RM6.5m landmark settlement for Orang Asli: Pakatan Rakyat set the stage

RM6.5m landmark settlement for Orang Asli
By Tan Yi Liang

End of a 14-year legal battle ... some of the orang asli families
outside the Federal Court today.
PUTRAJAYA (May 26, 2010): Twenty-six orang asli households of the Temuan tribe will receive RM6.5 million from the Malaysian Highway Authority (LLM) -- the culmination of a 14-year legal battle that began when their native land were taken away from them in 1996 to build a highway to KL International Airport.
This follows a landmark settlement reached yesterday between the orang asli, led by 79-year- old Sagong Tasi, and the defendants -- the highway authority, federal government and United Engineers Malaysia Bhd (UEM).
According to the terms of the settlement, recorded by a quorum comprising Justices Tan Sri Arifin Zakaria, Chief Justice of Borneo Tan Sri Richard Malanjum and Datuk Seri James Foong, the RM6.5 million is to be deposited by UEM at the Shah Alam High Court within one month beginning today.
The households will be eligible to claim from the sum for the land taken from them, totalling 15.38 ha (38 acres), in Bukit Tampoi, Dengkil without compensation to build the Banting-Nilai Highway.
The lawyers for the orang asli, led by Datuk Cyrus Das, will waive all costs granted by the court.
Sagong, who filed the suit along with six others -- Kachut Tunchit, Dabat Chabat, Kepal Kepong, Sani Saken, Illas Senin and Tukas Siam -- had named the federal government, the then BN-led Selangor government, the highway authority and UEM, the contractor, as the defendants.
The families, who were represented by a pro bono team led by Das, first won their case in the Shah Alam High Court in 2002, when Justice Mohd Noor Ahmad ruled that they enjoyed native title rights over their traditional land and should be compensated according to the Land Acquisition Act 1960.
The judge had directed that the compensation be assessed according to act and ordered UEM and the highway authority to pay damages for trespass.
His decision was upheld by the Court of Appeal in September 2005, and an appeal was made to the Federal Court, which granted leave in 2006.
In April 2009, the Pakatan Rakyat-led Selangor government pulled out of the suit to honour its pledge to support orang asli land rights, which set the stage for negotiations with the Attorney-General's Chambers.

Sagong ... 'my heart now
contented'
Today's settlement was the result.
Speaking outside the courtroom, Sagong said he was satisfied with the decision and his heart "was now contented".
"My body is old. My eyes can't see, I can't really walk and I can only eat a bit. I can't work. I am so thin," he said when asked what he would do with his share of the money.
"I could build a new house, maybe I could get married again," he said, adding that some of his friends, including plaintiffs Kachut Tunchit and Tukas Siam, had since passed away.
Selangor tourism, consumer afairs and the Environment chairman Elizabeth Wong said any proposed amendments to the Orang Asli Act should take this decision into account.
"There is an effort to amend the act which would limit the kind of quantum that would be made and the size of land that would be given out as compensation" she said.
"So any decision of the federal government to amend the Orang Asli Act should not go against the decision of the court in this case." -- theSun

S Manikumar wooed by BN 'gangs'

Rumoured Kedah defector charms party faithful
In the 6th PKR Congress, PKR speakers from all across the country tickled the delegates' funny bone, but no one held the court better than Bukit Selambau assemblyperson S Manikumar revealed that he had been "wooed" by certain "gangs".
When these gangs came to him, he would ask them whether he could be Umno Youth chief, MIC president, or MCA president. They would scratch their heads and did not know how to reply. So Manikumar would tell them that PKR was a multi-racial party which fought for the rights of all races.

Khalid Terima Sokongan Padu Pemimpin PR Sekalipun Najib Berusaha Rampas Selangor "At All Costs".

Pimpinan Pakatan Rakyat Percaya Kepimpinan Khalid Ibrahim

Malah, kepimpinan Khalid turut disenangi pimpinan lain.

Kongres PKR: Perkukuh Selangor, jadikan asas tawan Putrajaya

Bagaimanapun kata Krisna, beliau sedih kerana PKR kehilangan kerusi Parlimen Hulu Selangor.

PKR gagal mempertahankan kerusi Parlimen Hulu Selangor bulan lalu.

-TMI

USM against STPM students?

Posted: 29 May 2010 06:49 AM PDT

The nightmare is haunting STPM students again...

Many excellent STPM graduates are again, like last year, being denied a place in USM. Some people argued that its because of their poor performance in Munsyi test? So Matrikulasi students did better in Munsyi and hence deserving the opportunity to enter the prestigious Apex university? Is academic performance no longer a priority to USM?

Stop fooling the world, USM.... A brand new year with the same old trick. So far, I've heard many top stpm graduates did not get any kind of offer from USM, including those scoring 4.0CGPA.

To USM: If you keep wanting me to show my statistics and source of reference, why not YOU do it first... Dare you? Make the selection list public, and show YOUR statistics of the list of entry to various critical courses like Medicine, Dentistry and Pharmacy to all Malaysians.

I guess this is the time when non-matrikulasi students should do something about this issue which has been persisting for quite some time already.

In her passport, her name was written as Rosi Daw. She went to Mecca twice and performed Haj and Umrah with the RISEAP special package from KL.

As Thida, our children and I are away from both parents at that time, we loved and treated her as our own parents.

May Allah forgive all the  sins of our beloved Kyee Kyee, give enough space in the Kabar (Kubur), keep her away from all the punishments in Kabar andat Jahanam and granted her a special place in Jannath.

Adun Seberang Jaya tahu judi dilarang dan ditolak semua agama tetapi tetap pertahan judi sukan yang diluluskan Kerajaan Umno-BN

Posted: 29 May 2010 02:31 AM PDT

P.S. I Love You

Posted: 29 May 2010 05:52 AM PDT

It's a nice rainy night. The pitter patter of rain drops on the roof soothes the soul and it's also just the perfect setting to tell you what a soppy little character I can be at times.

I'm not the kind of guy who watches soppy romantic movies more than once. I watch them just for some laughs, especially the romantic comedies and that's about it. The more serious romantic movies don't even attract my attention.

But, there is one romantic movie that I would say I have watched, at the risk of losing my macho standings in the human race, for more than 8 times and am still enjoying every bit of the show! It's not something I'm proud to acknowledge but I just happen to love watching that movie over and over again whenever it's shown on TV.

The show in question is 'P.S. I Love You' and it stars Hilary Swank and Gerard Butler and I loved the movie the first time I laid my eyes on it and still love watching it till this very day. And yes, I get all mushy everytime I watch it! LOL!

Stop it already, I can see you laughing all the way over there! I don't know why I like this movie but I seriously do. Maybe it's because of the storyline and the way it plays out. I just love the entire concept of the show that even though Holly's (Swank) husband dies but he leaves her letters in anticipation of his death and if that is not romantic, I don't know what is!

Even wifey is amused with the fact that I happen to love this movie so much and can never get enough of watching it. There goes my manly macho image down the drain ... LOL! I know they're showing another rerun of it on Astro and you can bet your bottom dollar (for some of you it's monopoly dollars ... LOL!) that I would be watching it again and getting all mushy too! Hahaha!

Oh and I think Gerard Butler has a body to die for and I told wifey that I'm going to work towards getting a body like his, which would probably take me 20-30 years to achieve ... LOL! For now, I guess I'll just have to stick to looking for the best shampoo for hair loss to just keep whatever hair that is left on my head!

Penyokong UMNO Sendiri Tolak Model Ekonomi Najib

Posted: 29 May 2010 05:28 AM PDT

-mk

Kongres ekonomi bumiputera tolak MEB

Siasat 3 Puaka Ini. Jho Low, Big Mama & Khairy

Posted: 29 May 2010 03:35 AM PDT

AMK Mahu SPRM Siasat Jutawan Muda Jho Low

KOTA BHARU 28 Mei - Ketua Angkatan Muda KEADILAN, Shamsul Iskandar Mohd Akin mendesak Suruhanjaya Pencegahan Rasuah Malaysia (SPRM) supaya menyiasat latar belakang seorang rakyat Malaysia bernama Jho Low lulusan Wharton School of Business dan bagaimana beliau mampu memperolehi kekayaan sebegitu banyak dalam usia 28 tahun.

-sk

Siapa Jho Low, Big Ma? AMK minta siasatan

Mengikut New York Times, Jho Low didakwa membelanjakan AS$50,000 semalaman untuk berhibur dan menghadiahkan 200 botol arak berjenama bernilai AS$1,000 sebotol kepada pelakon Hollywood, Megan Fox.

-mk

Big-spending Malaysian is the mystery man of city club scene
By JENNIFER GOULD KEIL and BRIAN NIEMIETZ

A fleet of black Cadillac Escalades hums outside Chelsea hot spot Avenue -- the A-list watering hole of such celebrities as Justin Timberlake and Lindsay Lohan.

As the car doors open, a dozen men emerge and a bouncer whisks them over the club's threshold, past a group of shivering models behind the velvet rope.

"Who is it?" one of them wonders out loud. "Is it P. Diddy?"

But the man at the center of the entourage isn't a celebrity. He isn't even a mogul. He's Taek Jho Low, a 20-something Wharton grad from Malaysia who has burned through hundreds of thousands of dollars at the city's hottest nightspots in the last three months -- and shows no signs of stopping.

The nightlife scene is abuzz with tales of this international man of mystery -- who goes by the name Jho Low and whose chubby, bespectacled appearance hardly meets the image of a wealthy gadabout.

In September, during Fashion Week, sources said, Low helped rack up a $160,000 bar tab at Avenue, including several $900 bottles of Cristal champagne.

One month later, Lindsay Lohan was belatedly celebrating her 23rd birthday at downtown drinking den 1OAK when 23 bottles of Cristal suddenly appeared. They were reportedly paid for by a "mystery Malaysian," who, sources claim, was Low.

At chic 27th Street hangout Pink Elephant, Low routinely spends $50,000 to $60,000, according to the club's owner, David Sarner. One night, at the Pink Elephant outpost in Southampton, Low enjoyed himself so much that he kept the revelry going -- all the way to Malaysia, Sarner said.

"He ended up flying eight of our [waitresses] to Malaysia for a party," he added.

Strangely, for a man attracting so much attention, very little is known about Low.

According to his official biography, he currently serves as a group adviser of several international corporations and was appointed to the board of UBG Berhad, a financial-services group in Kuala Lumpur, last year.

But when The Post interviewed Malaysian experts at such think tank as the Council on Foreign Relations, no one had ever heard of Low.

According to inside sources, Low lives at a $100,000-a-month apartment in the Park Imperial, on West 56th Street, home to James Bond actor Daniel Craig and Sean "P. Diddy" Combs -- and he won't go anywhere, not even on the elevator, without at least one bodyguard.

Some of Low's entourage of eight to 12 people also reside in two other apartments at the Park Imperial -- a $30,000-a-month pad and a 2,200-square-foot loft with Central Park views that costs $20,000 a month, according to real-estate investor Michael Hirtenstein, who used to live in the latter.

"Diddy lived right below me, and that's where his [Low's] security staff is now," Hirtenstein said. "I know because I tried getting a friend in there. My friend offered $17,000; Jho Low came in with $20,000."

But Low's flashy ways during a time of economic hardship have appalled Park Imperial residents, who complain that the building's entire staff acts like his personal servants. Every day, shopping bags get delivered from the city's biggest stores, such as Bergdorf Goodman.

And Low's caravan of Escalades constantly crowds the area outside the building, several sources said.

"It used to be that when you saw the Cadillac Escalades outside, you knew Sean [Combs] was in town. Now it's this guy," said one amused neighbor.

Speculation is brewing over where Low is getting his money from. One inside observer said, "Nobody spends their own money like that. It's just weird."

Low did not respond to e-mails for comment, and his spokesman David Tan refused to reveal his boss' birthday or background.

"Mr. Low is currently in the USA for holiday and has on several occasions stayed in New York City with his friend[s]," Tan said via e-mail. "He, however, has not rented any property or purchased any property in New York City. Mr. Low did not spend $160,000 at Avenue on one night during Fashion Week."

Indeed, Low's name is not attached to the real-estate deals sources say he is involved in.

A spokesperson for Avenue confirmed Low helped rack up a $160,000 bill in September but added: "The tab was picked up by a friend of [Low's] from Kuwait."

That friend is international man about town Hamad Alwazzan, who also lives at the Park Imperial, according to an e-mail he sent to The Post.

In the e-mail, Alwazzan claims it is he, not Low, who's the big spender in town.

"I have been on holiday in New York since August 2009 and grown quite fond of the city," Alwazzan wrote. "I am especially fond of investment opportunities in real estate, as well as the food, quality of life, and lifestyle."

As for the $160,000 bar tab, he wrote: "[It] was to celebrate the engagement of a close personal friend to his longtime girlfriend, which was jointly hosted by myself and 19 other close friends. I don't have an exact breakdown of the cost, but it was a mixture of entertainment, food and drinks -- and it happened to be during Fashion Week."

But while Low clearly prefers to stay under the radar, he is splurging at a rate that's getting noticed all over the city. According to an inside source, Low recently bought at least six exclusive memberships, for $300,000, at an upscale club in Midtown.

And just this month, sources said, Low celebrated his birthday at a lavish bash in Las Vegas -- where Megan Fox was reportedly flown in to party with him and his entourage. The actress' Fox's publicist could not be reached for comment yesterday. -New York Post

WUJUD PELUANG, BN MENANG

Posted: 29 May 2010 02:02 AM PDT

BN kena cepatlah wujudkan peluang perniagaan.

Dr M agrees subsidy must go but says it must be done gradually

THE HIGHS OF A LOW

Posted: 29 May 2010 02:33 AM PDT

Of late, there has been a lot of curiosity about Jho Low. It was with much surprise when I first read about him HERE in The New York Post last November that related how he burned through hundreds of thousands of dollars at the city's hottest nightspots in the last quarter of 2009 and showed no signs of stopping. That post will shock you wrt the obscene amount allegedly spent.

Two days later, The New York Post featured another article on him about his 28th birthday in Las Vegas, a four-day affair that started at Caesars Palace, where sources said the swimming pool was stocked with bikini-clad party girls and surrounded by caged lions and tigers.

According to THIS SITE, he rents several apartments in the Park Imperial on West 57th St in midtown that house him and his staff—including several body guards. His famous neighbors include Daniel Craig and Sean Combs. The site said that he travels about town with his entourage in a fleet of Escalades. It said Jamie Foxx gave him a red sports car for a present while Paris Hilton and Usher also attended the party. After his party, Low bought 120 bottles of Cristal for the revelers at a nightclub. His supposed benefactor is Kuwaiti Hamad Alwazzancan. I can imagine how that money could have been used for welfare projects for the poor, needy and the handicapped not forgetting conservation of the environment.

Malaysiakini reported HERE yesterday:

PKR Youth chief Shamsul Iskandar Mohd Akin, as part of the 'shocking exposé' promised yesterday, called on the authorities to investigate one Taek Jho Low, who is reportedly a big spender at various Los Angeles nightspots.

"We hear that this Wharton School of Business graduate is a close friend of the prime minister's son with links to a 'Big Mama'," said Samsul in his opening address at the wing's annual congress in Kota Bharu this morning.

"We have some information, and we challenge the premier to reveal whether this person is behind the Sungai Besi air force base contract, which will be one of the biggest projects by the BN government this year," he said, quoting newspaper reports.

He was appointed to the board of UBG Berhad, a financial-services group in Kuala Lumpur, in 2008.

Shamsul later also claimed that Low is an adviser to the Terengganu state investment authority, now known as '1Malaysia' Development Berhad (1MDB).

I surfed the net for more information and came across this official site of 1MDB:

1MDB's origins can be traced to the 2008 general election, which saw the Umno-led Barisan Nasional (BN, National Front Federal Government) losing its two-thirds majority. The BN lost five states, which had an effect on the position of the menteris besar (chief ministers) of states under BN rule. In Perlis, there was a change in menteri besar said to be due to intervention by royalty.

The same thing happened in Terengganu where the Sultan was unhappy with the then menteri besar Datuk Idris Jusoh. One of the major issues was the utilisation of oil royalty amounting to more than RMI billion per annum by the Umno-Ied state and federal government agencies.

To stop the unaccountable spending of oil royalty, the Sultan, together with a few advisers, came up with the idea for the Terengganu Investment Authority (TIA).

A year after its conceptualisation, TIA was established with the blessings of the state and federal governments in March 2009. It is said that as part of the "settlement" of the unaccounted-for oil royalty, the federal government gave a RMS billion guarantee to kickstart TIA.

One of the key people who had advised the' King in establishing TIA was Low Taek Jho, a young merchant banker with strong links to the Middle East. Known as Jho Low to his friends, the young man is also said to be well connected and has done a few major corporate deals. His "lavish" lifestyle in New York was the subject of a feature article in the New York Post last month. Jho, the son of Penang businessman Datuk Larry Low – a former shareholder and director of MWE Holdings Bhd - has however denied that it was he who had splurged on a lavish celebration as had been reported.

Coming back to TIA, the idea was to establish the fund along along the lines of Mubadala Development Company, the SWF of Abu Dhabi. In fact, Khaldoon AI-Mubarak, CEO of Mubadala and chairman of Abu Dhabi Executive Affairs Authority, still sits on the board of 1MDB.

The fund size was initially targeted at RM11 billion, comprising RM5 billion from the federal government and another RM6 billion to come from the securitisation of future annual oil royalty that Terengganu gets from Petronas (the national oil corporation).

But after the initial RM5 billion, raised by a federal government guarantee, the troubles at TIA began. The state, led by Menteri Besar Datuk Ahmad Said, wanted control over the utilisation of the money, something that went against the charter of the fund.

The funds were supposed to be managed by a professional team and overseen by a board of directors and advisers. It was a triple-layer structure to ensure the money is well spent.

But the prime movers behind the funds found out early that this was easier said than done. Subsequently, TIA became a federal entity, which gave birth to 1MDB. CLICK HERE for more.

Another article in The Star HERE in January 2010 gives very interesting information. Excerpts from the article:

For long, the name Cahya Mata Sarawak Bhd has conjured up images of power, lavishness and wealth. But that's less to do with the company and more about its controlling shareholders. CMS, if you don't already know, is the flagship listed asset of Sarawak Chief Minister Tan Sri Abdul Taib Mahmud's family.

There is another listed entity, UBG Bhd (then, called Utama Banking Group) linked to the family but a sale (RHB Bank), massive restructuring and several acquisitions later in 2008 saw the family's controlling interest reduced to an associate level.

It is for this reason – the pomp and grandeur associated with the family – that these two companies draw as much curiousity as they do scrutiny. More recently, these two companies moved back in the limelight on news of a takeover of UBG by a foreign party.

CMS deputy chairman Datuk Seri Mahmud Abu Bekir Taib.

One foot in

After hiving of its interest in financial services to the Employees Provident Fund, UBG was left with a cash hoard (it has since partly paid this out to shareholders) and no core business, hence earning the title PN17. It either finds a new core business or gets booted out of the exchange. It managed to avoid the latter.

So, in early 2008, a private investment vehicle owned by Abu Dhabi-Kuwait Malaysia Investment Corporation (ADKMIC) – Majestic Masterpiece Sdn Bhd – swooped into UBG. Following a complex plan (UBG's regularisation plan to shake itself off the affected listed status) which among many things also involved the acquisitions of water infrastructure company Loh & Loh Corp Bhd (LLCB) and construction firm Putrajaya Perdana Bhd (PPB), it ended up with 53% of UBG while CMS, the original controlling shareholder's interest had reduced to 32%. UBG's public float had thinned out to just under 10% (to retain its listed status, MMSB was required to sell down its stake).

Fast track two years later, in January this year, both those stakes are being hived off, this time, to another Middle-East company PetroSaudi International Ltd - a name that flashed across business sheets' headlines in Malaysia not too long ago for its US$2.5bil tie up with 1Malaysia Development Bhd - for RM2.50 a piece or total RM1.12bil.

The over riding issue behind this deal – CMS needs to cash out to fund its other projects, namely the multi-billion ringgit aluminium smelter project. CMS will raise some RM460mil from the sale and is also believed to be planning a bond issue for this purpose.

"No one haggled. CMS needed to raise money and the sale was fixed at RM2.50 per share," says a source.

Truth is, there was no need to haggle. At RM2.50/share, it values UBG at about 20x over the street's 2010 earning estimates for the group, which analysts deem "fair on the up side". They also point out that UBG has over RM500mil in its coffers and this coupled with its sound earnings potential, would render the price tag reasonable.

MMSB is selling out, says a source, because its aspirations to use UBG as a vehicle to tap the construction opportunities in the Middle-East and more specifically Dubai had fallen flat given the global financial crisis.

"We admit it. We wanted the big jobs but we didn't get it. So, we have changed our focus," says a company source.
...

The 'J Low' factor

These ventures share one thing in common – they all involve Low Taek Jho or Jho Low, a Penang-born 29 year old who has attracted much curiosity and suspicion as he has intrigue in Malaysia's corporate scene.

Low was in fact instrumental in driving TIA during its formative stage; he continues to play a role in 1MDB, particularly in wooing the Arabs to part with the money to invest in the country.

Much of Low's strong ties with the Middle East, it is believed, was nurtured from his pre-tertiary education days at the famous Harrow School, Harrow on the Hill, London.

His father is businessman Datuk Larry Low, who is co founder and chairman of Singapore-listed ElectroTech Investments Ltd. Low's investment vehicle, together with other private investors, is ADKMIC and he is also a UBG board member.

And his latest pet project, sources say, is the setting up of a massive privately-held general investment fund with head offices in the Middle East and Asia.

Will 1MDB be involved?

It is for these two reasons - the `J Low factor' and PSI's earlier tie up with 1MDB - that tongues started to wag as soon as the Petro Saudi-UBG deal was revealed a week ago. Speculation is rife that the deal, in one way or the other, eventually, will see the involvement of 1MDB. CLICK HERE for more.
Interestingly, PSI came out with a statement in The Star HERE that they have no interest in the fortunes of CMS.

If you surf the net, you can find even more information on all this news. For a very young man of 29 years of age, Jho Low has certainly reached the highs of corporate hierarchy very quickly. I wonder how and why...don't you?

Australian Dollar - A Darling Carry Trade Target!

Posted: 29 May 2010 01:52 AM PDT

If you missed out, sadly to speak, the last windfall on Australian Dollar after the burst of the subprime mortgage bubble in USA when our nerves were gripped by the furious fall of AUD (Australian Dollar), then you should grab it back this time.

AUD is simply a darling currency of a lot of international currency investors. It has been target of carry trade by reason of its high-yielding nature. Other reasons include sound economy from the buoyant commodities.

Many thanks to the crisis in Greece for the recent sharp fall in AUD. Get hold of it this time!

Have a good weekend!

Malaysia akan Bangkrup Setahun Sebelum 2020

Posted: 28 May 2010 09:13 PM PDT

Kroni-kroni bebas membahagi-bahagikan kekayaan negara sesama mereka.

Sekarang, Najib dah keluar amaran.

Rakyat mesti bekorban supaya kroni-kroni terus menikmati kekayaan negara.

Rakyat pula terus hidup terhimpit. Pendapatan semakin mengecil, kos hidup makin bertambah.

Itulah Wawasan 2020.

Subsidy removal: more questions than answers

Posted: 28 May 2010 04:07 PM PDT

  1. After the public relation exercise and biased designed opinion poll that was done at KLCC Convention Center, I spent sometime going through Idris Jala slide presentation which was down loaded from PEMANDU website.

  2. Apart from the many "justification" and "scare tactic" slides, one slide is of particular interest to me. The slide shows that the nation debt has increased steadily from RM 90 bill in 1997 to over 407 in 2010. To find a solution that is reasonable and does not burden the average Joe we need to understand what led to the massive increase in debt. Can we say that the nation financial was badly managed that led to the current state. Bear in mind, the government that was ruling us is the same government all the while. Every child that is born in Malaysia today will shoulder now has to shoulder this debt. The debt that was created by the few elitist.

  3. I expect the media and the experts to question on the snowballing of the nation debt. Since yesterday, I did not see any. Everyone was to focus on the fact that the price of good and services is going up. It is as if that there are no other solutions in sight. No one bothered to ask why the snowballing of debt took place. We have oil from the ground and from the trees and yet we live on debt! Something is seriously wrong somewhere here.

  4. I think we need to address the issue by reducing our nation debt in a structured manner. I had been following the actions of Kevin Rudd the Australian premier in addressing the government expenditure deficit. He has raised the mining tax by another 10%. Going by what is being done in Australia, why can't the government follow the same strategy in certain high income sector like banking?

  5. I hope the people in PM department read blogs. If we can increase our taxation net to a wider area, we should collect more. Right now, this is a major weakness. The government is too dependable on the individual income tax as well as the declared income tax by companies. I have only one issue at this stage on subsidy removal. Why should we burden the ordinary people and increase government coffers for the sake of a few people to abuse it! To solve the current debt problem we need to understand what happened between 1997 and 2010.
