of the Federal Court 1995 was "inconsistent" and "dishonest" and "those ignoramuses" were talking "utter nonsense". Those "inane judges cannot even understand plain English"! He put it very plainly and painfully!

Calling the three-member panel of Justice Zulkefli Ahmad Makinuddin, Mohd Ghazali Mohd Yusoff and Heliliah Mohd Yusof "incompetent", he added "perhaps they were clowns as their statements were laughable". His searing criticism was that they "…do not know justice from injustice", and that "such lowly individuals should never be allowed to sit on the seat of Justice…(and) to be judges at all. And yet there are so many of them in the judiciary today ever since the rot begun."

He shredded into smithereens the "judicial renaissance" of the CJ: "Our country does not need impostors, who pose as judges, to deceive the common people any longer. The common citizenry can now uncover the impostors hiding beneath the mantle of the judicature." He laid bare the judicial sham: "With judges such as these in the Malaysian judiciary where, to them, the principles of the law are not to be consonant with justice to be manipulated by them to uphold injustice, it is no wonder that the errant judges have forfeited the confidence of the people. "

He left them with a stinging slap in the face: "The general public does not respect such judges anymore! They have put themselves beyond the pale. Just like pariahs. Don't you think they should be despised?" On High Court judge Justice Mohamad Zabidin Mohd Diah's rejection of Anwar's application to have the judge recuse himself from further hearing the sodomy trial, N H Chan said that the judge was talking "utter nonsense" and "knew next to nothing about judicial bias".

He added that the "moral of this unsavoury episode" is this: if you appoint mediocre lawyers to the Bench you will get substandard judges. The solution to this problem is a simple one. Appoint judges from the cream of the legal profession and you will not find me assailing the judges for incompetence simply because I will not be able to do so." Such was his cutting conclusion: "It is only when we have fools on the bench that I can point out that what they have decided is not the law."

"Bunch of idiots in high places"

N H Chan had not spared the judges in the cases related to the Perak constitutional crisis of his very strong language when scrutinising their decisions (with the exception of Kuala Lumpur High Court Justice Abdul Aziz Abdul Rahim whom he had praised). He highlighted the "bad" and "perverse" judgments, especially those in the appellate courts, the collective written judgements which were "riddled with contradictions" and how the Perak and Federal Constitutions were toyed with and trampled on by the judges!

During the Perak debacle N H Chan had said that there are "many of our judges today especially among those judges in the higher echelon of the judicial hierarchy who do not seem to know the true meaning of separation of powers in constitutional law. This is most apparent." He called some of the judges of the cases of the Perak imbroglio:

a) Bad judges – they "seem to think that independence means that they can do what they like"
b) Recalcitrant judges – "they think that words can mean whatever they want them to mean"
c) Humpty Dumpty judges – "they also think that they are independent of the legislature".

N H Chan has brought to light how beholden the judiciary is to the Umno-dominated Government. He said the "so-called Perak crisis has brought out a host of cases that showed that the judges gave the impression that they were one-sided. The perception of the people is that they sided with the BN government." In the "shocking case" of Zambry v Sivakumar in the Federal Court, he called the judgment by the "infamous five" (judges) Alauddin Mohd Sheriff , Arifin Zakaria, Nik Hashim Ab Rahman, Augustine Paul and Ahmad Makinnuddin, a "perverse decision".

In the case of Nizar vs Zambry he called the panel of five Federal Court judges made up of the President of the Court of Appeal Alauddin Mohd Sheriff, Chief Judge of Malaya Arifin Zakaria, Zulkefli Ahmad Makinuddin, Ghazali Mohd Yusoff and Abdul Hamid Embong, "myopic judges". They "were lost in a quagmire of confused thinking caused by their own incompetence. They found themselves deep in the forest unable to see the wood for the trees. Does this mean that we have a bunch of incompetent judges who sit in the highest court in the land?"

Alas, with the help of N H Chan the public especially those in Perak were able to see for themselves how members of the judiciary had left behind a dead constitution, "bad" and "perverse" decisions, dubious declaratory orders, judgments devoid of reasoned grounds, and disgraceful double standards.

Blind and Biased Judges

N H Chan has "judged the judges". He considers them, especially those in the appellate courts' "ignorant", "inane", "incompetent" and even "idiots" (which he has strongly inferred). The public shares his view. In their eyes the judiciary has allowed itself to be intimidated, its independence and impartiality interfered with, and its integrity reduced to ignominy.

In the light of the severe criticism of N H Chan of the judiciary (which is quite unprecedented by a retired judge), surely the Chief Justice cannot stand idly, silently and stoically by – unless Zaki Azmi strenuously, staunchly and solemnly agrees with him! Further if Zaki continues to remain silent the public will assume that he shares N H Chan's searing criticism of the judiciary. Logically he would have to resign for he has allowed the reputation of the judiciary to be sullied irreparably.

The judicial shenanigans whom N H Chan has criticized and castigated should also resign for having shamelessly sacrificed justice on the altar of political expediency. N H Chan's comments on members of the judiciary have no doubt been bold, blunt and blistering. He has accused judges of being blind, biased and being a bunch of "idiots" and "fools". He has thrown the gauntlet down.

If the CJ disagrees with N H Chan's criticisms he should haul the former Court of Appeal judge into court and demand that the latter shows cause for why he should not be cited for contempt! Does Zaki have the guts to take up the gauntlet or will he prefer to allow the judicial circus to go on? N H Chan has made no bones about it. His blitzkrieg on the judiciary will continue. Egyptian officials says Grand Imam of Al-Azhar, who caused storm in Muslim world when he shook Peres' hand, dies of heart attack at age 81 during visit to Riyadh. Sunni Islam's top cleric, Sheikh Mohammed Sayed Tantawi, died on Wednesday in Saudi Arabia of a heart attack suffered while boarding a plane, Egyptian officials and state media said. He was 81 years old.

Tantawi, the Grand Imam of Al-Azhar - Sunni Islam's highest seat of learning - was in Riyadh to attend the King Faisal awards ceremony, the official MENA news agency said.Tantawi was boarding a plane early Wednesday morning when he suffered severe pain and fell on the stairs, Egyptian television said. He was rushed to the Amir Sultan hospital in Riyadh where doctors proclaimed him dead. An Egyptian official told AFP that Tantawi had died of a heart attack. His body is likely to be sent back to Cairo on Wednesday evening, the television said.

Tantawi, who was born in the Egyptian village of Saleem al-Sharqiyyah on October 28, 1928, was appointed Grand Mufti of Egypt in 1986. He held this position for almost ten years, until he was appointed Grand Imam of Al-Azhar Mosque and Grand Sheikh of Al-Azhar University by President Hosni Mubarak. About a year ago Tantawi caused a storm in the Muslim world when he shook Israeli President Shimon Peres' hand during a United Nations-hosted interfaith meeting in New York.

Tantawi explained that he did not recognize Peres. The handshake sparked harsh criticism among the Egyptian opposition, which went as far as to demand the cleric's resignation. Tantawi told the independent Egyptian paper Al Masri al Youm at the time that "I shook the hand of anyone who held out his hand. Among those was Shimon Peres, whom I did not recognize, so I shook his hand like I did the others, at random without even knowing him... Women undergoing cesarean sections (C-sections) are at an increased risk of maternal death and serious complications if the operation is not medically indicated, according to findings from a WHO global maternal survey.

Researchers analyzed data from 107,950 deliveries in 122 health facilities from nine Asian countries and found that compared to spontaneous vaginal delivery, C-sections were associated with an increased risk of maternal mortality and morbidity index (defined as the presence of at least one of the following: maternal death, intensive care unit admission, blood transfusion, hysterectomy, or internal iliac artery ligation). The increased risk compared to normal birth was 2.7 times for antepartum C-section without medical indication, 10.6 times for antepartum C-section with indication, 14.2 times for intrapartum without indication and 14.5 times for intrapartum with indication. "The most important finding of the survey is the increased risk of maternal mortality and severe morbidity… in women who undergo cesarean section with no medical indication," wrote Dr. A. Metin Gülmezoglu, of the department of reproductive health and research, WHO, Switzerland, and colleagues who conducted the study.

"C-section should be done only when there is a medical indication to improve the outcome for the mother or the baby. Women and their carers who plan to undertake C-section delivery should discuss the potential risks to make an informed decision if they still wish to have a cesarean delivery," the authors wrote.

In an editorial about the study, Dr. Yap-Seng Chong, of the department of obstetrics and gynecology, Yong Loo Lin School of Medicine, National University of Singapore, Singapore, and Dr. Kenneth Y.C. Kwek, of the department of maternal fetal medicine and chairman of the medical board at KK Women's and Children's Hospital, Singapore, stated that the risk of ICU admission was 10 times more likely for antepartum C-section without medical indication and 67 times more likely for intrapartum C-section without medical indication compared to spontaneous vaginal deliveries. "Clearly," they wrote, "cesarean deliveries, even in mothers with no underlying medical issues, can be life-threatening." [Lancet 2010 DOI:10.1016/S0140-6736(10)60055-4]

Controversy about the ideal rate of
C-section and the place of maternal choice has been protracted and "many obstetricians have become accustomed to the practice of medical interventions for non-medical reasons," wrote Chong and Kwek.

The survey, which involved health facilities from Cambodia, China, India, Japan, Nepal, the Philippines, Sri Lanka, Thailand and Vietnam, also revealed that 62 percent of the health facilities surveyed received financial incentives for carrying out C-sections.

"Financial incentives for doing these procedures should be removed or kept to a minimum," Chong and Kwek stated.

Dr. Ravindran Jegasothy, senior consultant and head of the department of obstetrics and gynecology at Hospital Kuala Lumpur, Malaysia, stated that the "doctor's duty is to counsel patients and always state the fact that C-sections are four times more risky than vaginal delivery, as shown by the Cochrane database." He added that birth plans and the patient's concerns should be addressed before labor and that counseling should be detailed and recorded in notes. "What should a doctor do if the patient still requests a cesarean? One should be prepared to do it or refer to someone else for a second opinion. Mahkamah Syariah Wilayah Persekutuan hari ini menetapkan 14 April depan bagi keputusan berhubung bantahan awal yang dikemukakan oleh Ketua Pendakwaan Syarie Wilayah Persekutuan Shamsuddin Hussain untuk membatalkan permohonan qazaf oleh Datuk Seri Anwar Ibrahim.

Dalam hujah di mahkamah pagi tadi, pihak responden mengatakan mahkamah syariah tidak mempunyai kuasa untuk mengarahkan Ketua Pendakwaan Syarie membuat dakwaan terhadap bekas pembantu Anwar, Saiful Bukhari Mohd Azlan yang memfitnah Anwar beliau telah diliwat.

Selain dari Shamsuddin dan Jamil Baharom, seorang lagi responden ialah Pengarah Jabatan Agama Islam Wilayah Persekutuan (JAWI) Che Mat Che Ali.

Kamar Ainiah Kamaruzzaman yang mengetuai enam peguam syarie Anwar, dalam hujah balasnya berkata wujudnya bidang kuasa dalam mahkamah syariah dengan merujuk kepada beberapa kes terdahulu seperti kes Lina Joy.

Pasukan peguam Anwar membantah tentang ketidakhadiran Menteri di Jabatan Perdana Menteri Senator Datuk Seri Mohd Jamil Khir Baharom dengan berhujah beliau dikehendaki untuk hadir mengikut undang-undang dan tidak seharusnya berselindung di sebalik tugasnya sebagai seorang menteri.

Hakim Mohd Shukor Sabudin kemudian mengarahkan Jamil Khir supaya hadir pada tarikh yang telah ditetapkan. Beliau tidak hadir pada perbicaraan hari ini kerana menghadiri mesyuarat Kabinet.

Peguam bela Zainal Rijal Abu Bakar mengemukakan tiga sebab kenapa permohonan qazaf terhadap Saiful harus ditolak.

Pertama, afidavit mengandungi unsur kesalahan kerana ia bukan berasaskan notis permohonan dan bukan notis saman.

Kedua, permohonan itu tidak memasukkan keperluan syariah tertentu maka dengan itu bercanggah dengan undang-undang Islam.

Ketiga, sama ada ia dalam bidang kuasa mahkamah syariah untuk mengarahkan supaya Saiful dihukum.

"Persoalannya bukan perbuatan qazaf itu berlaku atau tidak.

Ianya sama ada mahkamah boleh mengeluarkan arahan pendakwaan atau tidak?", kata Zainal.

Kamar Ainiah Kamaruzzaman yang mengetuai enam peguam syarie Anwar, dalam hujah balasnya berkata wujudnya bidang kuasa dalam mahkamah syariah dengan merujuk kepada beberapa kes terdahulu seperti kes Lina Joy.

Beliau menambah, penolakan pihak responden tidak berasas kerana mereka mahu kes ini dibuang berdasarkan sebab teknikal dan bukan berdasarkan sebab-sebab 'fundamental'.

"Jika mereka (pembelaan) mahu kami membuat permohonan semula dengan saman maka kami boleh lakukan. Selagi keadilan dapat ditegakkan," kata beliau.

Kamar Ainiah berkata, ketiadaan keperluan-keperluan syariah seperti mana yang disebut oleh Zainal adalah perkara kecil dan tidak memberi kesan dalam apa cara jua.

Beliau seterusnya memberi amaran jika permohonan qazaf ditolak maka ini merupakan satu ancaman kepada keadilan dalam undang-undang Islam.

"Saiful mengakui di depan masyarakat awam perbuatan liwat berlaku terhadapnya tetapi beliau tidak dikenakan tindakan, sedangkan ketiga-tiga wanita yang mengakui secara tersembunyi dirotan.

"Adakah ini bermakna undang-undang Islam dikecualikan kepada mereka yang disokong kuat oleh mereka yang berkuasa?'
, soal beliau.

Mohd Shukor memohon tempuh masa sebulan untuk membuat keputusan dan akan menetapkan tarikhnya kemudian.

Bagaimanapun, Kamar Ainiah meminta mahkamah menentukan tarikh sebelum perbicaraan ditangguhkan kerana beliau bimbang pengumuman tarikh pada kemudian hari mungkin bertembung dengan tarikh perbicaraan lain dan mengakibatkan kes ini tertangguh.

Bercakap selepas perbicaraan, Anwar yang juga Ketua Pembangkang dan Ketua Umum Parti Keadilan Rakyat melahirkan rasa kecewa.

Beliau menekankan bahawa tidak ada tindakan diambil sejak beliau membuat permohonan ini hampir dua tahun yang lalu dan kini pihak responden sedang mencipta alasan untuk menolak kes ini sama sekali. "Saya juga merasa malu dengan tingkah laku dua orang ustaz dalam kes ini.

Mereka memilih untuk mengikut telunjuk Umno dengan menghukum tiga wanita itu dan membiarkan Saiful bebas,"
katanya.

Pada 9 Julai 2008, Anwar membuat laporan qazaf terhadap Saiful di Unit Siasatan, Bahagian Penguatkuasaan, JAWI mengikut Seksyen 41 Akta Kesalahan Jenayah Syariah (Wilayah Persekutuan) 1997.

Ini disusuli dengan tindakan Anwar memfailkan permohonan bagi mendapatkan perintah untuk mengarahkan Shamsuddin agar mendakwa bekas pembantunya itu atas tuduhan qazaf pada 7 Januari lalu.

Menurut seksyen tersebut sesiapa yang menuduh orang lain melakukan kesalahan seksual tanpa mengemukakan empat saksi lelaki atau ikrar (pengakuan) orang yang dituduh boleh dikenakan denda RM5,000 atau penjara tidak lebih tiga tahun atau kedua-duanya sekali. -FMT

Ketua Pembangkang Datuk Seri Anwar Ibrahim berkata setelah dua tahun kemenangan besar Pakatan Rakyat gagasan itu semakin teguh dan mantap dan sukar digugat walaupun diasak serta ditekan berterusan oleh Umno dan Barisan Nasional.

Ini kerana rakyat berdiri teguh di belakang Pakatan Rakyat yang memberi kekuatan dan dorongan untuk membawa perubahan total yang diharapkan rakyat selama lebih 50 tahun di bawah Umno-BN.

Berucap di Commerce Square, Seremban malam tadi dihadapan lebih 10,000 penyokong yang tidk berganjak walaupun terpaksa mengharungi hujan lebat tanpa henti sempena majlis sambutan ulangtahun kedua kemenangan Pakatan Rakyat, Anwar berkata dengan semangat jitu yang ditunjukkan rakyat Negeri Sembilan tidak mustahil Umno akan rebah di negeri itu pada pilihan raya akan datang.

"Malam ini pemimpin-pemimpin Umno Negeri Sembilan tidak boleh tidur. Semangat rakyat tinggi menggunung. Berapa tinggi gunung Kilimanjoro, tinggi lagi semangat rakyat Negeri Sembilan," ujar Anwar.

Majlis itu turut dihadiri Ketua Parlimen DAP Lim Kit Siang, Setiausaha Agung Pas Datuk Mustafa Ali, Naib Presiden KEADILAN Azmin Ali, Ketua Angkatan Muda KEADILAN, Shamsul Iskandar Mohd Akin, Pengerusi Majlis Pimpinan KEADILAN Negeri Sembilan Datuk Kamarul Baharin Abas serta pimpinan Pakatan Rakyat pusat dan negeri.

Anwar yang berucap dengan penuh semangat berkata walaupun pelbagai tekanan dan ujian yang dihadapi Pakatan Rakyat sepanjang dua tahun pentadbirannya namun sambutan rakyat terhadap KEADILAN, PAS dan DAP lebih hebat berbanding sebelum ini.

Beliau tegas menyatakan hanya pemimpin yang berjuang untuk prinsip diterima dalam Pakatan Rakyat manakala pemimpin yang berjuang untuk mendapatkan kekayaan dan projek akan disingkirkan.

"Wajah dan peta politik Malaysia sudah berubah. Kita sekarang ambil pendekatan yang jelas berdasarkan apa yang benar. Sebab itu apabila ditanya mengapa kita memilih untuk memecat Ahli Parlimen KEADILAN meskipun jumlah kita menurun, kita pecat sebab kita berani, kerana kita mengambil keputusan yang tepat dan benar serta tidak tunduk kepada mereka," tegas Anwar lagi.

Pada masa yang sama Ketua Umum KEADILAN itu turut mengulas isu integriti dan keselamatan negara membabitkan isu pembelian kapal selam dan kehilangan enjin pesawat Tentera Udara DiRaja Malaysia.

"Ini isu keselamatan negara kita. Sebab itu mereka (Umno) tak tahan dengan PAS, DAP dan KEADILAN sebab kita suarakan, walau hadapi risiko. Kalau kita tidak suarakan rakyat tidak akan tahu. Kalau perang, kapal selam tak boleh selam, kapal selam tak boleh naik, bermakna kalah Malaysia," tegas Anwar.

Berhubung isu penggunaan kalimah Allah bukan sahaja KEADILAN malah PAS dituduh sebagai pro-Kristian.

Sementara di Pulau Pinang pula Ketua Menteri Lim Guan Eng dituduh merampas hak orang Melayu.

Hakikatnya kata Anwar pentadbiran Guan Eng di Pulau Pinang telah banyak membantu kaum Melayu di negeri itu berbanding semasa ia ditadbir Gerakan-Barisan Nasional.

"Di Pulau Pinang, Cina majoriti, kita angkat Cina. Cina yang prihatin masalah rakyat, yang ada peribadi yang baik, yang tak rampas tanah kita, Cina yang tak rasuah, itu Cina kawan kita.

"Saya tahu Lim Guan Eng tegas, bagi arahan jelas tak akan ambil saham negeri, tak ambil tanah negeri, tak ambil kontrak negeri. Tanya Menteri Besar Umno, Ketua Menteri Umno, ya memang dia kata tak ambil satu kontrak, dia ambil 14 kontrak! Mana ada pemimpin Umno yang tak ambil (rasuah).

"Kerajaan negeri semasa Umno-Gerakan perintah peruntukan untuk majlis agama setakat RM12 juta sahaja. Tetapi apabila Pakatan Rakyat memerintah peruntukan untuk Majlis Agama Islam Pulau Pinang meningkat daripada RM12 juta kepada RM24 juta," tambah beliau.

Kata Anwar, Menteri Besar Kelantan Datuk Nik Abdul Aziz Nik Mat yang hidupnya secara sederhana turut menjadi mangsa fitnah dan tuduhan jahat pemimpin Umno.

Beliau mempersoalkan mengapa tiada siasatan dilakukan terhadap pemimpin Umno-BN yang memunggah kekayaan negara untuk diagihkan kepada kroni mereka.

"Kenapa tidak boleh diagihkan kepada rakyat terbanyak. Kenapa mesti adik Najib, kenapa mesti menantu Abdullah Badawi, kenapa mesti jadi anak Mahathir, dah kaya beli kilang arak terbesar di Filipina. Ini yang kita lawan, kita lawan soal prinsip. Saya Melayu, saya tetap Melayu, saya tetap pertahankan Melayu. Tapi apa bezanya saya dengan Umno. Saya Melayu Muslim, saya pertahankan hak Melayu tetapi saya tetap pertahankan juga hak Cina dan India di negara ini," tegas Ahli Parlimen Permatang Pauh itu.

Dalam isu Konspirasi II yang dihadapi beliau, Anwar berkata beliau tidak gentar kerana tidak bersalah melakukan perbuatan itu yang hanya merupakan satu konspirasi jahat.

"Ada orang kata orang tuduh supaya saya disiasat. Siasatlah. Saya tak marah polis siasat, saya marah kerana terlibat dalam konspirasi jahat dan fitnah orang," kata Anwar yang turut menjelaskan fatwa Pengerusi Majlis Ulama Sedunia, Sheikh Dr Yusuf Al Qaradawi mengenai fitnah dan tohmahan yang dihadapi beliau.

Anwar berkata Pakatan Rakyat akan tetap menyuarakan pelbagai isu membabitkan masalah rakyatdan soal kebobrokan kerajaan di Parlimen.

Beliau mengakhiri ucapannya dengan memetik kata-kata pejuang bahasa dan anak kelahiran Negeri Sembilan, Pendita Zaaba dalam buku beliau yang ditulis sekitar 1920 mengenai prinsip perubahan.

"Daripada kepercayaan yang bodoh yang melemahkan akal dan ikhtiar (ala Umno) kepada kepercayaan yang cerdik yang membebaskan pemikiran (ala Pakatan Rakyat). Daripada keyakinan dan ikhtiqad yang kering dan terpesong (ala Umno) kepada ikhtiqad yang subur dan merdeka (ala Pakatan Rakyat). Anwar Terus Cabar Pemecatannya Dari Jawatan Kabinet

Datuk Seri Anwar Ibrahim terus mencabar kesahihan pemecatannya dari jawatan Kabinet oleh bekas Perdana Menteri, Tun Dr Mahathir Mohamad, 11 tahun lalu.

Hari ini, beliau memfailkan permohonan bagi menuntut Mahkamah Persekutuan untuk menyemak semula keputusannya pada 8 Mac yang mengisytiharkan bahawa pemecatannya sebagai timbalan perdana menteri dan menteri kewangan pada 2 September 1998 adalah sah di sisi undang-undang.

Notis usul, yang dikembarkan bersama dengan afidavit Anwar, difailkan di Pendaftar Mahkamah Persekutuan hari ini melalui firma guaman Messrs Karpal Singh & Co.

Dalam afidavitnya, Anwar memohon mahkamah tertinggi supaya menggunakan budi bicara sedia ada untuk menyemak semula kesnya mengikut Kaedah 137 Peraturan Mahkamah Persekutuan bagi mengelak ketidakadilan yang didakwa dilakukan ke atasnya.

Anwar berkata penghakiman Mahkamah Persekutuan bertentangan dengan peruntukan Artikel 43 (5) Perlembagaan Persekutuan yang jelas menetapkan bahawa hanya Yang di-Pertuan Agong boleh membatalkan pelantikannya daripada jawatan-jawatan Kabinet atas nasihat Perdana menteri dan bukan Perdana Menteri.

Anwar berkata panel Mahkamah Persekutuan sebelum ini, dalam menolak rayuan terakhirnya, melakukan kesilapan undang-undang dengan memutuskan bahawa ia adalah Perdana Menteri yang juga pihak yang berkuasa melantik dan mempunyai hak untuk membatalkan pelantikan Anwar.

Beliau mendakwa ia adalah satu penghinaan ke atas perumus perlembagaan bagi mencadangkan pematuhan kepada Artikel 43(5) dalam formaliti yang kosong dan bahawa penghakiman Mahkamah Persekutuan tidak boleh bertahan terhadap penyeliaan penghakiman.

Anwar berkata perkara itu merupakan kes yang luar biasa bagi mahkamah untuk membatalkan budi bicara sedia ada bagi menghalang ketidakadilan terhadapnya.

Anwar mengambil tindakan undang-undang terhadap Dr Mahathir dan kerajaan Malaysia, bagi menuntut perintah pengisytiharan bahawa pemecatannya adalah tidak sah di sisi undang-undang dan mahu beliau diberikan pampasan sebagai ganti kepada pengembalian kedudukan jawatan.

Service In Memory of Mdm. Wu Bao Di

Mdm. Wu Bao Di (in pinyin) was called by Lord to rest in heaven last Saturday. I learned about it from the obituary message in See Hua Daily News on Sunday morning. Then in a short e-mail, Dr. Dennis Ngien informed me of the sad news of his mom's demise.



The family of the late Mdm. Wu Bao Di held a memorial service this morning (10th March) at Zion Methodist Church in loving memory of their beloved one.



It was a near-full Zion Methodist Church despite the drizzle.



In his sermon, Rev. Liik Tung Yeu likened life to a race. "You need to persist in Lord to win the race," Rev. Liik told the congregation.



Dr. Dennis Ngien represented his family to testify the greatness of the love of his mom. The sharing was touching and it almost wetted my eyes. Dr. Dennis Ngien's testimony left ample space for us to give deep thinking to.



The memorial service concluded with a benediction by Rev. Liik and thereafter a group photo shooting at the entrance of the church.

Gerakan Pulau Pinang menggesa kepimpinan Umno dan Barisan Nasional (BN) tidak menerima anggota Parlimen Kulim-Bandar Baharu Zulkifli Noordin yang disingkirkan daripada Parti Keadilan Rakyat (PKR) Sabtu lepas, sebagai anggotanya.

Pengerusi Gerakan negeri Datuk Dr Teng Hock Nan berkata Zulkifli yang kini menjadi anggota Parlimen Bebas, dilihat sebagai seorang pelampau agama dan rasis.

"Beliau disingkirkan oleh PKR kerana tidak bersedia menerima kepelbagaian bangsa. Menerima beliau masuk Umno dan BN tidak akan mencerminkan BN sebagai sebuah parti campuran pelbagai bangsa yang sederhana berkhidmat bagi kepentingan semua rakyat Malaysia," katanya dalam kenyataan di sini hari ini.

Dr Teng, yang juga naib presiden Gerakan, berkata Zulkifli telah mengetuai satu bantahan yang sangat bising untuk mengganggu Forum Masuk Islam Majlis Peguam di sini pada 9 Ogos, 2008.

Beliau berkata Gerakan agak "cemas" dengan kenyataan Timbalan Perdana Menteri Tan Sri Muhyiddin Yassin bahawa pintu Umno "sentiasa terbuka" kepada sesiapa yang ingin menjadi anggotanya termasuk Zulkifli.

Dr Teng berkata BN pada amnya dan khasnya Umno janganlah menerima pelampau agama dan racis dalam kumpulannya. — Bernama
