Mahfuz Gesa JPJ Supaya Patuhi Keputusan Mahkamah

Mahfuz Gesa JPJ Supaya Patuhi Keputusan Mahkamah

Mahfuz Gesa JPJ Supaya Patuhi Keputusan Mahkamah

Posted: 28 Feb 2011 09:30 AM PST

The language in s. 17(1)(d) of the RTA should be given a strict and narrow interpretation to avoid injustice done to motorists in that the expression "outstanding matter or case with the RTD or the police relating to any contravention of or offence against the RTA or the CVLBA" should be confined only to a matter or case that has gone to court and in which the applicant had failed to appear to answer the charge on the offence or contravention for which the summons was issued, and also to a matter or case under investigation by the RTD or the police and pending the outcome of such investigation. In this case, there was no evidence that the 2nd respondent had satisfied himself that the applicant had been charged in a court of law for the offence stated in exh. L2 or whether the offence alleged had been proven in a court of law against the applicant.

The blacklisting of the applicant was tantamount to compelling the applicant to admit to the alleged offence and pay the compound. This conclusion seemed to have the support of the Federal Counsel when she told the court that the purpose of s. 17(1)(d) of the RTA is to ensure that a person issued with a traffic summons pays the summons. Clearly, therefore, such purpose of the statutory provision would be an affront to the basic principle of criminal law that a person is presumed innocent until proven guilty.

the very corrupted super damn rich chief minister

Posted: 28 Feb 2011 09:03 AM PST

who else, but taib from sarawak! the one who fleece the rakyat in sarawak of all their money, esp. via logging/timber. the one who is so super damn rich while his most of his rakyat are living in poverty.  well, it's not only us in malaysia who feel that of course, not only us in malaysia who are so very angry at how corrupted taib is… but foreigners as well!

well, yesterday, there was an anti taib protest, calling on a halt to timber corruption in london. on the 3r of march and 9th of march, there will be one in the US. see this special site 'stop timber corruption' for details. here is the info on the main page:

Since 1981, the Malaysian state of Sarawak in Borneo has been governed by Chief Minister Abdul Taib Mahmud, one of the most corrupt politicians in South East Asia.

While Taib himself has personally profited immensely from the destruction of the Borneo rainforest through logging and oil palm plantations, Sarawak's indigenous communities have lost their land, the source of their livelihood, and have been increasingly marginalized.

Taib and his family members have illegally acquired assets worth billions of dollars in Malaysia, Canada, the UK, Australia, the United States and other countries. All these assets should be restituted to the people of Sarawak, and the Taib family should be prosecuted for corruption, the abuse of public funds, fraud, money-laundering, tax evasion and other related crimes.

Help us to build up international political pressure against the corrupt Taib family and sign the online petition against timber corruption.

there is also an online petition, where, when you signed, your email will automatically be send to some authorities in several countries, including our very own MACC of course. the problem is MACC won't dare to touch taib. so much had been revealed by the sarawak report already, and yet MACC played deaf and dumb. also, sad to note that there are protests out of malaysia but in malaysia itself, where the corrupt person himself is, there are no protests!  why the people of sarawak fear him eh? they should do a mubarak on him!!

PM Itali Didakwa Penyebar Penyakit AIDS/HIV

Posted: 28 Feb 2011 08:53 AM PST

Laman berita Malaysiakini melaporkan:

Must Renounce Violence or Be Left Out.

Down the Drain - Our Money!!

Posted: 28 Feb 2011 07:11 AM PST

According to The Malaysian Insider HERE, former prime minister Tun Dr Mahathir Mohamad said that mastering the English language will not make one less patriotic as English is currently the language of knowledge. He opined that we have to face the reality that if we want to understand Science and Mathematics for the betterment of our lives, and to build the nation towards becoming a developed nation, we have to understand foreign languages.

Until 1976, the medium of instruction in schools and universities was English. From 1977, the education policy was changed so Bahasa Malaysia became the medium of instruction.

However, in June 2002, a dramatic shift in the Malaysian Educational Policy was announced whereby from January 2003, Science and Mathematics will be taught in English in standard One, Form One and Lower Six in all fully aided government schools.

The rationale for this decision was that most Science based courses in the universities were highly dependent on reference materials published in the English language. This move was to facilitate the learning process in educational institutions.

Tragically, the government announced last year that it would revert to the teaching of the two subjects in the Malay language in national schools and the students' mother tongue (Mandarin or Tamil) in national-type Chinese and Tamil schools from 2011 following the abolishment of the policy of teaching and learning Science and Mathematics in English (PPSMI). Following that, our government announced the strategy of upholding the Malay language and strengthening the command of English in schools.

Those who are in Standard 6, Form 1 and Form 2 (who are currently learning Science and Maths in English) will be hit when they reach Form 4 and Form 5 whereby they will study Science and Maths in BM and after that learn those subjects in English again when they move on to Form 6. So for two years, it will be a drastic change for them and by the time they have adapted, they have to learn in English as well. There are serious implications not just for students but for teachers as well. What is the rationale for this shift?

I do not want to repeat the arguments that others have put forward against the abolishment of the PPSMI. You can read more about that HERE and HERE.

This evening, I came across this paper by Hannah Pillay called "WINDS OF CHANGE: TEACHING SCIENCE AND MATHEMATICS IN ENGLISH - A PERSPECTIVE FROM THE SCHOOL".

I just one to highlight one aspect of this hot topic. Consider this excerpt from the above-mentioned paper:

Distribution of Human Resources

It cannot be denied that there is an uneven distribution of Science and Mathematics teachers who are competent in English. Currently, some urban schools are better placed to take advantage of the Ministry's policy of allowing schools to teach Science and Mathematics in English at all levels, if they have the manpower and resources. There is concern amongst head teachers that various officials will seek to move certain teachers in order to ensure there is a fairer distribution of the available human resources. Is this to be considered "poaching" or "redistribution" of human resources? As a head teacher, I am concerned because the movement of teachers will effect the planning in schools.

From the point of view the District Director of Education or the State Education department, the smooth implementation of the policy will depend on whether schools are evenly resourced What ever decisions are taken, I hope that they will be taken in consultation with the schools heads.

Resources

In the national budget for 2003, the Prime Minister announced that RM 5 billion would be allocated between 2002-2008, for the implementation of the policy to teach Science and Mathematics in English.

All teachers from national schools teaching these two subjects and English would be given a laptop computer to use. All Standard One, Form One and Lower Six classes will be equipped with a LCD projector, a screen and a trolley with speakers and an UPS system.

The Ministry of Education has also prepared materials for use in Standard One, Form One and Lower Six. Each school will be given a launching grant of RM $5,000 to $15,000 to acquire additional materials.

However issues of maintenance and security have not been adequately addressed. The cost of maintaining this equipment is high. Many headteachers are concerned as to who will bear the cost of maintenance as we expect in the initial stages, there will be problems as teachers get used to handling and using the equipment.

The other great concern is security. Most schools are not adequately provided for in terms of security. There are a number of schools, which do not have a twenty four hour security system in place. Hence, it is vital that as more expensive equipment comes in, the Ministry of Education needs to ensure that there is a better security system in place in schools.

The other issue that needs to be raised is whether there is the necessity of equipping schools with all these hardware. Often, it is easy to acquire hardware but not that easy to acquire suitable software.

Institutions sometimes make the mistake of acquiring hardware without making adequate provision for acquiring software. Further, the issue of actual use in the classroom needs to be looked into. Take a Mathematics class for instance. A mathematical solution to a problem needs to be explained in such a way so that the students see the steps being taken towards solving the problem with the teacher explaining it as it is done. Would it be better to use the white board or the computer? CLICK HERE FOR THE REST OF THE PAPER.
So all that money spent to implement the teaching of Science and Mathematics in English in Standard One, Form One and Lower Six in all fully aided government schools w.e.f. 2003 has gone down the drain just like that.

Can you imagine this? That policy lasted from 2003 to 2010 - a total of eight years.

Why change the policy again after such a short period of time? Time and money not forgetting manpower hours have been lost as this change has meant that new textbooks, resources and educational materials have to be prepared in tandem with the change.

It is most unfortunate that it seems as though our education system has long been manipulated to favour a certain party for its vested interest. The motives for the change in policy is highly questionable. I can imagine the frustration that TDM must have felt when he first learnt about this change. Although I may not agree with everything he says, I feel that what he said today about how mastery of the English Language does NOT undermine one's patriotism is spot on.

Truly, for far too long, students have been getting a raw deal as they are the guinea pigs for new policies. At the end of the day, the students suffer. So do teachers but the worst thing is some are willing to let the country suffer in the long run just so they can achieve mileage in their political agenda. The language issue is minor compare to the eroded standards and the quota system and the need to make our youth internationally competitive that our nation may be a high income nation in the future.

Politics and education are like oil and water. They cannot mix.

As it is, far too many graduates today cannot string a sentence or write a decent application letter in English. Instead of moving forward by taking remedial action to restore the deplorable standard of English and to preserve our international competitiveness, they are moving backwards and spending more money!!!

Who suffers?

EVERYONE!!!!

Don't they get it?

Oh perhaps they don't as they are likely to pack their kids off to international schools locally or they may send them abroad to boarding schools.

And who pays for all these wonderful policies??

The rakyat.

You.

Me.

And what do we get???? Excellence in education? Advancement of the Nation?

More money down the LONGKANG!!! And for what purpose?? For whose benefit again?

Sighs.

Brought Sofie to the hospital this morning. She didn't have an appointment with the doctor, but SN wanted to see her to make sure she's compliant with the latest HAART. Since I needed to see SN anyway to discuss with her about the 2 homeless PLHIV we need to send to shelter homes, I had offered to fetch Sofie at her house so she could come with me to the hospital. Sofie was ready when I got to the house, and this time, Saiful & Ika did not follow us to the hospital. I had told them earlier that if they make it a habit to skip school every time their mother has to go to the hospital, we may consider cancelling their education sponsorship.

So what Sofie did was to get them to set the alarm at 10.30 am for them to get ready. The school bus comes at 11.30 am. She had already told them where to leave the house keys.

After dropping off Sofie at the hospital, off I went home for a while. When I grabbed my "mobile office" bag from home earlier, I had forgotten to put my wallet into the bag. So all the while when I was driving to Sofie's house and then to the hospital, I didn't have my IC and driving license with me!!

Luckily my house isn't too far from the hospital. It didn't take too long for me to go home, get my wallet, and then back to the hospital. It took me much longer to find a parking space! There seemed to be so many people today, more than usual. I ended up parking my car at quite a distance, and then walked all the way to the specialist clinic. I guess God just wanted me to have my daily exercise… I didn't do any gardening earlier in the morning as I had to leave home quite early.

When I got to the doctor's room, SN was talking to Sofie, checking on whether she had been taking her medication on time. She was then asked to go to the front to weigh herself and to get her BP checked.

We (SN and I) then discussed about the 2 homeless PLHIV referred to me last week, Lee and Kasim Teoh. I confirmed with SN we'd be able to send them to Hospital Sg Buluh this coming Thursday as I already have someone sponsoring the transportation cost and a fellow volunteer to join me for the trip. I could just send my fellow volunteer to accompany the 2 homeless chaps, but I wanted to meet with the people from the 2 homes so I could get more details about their homes. SN had already made the necessary arrangements with 2 homes willing to accept them, one Muslim home for Kasim and another home for Lee. The people in charge of the 2 homes promised they'd come fetch them at Hospital Sg Buluh so that we don't have to go to 2 different places.

I asked SN to make all the necessary arrangements to get the 2 discharged early morning so that I don't have to end up having to wait for the papers and the medication etc when we come on Thursday morning to fetch them. With previous experiences of having to do everything including to settle payment and to get medication from the pharmacy, I don't want to end up leaving Ipoh in the afternoon.

SN promised me she'd get the staff at the ward to bring Kasim down immediately after breakfast so that we don't have to go up to the ward to fetch him. Great! That means I don't have to find parking. In addition, SN also said she'd try to get Lee (who is at a district hospital) to be brought to Ipoh earlier so that we don't have to go to the district hospital. That would even be better!

SN said she'd call me once all the arrangements are made.

Anyway, since Sofie didn't need to see the doctor, she was done quite early. By the time I brought Sofie home, it was only about 10.40 am or so. To our surprise, both Ika and Saiful were ready in their school uniforms. They were having brunch… leftovers of tomyam cooked by their aunt the day before.

After sending Sofie home, I went to the Buddies Centre. I wanted to make sure all the necessary reports for our coming AGM were ready. Glad to note that all amendments were done… the only thing left now is for the honorary auditor to sign the financial statements. I told the part time staff to make sure that all notice/annual reports are sent out to members by 7th March, so I guess everything is going according to schedule.

I then remembered a new case referred to me from Taiping Hospital. A single mother who works as a school gardener, needing help with her children's education. Since I had not met her yet, I decided to give her a call. Lela, in her late 30's, has 3 teenaged children. She had been on leave from work since her youngest daughter was hospitalised. The daughter had been having high fever for some time  now. All 3 daughters had been tested negative for HIV and so the illness had nothing to do with HIV. Just talking to Lela on the phone, I couldn't really figure out what was wrong with the daughter, but I was made to understand that she may need to be warded for a few more weeks. Oh dear.

I also found out from a fellow volunteer that another client's child is also having health problems. Hana's daughter, who is under our education sponsorship programme, of late had been fainting at home and from time to time would be complaining of chest pains as well. Hana did bring the child to the district hospital, and was told that the girl is suspected to be having heart problems. I told my fellow volunteer to make sure Hana brings the girl for follow-up checks. I don't want Hana to use the "tak ada duit" excuse to postpone doing so.

I do hope the condition of the 2 children is not too serious…

Pegawai Polis Dalang Edar Wang Palsu

Posted: 28 Feb 2011 05:30 AM PST

Kuala Lumpur: Seorang pegawai kanan polis berpangkat superintendan berusia awal 50-an ditahan bersama enam lelaki selepas dipercayai terbabit dalam sindiket pengedaran wang palsu dalam satu serbuan di sebuah kondominium mewah di Jalan Genting Klang, di sini, Jumaat lalu. Gambar Fail.

-hm

Children of Terror

Posted: 28 Feb 2011 04:44 AM PST

This film deals with the militant madrassas in Sudan often inhabited by the orphans of the jihad in southern Sudan, Darfur, Nigeria and Chad. Here, the men are usually enslaved or killed; the women, if not killed, are taken north and sold after enduring sadistic rapes. But the children are often kidnapped and deported to terrorist training camps, where they are brainwashed into the Islamic ideology of hate and trained for military warfare against non-Muslims and the west. When they finish their schooling they are sent back home or abroad to establish sleeper cells and await orders from religious leaders.

This strategy of child deportation and indoctrination has been documented in other wars on innocent non-Muslims and seems to be a jihadi tradition. At least, it carries the distinctive mark of the Islamic strategy: feed off the enemy while you fight him. Within this field Islamic teachings really are highly developed and innovative, applying hundreds and hundreds of often complicated schemes and rackets to bleed the dragon. In fact, "terror" seems to be one such scheme. The creativity behind these traditions of jihad, is so downright evil it boggles the mind, but when one understands the true implications of a doctrine of permanent war one realises a neccessity at work and begin to find these vicious systems of exploitation feeding off non-muslim societies time and time again. A kind of ancient jihad economics is in play, in which the kafirs figure as nothing but a natural resource.

The documentary contains original footage from these child terrorist camps which was sent to thousands of Muslims in the West to raise alms for jihad. In the video we are told that "these are the children the West fails to see, the children the West fears the most." "Each one of them has been trained with an AK-47 assault rifle and will do their duty to Allah and the Ummah when called upon to do so"

What this "duty" is, and how many of the "youths" of the West actually stayed in extremist madrassas before being welcomed as de facto refugees, "unaccompanied minors. asylum seekers, and immigrants we have yet to see. But human trafficking being yet another branch of jihad economics, one has to hope for the best but expect the worst.

Chan Kong Choy Hadapi Tuduhan Kes PKFZ

Posted: 28 Feb 2011 04:19 AM PST

Akhir 2009, bekas Pengurus Besar Lembaga Pelabuhan Klang (LPK) Datin Paduka O.C.

Merlimau Tunggu Tarian Separuh Bogel Dari UMNO BN

Posted: 28 Feb 2011 04:12 AM PST

PRK Merlimau: UMNO BN Terdesak Guna Taktik Ugutan Kepada Pengundi

Posted: 28 Feb 2011 03:36 AM PST

-TMI

Scandals Galore

Port Klang Free Zone (PKFZ) is a 1,000-acre (4.0 km2) regional industrial park located in Malaysia. Located along the Straits of Malacca, Port Klang, it offers extensive distribution and manufacturing facilities. Jebel Ali Free Zone Authority (JAFZA) previously managed the place but it was taken over and rebranded by a local company in 2007.

The PKFZ offers various investment incentives to investors including:

  • tax exemptions on most products and services
  • subsidies
  • wholly foreign owned enterprises is allowed
  • free repatriation of capital and profits and incentives for research and development, training and export.
Click HERE to read Wikipedia's article about PKFZ.

The PKFZ controversy arose after the cost to develop the massive 1000-acre integrated cargo distribution hub and industrial park spiraled from RM2 billion to RM4.6 billion.

Today, TMI reported HERE that former transport minister Tan Sri Chan Kong Choy was today charged with three counts of cheating over the Port Klang Free Zone (PKFZ) project at the Sessions Court here, and faces up to five years' jail on each count.

On July 29th last year, The Malaysian Insider reported HERE that Tun Dr Ling Liong Sik was charged with cheating here today over the scandal hit Port Klang Free Zone (PKFZ) project.

The PKFZ website HERE outlines the charges for former general manager of the Port Klang Authority (PKA), Datin Paduka OC Phang, along with two others.

Frankly, although the PKFZ scandal involved a large sum of money, there have been other scandals which have clocked record high amounts as well.

Do you remember the two bailouts of Malaysia Airline System? I cannot find official data on the total amount as reported by some bloggers but I managed to unravel old reports HERE.

According to LKS's blog HERE, he called for public inquiry on how the half-a-trillion ringgit contributed by Petronas to government past 33 years and the RM15.2 billion ringgit royalty to Terengganu from 2000-2009 have been properly spent and accounted for. CLICK HERE to read the astounding amounts for bailouts!

CLICK HERE to read LKS's media statement on Government should name names as to the leaders or officials responsible for overpaying Tajudin Ramli 117% over the market price for the MAS stake without any independent professional valuation so that police reports could be personally lodged against them.

Asia Sentinel HERE reported about the AP issue and listed many scandals that rocked our country. It also quoted an economist who said the country might have lost as much as U$100 billion since the early 1980s to corruption.

The report said:

In July of 1983, what was then the biggest banking scandal in world history erupted in Hong Kong, when it was discovered that Bumiputra Malaysia Finance (BMF), a unit of Bank Bumiputra Malaysia Bhd, had lost as much as US$1 billion which had been siphoned off by prominent public figures into private bank accounts. The story involved murder, suicide and the involvement of officials at the very top of the Malaysian government. Ultimately it involved a bailout by the Malaysian government amounting to hundreds of millions of dollars.

That was just the first Bank Bumi scandal. The government-owned bank had to be rescued twice more with additional losses of nearly US$600 million in today's dollars. Ultimately government officials gave up and the bank was absorbed into CIMB Group, currently headed by Nazir Razak, the prime minister's brother. That scandal, which stretched over several years before its denouement in 1985, set the tone for 24 years of similar scandals related to top Malaysian officials and was the first to prove that in Malaysia, you can not only get away with murder, you can get away with looting the treasury as well.

Perwaja Steel, for instance, lost US$800 million and its boss, Eric Chia, a crony of Mahathir's, was charged with looting the company. He stood trial, but was acquitted without having to put on a defense.

CLICK HERE to read the rest of the article.
With all these facts and figures available with the click of the mouse, decision-making about who to vote for is a piece of cake, at least for me and I hope for you too.

Add up the amount lost and then imagine how developed our country would have been - the types of highways we should have been enjoying sans tolls, schools and universities with state of the art equipment, the number of strong bridges that we would have had, hospitals and equipment for all areas and the standard of living we should have been enjoying.

Years ago, Korea was lagging behind Malaysia. Today, they have overtaken us. At this rate, would Vietnam or Laos overtake us one day as well?

Some may be numbed by the incidences of corruption but I am sure there are many who continue to be outraged and yet helpless about what to do. Listen to what Executive Director of Transparency International, India, Anupama Jha has to say in an interview with One World, South Asia. Excerpt from THIS SITE:

Yes I feel that there is a real, practical, doable way of addressing corruption. As a corruption fighter I have to be optimistic even in the midst of rampant corruption in the country.

Corruption always flows from top to bottom and if we are able to address political corruption then we will be able to reduce, if not eliminate, corruption in judiciary, bureaucracy and in any other sector.

In a democracy, it is possible to create political will if the civil society and media work together to pressurize politicians.

People should realise and decide that no matter what, until and unless there is a situation of life and death, they won't indulge in bribery.

If politicians want things can actually change. There is at present no independent anti corruption agencies. There is the CBI, where there is too much political interference. The Chief Vigilance Commission can't take action but can give only suggestions.

It is very important for civil society bodies and people in the country to realise that there is a supply side of corruption also. People too, need to commit that they will not give a bribe, no matter what. What we see today is that people are ready to pay bribes for the smallest tasks.

The culture of corruption has to be put to an end and this is something that ALL of us have to do.

If not, we will have to suffer more scandals galore and our coffers will be bleeding dry...What will happen then?

The solution lies within you and me and the ballot box.

Nik Aziz Seru Pengundi Beri Kepercayaan Kepada PAS-Pakatan Rakyat Tadbir Negara

Posted: 28 Feb 2011 02:00 AM PST

-TMI
