Dr Hatta Menang Saman Terhadap Polis Yang Menceroboh Kediaman Persendirian

Dr. Mohd Hatta Ramli, Timbalan YDP PAS Rompin Mazlan Mohamed Yasin dan Ketua Pemuda Rompin Nazri Ahmad menang dalam saman terhadap bekas Ketua Polis Daerah Rompin di Mahkamah Tinggi Kuantan berkaitan kes penangkapan semasa berceramah di premis sendiri pada 2004 lalu, lapor harakahdaily.

Mahkamah Tinggi Kuantan akan menentukan jumlah tuntutan saman yang dimenangi Bendahari PAS Pusat, Dr Hatta dan dua rakannya terhadap polis, sebelum 15 Mac ini.

Menurut Dr Hatta yang dihubungi Harakahdaily, hari ini berlangsung perbincangan dengan peguam kedua-dua pihak namun jumlah sebenar tuntutan belum boleh diputuskan.

Hakim Datuk Mariana Yahya dalam penghakimannya pada 26 Ogos lalu memutuskan Hanapi Daud (pihak polis) telah secara salah menangkap Dr. Mohd Hatta Ramli, Mazlan Mohamed Yasin dan Nazri Ahmad.

Hakim dalam keputusannya berkata, pihak polis telah gagal menyatakan sebab penangkapan di samping ternyata bersalah menceroboh kediaman persendirian semasa penangkapan itu.

Berikutan itu, hakim memutuskan Hanapi selaku defendan dikehendaki membayar ganti rugi khas, ganti rugi am, ganti rugi tauladan dan ganti rugi melampau kepada tiga aktivis PAS terbabit.

Menurut fakta kes, pada jam 9.15 malam 10 Jun 2004 satu majlis ceramah penerangan telah diadakan di Markas Pas Kawasan Rompin, di nombor 42 Desa Teratai, Muadzam Shah. Ketua Polis Daerah yang mengetuai sekumpulan anggota polis dari Ibupejabat Polis Rompin telah mengeluarkan arahan supaya majlis tersebut dihentikan diatas alasan tiada permit perhimpunan dikeluarkan.

Ketua Polis Daerah juga telah mengarahkan anggota-anggota polis melakukan serbuan keatas premis ceramah tersebut dan telah menangkap plaintif kedua, ketiga dan keempat tanpa menunjukkan sebarang waran tangkapan.

Anggota-anggota polis yang melakukan serbuan dan tangkapan keatas premis tersebut telah merampas segala peralatan sistem bunyi (P.A. System) dan secara kasar yang telah mengakibatkan kecederaan pada plaintif keempat.

Berikutan itu, mereka bertiga telah ditahan, digari dan dibawa ke ibu pejabat Polis Daerah Rompin untuk disoal-siasat sehingga keesokan harinya.


Kes tersebut difailkan oleh ketiga-tiga ahli PAS itu pada 1 Disember 2004 di Mahkamah Tinggi Malaya Kuantan melalui firma guaman Mohamad Hanipa & Associate.

Plaintif memohon deklarasi bahawa penangkapan dan penahanan mereka pada masa ceramah tersebut tidak sah, terbatal, tidak berpelembagaan dan tidak mempunyai apa-apa kesan.

Plaintif juga memohon deklarasi bahawa majlis ceramah yang diadakan di markas PAS Kawasan Rompin (pada 10 Jun 2004) tidak memerlukan permit polis di bawah Seksyen 27 Akta Polis 1967.

Selain itu, plaintif memohon deklarasi bahawa defendan telah bertindak melampaui batas kuasainya di bawah Akta Polis 1967 dan tindakan defendan tersebut adalah satu penyalahgunaan kuasa (abuse of power).

Plaintif turut memohon deklarasi bahawa defendan telah melakukan pencerobohan ke atas markas PAS Kawasan Rompin dan menuntut ganti rugi serta lain-lain relif difikirkan sesuai oleh mahkamah. -harakahdaily

Justeru itu, jika ada kes di mana berlakunya serbuan dan tangkapan oleh pihak polis terhadap mana-mana individu di premis persendirian, ia adalah satu kesalahan yang dilakukan oleh pihak polis lantaran menceroboh (trespass) dan hendaklah didakwa di mahkamah.

517 Kes Buang Bayi Dilaporkan Dari 2005 Hingga Januari Tahun Ini

KUALA LUMPUR: Sebanyak 517 kes pembuangan bayi dilaporkan sejak tahun 2005 hingga Januari tahun ini.

Pengarah Jabatan Siasatan Jenayah Bukit Aman Datuk Seri Mohd Bakri Mohd Zinin berkata jumlah itu merangkumi 203 orang bayi lelaki, 164 orang bayi perempuan dan 150 orang bayi yang tidak diketahui jantinanya.

"Bagi kes tidak dikenal pasti jantina, ini adalah kerana keadaan mayat yang reput dan bedah siasat tidak dapat dilakukan," katanya kepada pemberita di pejabatnya di sini pada Rabu.

Beliau berkata daripada 517 bayi itu, sebanyak 230 merupakan bayi yang hidup manakala 287 pula bayi yang telah meninggal dunia.

Mohd Bakri berkata seramai 37 orang suspek telah ditangkap dari 2005 hingga tahun ini termasuk empat orang pada Januari ini berhubung kes pembuangan bayi.

Dalam tempoh yang sama, 18 kes telah dituduh di mahkamah dan sebanyak sembilan kes telahpun dijatuhi hukuman, katanya.

Menurutnya hasil kajian mendapati lokasi yang paling popular untuk jenayah ini adalah di kawasan perumahan dan tempat pembuangan sampah selain di tepi jalan, masjid, sungai, semak dan dalam tandas.

Mohd Bakri berkata polis berdepan dengan kekangan dalam siasatan jenayah tersebut seperti kesukaran untuk mengesan suspek, tidak dapat mengumpulkan bukti yang mencukupi kerana kebanyakan bayi telah reput.

"Ujian DNA tidak dapat dilakukan kerana tiada sampel yang diperolehi daripada suspek untuk perbandingan," katanya.

Justeru itu, polis mencadangkan kepada semua pihak yang terlibat dalam mencegah jenayah ini sama ada kerajaan dan bukan kerajaan agar menekankan aspek pencegahan dan rawatan secara serentak.

Sementara itu, beliau berkata pihaknya kini diberi tanggungjawab mengendalikan sistem amaran awal kehilangan kanak-kanak yang dikenali sebagai NUR Alert (National Urgent Response Alert) bagi mengesan dan menghebahkan kehilangan kanak-kanak berumur 12 tahun ke bawah.

Katanya pihaknya diberi kepercayaan oleh Kementerian Pembangunan Wanita, Keluarga dan Masyarakat dalam isu ini memandangkan siasatan dilakukan oleh polis turut meliputi pencarian bukti dan penyebaran maklumat.

"Oleh itu bagi polis, kita mengharapkan kerjasama dari semua pihak dalam mengendalikan perkara itu," katanya.

Menteri Pembangunan Wanita, Keluarga dan Masyarakat, Datuk Seri Shahrizat Abdul Jalil baru-baru ini berkata, kementerian itu bersama-sama polis telah memuktamadkan pelaksanaan sistem itu setelah ia dipersetujui kedua-dua pihak.

"Kalau ada kes-kes kehilangan, sistem ini akan digerakkan segera," katanya. - BERNAMA

I was on clinic duty again today. Since I ran out of Buddies brochures I stopped by our center to get a few and chucked them into my bag. And thank goodness, getting a parking space today wasn't too bad.

As usual, once I got to the specialist clinic, first thing I did was to go to the doctor's room to inform the nurse I was there, and to find out if there were any new cases to be referred. The doctors had not come down from their rounds yet but SN told me there were a few new cases today.

So I went straight to the counselling room. It wasn't long before the nurse came in with a new case… a 68 year old man who went for a holiday in Cambodia last year, had too much of a drink, and ended up having sex with strangers. Well, his CD4 isn't too bad, so I guess he won't be on HAART yet. I had to rephrase my questions a few times… although the guy could speak Malay, I guess he'd be able to understand better if I gave him a Chinese volunteer.

When I went to return his file to the nurse, I was told there was another case to be referred, and although the lady was already at the hospital, she was on a stretcher as she's bedridden. But at that point of time, she was still outside with the other patients waiting for their numbers to see the various specialists. It wasn't practical to get the lady to the counselling room, not when she's on the stretcher… and it wouldn't be a good idea for me to go out to talk to her when so many other patients would be able to listen to our conversation, so the nurses agreed that I wait for the lady to be wheeled in to see the doctor and I could talk to the lady there.

While waiting, I called Aina. Remember Aina? The lady whose house I (and 2 other volunteers) went to visit earlier this year, and whose husband passed away end of last month? The last time I called, Aina was still at her late husband's kampong, where he was buried. I had asked Aina to send me a copy of Ali's death cert. Today when I called, Aina was already back at her own kampong. But when I asked if she was still staying at the same house, she said she had moved to her mother's house within the same kampong because an uncle of hers wanted to stay at the old house. You see, the house is still under the name of her late grandmother, which means quite a few family members had rights to the house. All the while Aina stayed there out of courtesy as she didn't have a home, but apparently immediately after her husband died, her uncle wanted to stay in the house. Not wanting to make too much of a fuss, Aina and her 2 kids moved out to stay with her mother. Anyway, I told Aina to inform me if her children needed any help especially pertaining to their schooling.

Just as I got off the phone with Aina, SN came in to inform me that the bedridden lady had already been wheeled in to see the doctor. I immediately got up heading to the doctor's room. Well, they didn't even wheel her into the room as the room was rather small, so the doctors themselves had to get up to see her right outside the room… at the corridor meant only for hospital staff.

The lady, Hamidah, couldn't even talk much. Every time she opened her mouth, she felt pain. Other than HIV, she had TB and mouth ulcers. Even when she talked we couldn't understand much of what she was saying. So our conversations were more with the 2 nurses who accompanied her from the district hospital where she had been warded for the past month.

Hamidah married thrice. Her first husband died, leaving her & 4 children. Hamidah remarried and had 3 children with her 2nd husband. The 2nd husband died of AIDS related illnesses (he was an IVDU). Hamidah then married a third time. Then one time she had to be admitted to the hospital, and they decided to do a full blood test on her. That was when she was diagnosed HIV positive. Her husband was then called to get his blood tested as well, and he too was confirmed positive. The only problem was, immediately after he was diagnosed +ve, he disappeared. He never followed up at the hospital to get treated.

Actually Hamidah herself never went for follow up appointments for her HIV as she still felt okay then. She only went back to the hospital lately when she got weaker and weaker. Now, with a CD4 of only about 60, and her body weight getting below 30kg, Hamidah was too weak to even sit down. She lost a lot of weight because she couldn't eat. Not that she didn't have the appetite to eat, but every time the nurses tried to feed her, the moment the food got into her mouth, she shouted due to the pain. So she couldn't really consume much, hence, the lost of weight.

According to the nurses, of late her children had not been visiting her at the hospital either. Her 2 younger children are teenagers, still schooling, and ever since Hamidah was hospitalised, they had to take care of themselves at home. Her older children, all married and working, stays elsewhere. One son does stay in the same town, but he too seldom visits. Only when he visits, then he'd bring the 2 younger ones to visit as well. Otherwise, she'd have no visitors at the hospital. The nurses at the district hospital did call one of her daughters to inform her that they'd bring Hamidah to Ipoh GH today for further check-up, and asked if she'd like to come along to accompany her mother. But she just said no.

Based on what the doctor said, chances are Hamidah would have to stay at the hospital for some time, as they'd need to monitor her medication. Nobody would be taking care of her at home if she's discharged. She'd be totally helpless.

Frankly, other than to follow up on her case, I don't really know how to help Hamidah.

Nurul: Explain RM70,000 per metre walkway

Lembah Pantai parliamentarian Nurul Izzah Anwar demanded to know why RM10 million is needed to construct a 142m air-conditioned elevated pedestrian walkway in Kuala Lumpur.

The first phase of the pedestrian walkway project links the Kuala Lumpur Convention Centre to Impiana Hotel. 

Another six pedestrian walkways will be constructed linking Pasar Seni LRT-Dayabumi, DBKL main building-Sogo Shopping Complex, KTM Komuter-Bandaraya LRT, Jalan Sultan Ismail-Maju Junction-Medan Tunku monorail station, Plaza Rakyat-Puduraya terminal bus station and Albukhari Mosque-Hang Tuah LRT station.

Syarikat Prasarana Sdn Bhd (Prasarana) has invested about RM60 million to build the six walkways which are part of 12km project.

"As a Federal Territory Pakatan Rakyat MP I am happy that such infrastructure is built for the benefit of Kuala Lumpur residents and tourists… (but the) amount (spent) demands clarification as public monies were undoubtedly used," she said. 

According to a Bernama report, national oil company Petronas contributed RM100 million towards the development of the two-phase facilities. 

Nurul said that the project must be taken to task as government-linked companies (GLCs) are backing the project. 

"What are the exact figures for the construction of these walkways? As the elevated pedestrian walkway is air-conditioned, what are the maintenance and operational costs involved and as the unit price of energy increases how will these costs increase over time?" she asked. 

NONE"As GLCs and agencies – Petronas, KLCC Holdings Sdn Bhd, DBKL (Kuala Lumpur City Hall) and Prasarana – are involved, was there an open tender process to ascertain whether there were any lower-priced options available?" she added.


"These are all questions that I hope will be answered dutifully and truthfully by Raja Nong Chik (right) as the minister in charge, as well as by the mayor of Kuala Lumpur Ahmad Fuad Ismail."

Although she welcomed the efforts to develop the basic infrastructure for pedestrians in the city centre following the hike in prices of domestic goods and petrol, she insisted that the hefty cost must be well accounted for.

Nurul urged all related government ministries, agencies and organisations to lead by example and end such excessive expenditure.

Obama Akhirnya Berhenti Merokok

Presiden AS Barack Obama akhirnya dapat mengakhiri kecanduannya pada rokok. Isterinya, Michelle, menyatakan sangat bangga bahawa mantan "panglima penghisap asap" itu dapat memandang mata anak-anaknya dan berkata ia tak lagi merokok.

Perjuangan Obama untuk mengalahkan kecanduannya telah menjadi pusat perhatian yang sangat besar buat media AS selama kempen kelilingnya tahun 2008 dan dalam dua tahun pertama masa jabatannya.

Namun, Ibu Negara Michelle Obama, Selasa (8/2), mengatakan kepada wartawan bahwa Obama sudah tak mengepulkan asap selama satu tahun terakhir. Michelle mengatakan, ia "sangat bangga" Obama telah berhasil dalam mengalahkah apa yang telah menjadi "tantangan peribadi buat dia", demikian laporan USA Today.

"Ketika seseorang melakukan tindakan yang benar, jangan mengacaukannya," kata Michelle Obama sebagaimana dikutip USA Today. Ia menambahkan, Obama akhirnya berhenti merokok sebab ia mau memberitahu puteri-puterinya, Malia dan Sasha, bahawa ia tak merokok lagi.

Ibu Negara Amerika Serikat itu berbicara kepada wartawan untuk menandai peringatan kempen "Let's Move" guna mengakhiri kegemukan pada anak-anak.

Obama telah didesak doktornya pada Februari tahun lalu agar berhenti merokok demi kebaikannya setelah pemeriksaan kesihatan pertamanya sebagai presiden. Pada pemeriksaan itu, Obama dinyatakan "memiliki kesihatan yang sangat bagus" dan "cocok untuk menjalankan tugas", tetapi doktornya mendesak dia untuk berhenti merokok.

Jurucakap Rumah Putih Robert Gibbs mengatakan, beberapa pembantu dekat Obama telah bergabung dengan presiden tersebut dalam usaha untuk berhenti merokok. Gibbs menambahkan, dirinya yakin pengaruh Ibu Negara telah membantu. "Saya fikir ketika seseorang memutuskan untuk berhenti merokok ... mereka melakukannya bukan sekadar kerana mereka mau, tetapi kerana orang lain juga mau mereka melakukannya," kata Gibbs.


RMN DESERVE THE BEST REGARDLESS OF COST

The recent announcement by Defence Minister Dato Seri Dr. Ahmad Zahid Hamidi regarding the intended construction of six Littoral Combat Ships (LCS) by Boustead Naval Shipyard (BNS) at an estimated cost of RM6 billion has generated enough debate by the opposition, bloggers, defence analyst, ordinary man on the streets, and the latest being the Navy Chief himself. I view this as a healthy debate as it only shows that Malaysians are alert concern with the developments surrounding them, and more so if it involves public spending; especially that of defence spending.

As a retired military person, I would not hesitate to support the local defence industry and particularly if it involves high technology transfers. In the case of the construction of the LCS, or for that matter any other navy vessels, one must understand that Malaysia seriously needs to a strong navy as the country is a maritime nation.

Malaysia has several ship building companies, but the construction of a navy vessel is not as simple as building a leisure yacht or even a cruise ship. This is something that is not well understood by most people, as a navy vessel is grossly different for other ship. I think the Navy Chief in his press conference held today has enumerated in great detail as to why the cost of building the LCS locally is exorbitant.

One ought to be aware that although BNS has recently delivered Offshore Patrol Vessel (OPV) to the Royal Malaysian Navy (RMN), this does not mean that they are now competent and are experts in building more sophisticated navy vessels. Indeed, if one were to understand what an LCS entails and the technology that goes into building such a vessel, one will at once realize the substantial differences in the makeup and configuration of the OPV and the LCS. More significantly, the OPV and LCS have vastly different roles and tasks.

I am informed that BNS would be collaborating with a number of established internationally renowned shipbuilding companies. This in itself is already a costly affair as it also involves technology transfers and various aspects of sophisticated equipment integration that would make the LCS a awesome fighting navy vessel.

I believe the idea of building the LCS locally is not something that had just appeared from the sky. It must have gone through long drawn discussions, fore thought and taking cognizance of the long drawn development plan of the RMN. Let's hope too that once the LCS has been successfully built, Malaysian can proudly say that the country now has the full capacity to built larger and more sophisticated navy vessels and ships, thus contributing to the defence self relience that the country aspires.

Our RMN truly deserve the best as its role in the defence of our sea frontier is critical to the defence of the mainland. You breach the sea frontier; you breach the mainland as well.

Ops Lalang: Kit Siang cabar Mahathir namakan pembangkang, jangan salahkan polis

KUALA LUMPUR, 9 Feb — Lim Kit Siang hari ini mencabar bekas perdana menteri Tun Dr Mahathir Mohamad mendedahkan nama pemimpin-pemimpin pembangkang yang beliau bertemu dan memberi jaminan bahawa mereka tidak akan ditahan di bawah Operasi Lalang 1987.

Menjawab dakwaan Dr Mahathir bahawa polis yang mahu pemimpin-pemimpin pembangkang dan yang lain ditahan, Lim berkata:

"Biar Mahathir menamakan pemimpin-pemimpin pembangkang yang beliau telah bertemu dan memberikan jaminan bahawa mereka tidak akan ditahan, tetapi ia telah diatasi oleh polis menerusi Operasi Lalang."

Dr Mahathir mengatakan demikian dalam buku terbaru "Doctor M: Operation Malaysia – Conversations with Mahathir Mohamad" tulisan Tom Plate.

Penasihat DAP itu berkata, Dr Mahathir bukan sahaja berhadapan dengan masalah memori selektif dan fikiran tidak betul tetapi turut memutarbelitkan perkara tidak benar mengenai ketidakdilan yang dilakukannya selama 22 tahun menjadi perdana menteri.

Operasi Lalang atau Ops Lalang dilancarkan pada 27 Oktober 1987 oleh polis, agensi di bawah Kementerian Dalam Negeri bagi menangkap mereka yang mengeruhkan suasana politik ketika itu.

Dalam Operasi Lalang ini, seramai 106 ahli politik terutama parti pembangkang ditahan di bawah ISA dan pembatalan dua akhabar harian dan dua akhbar mingguan.

Selain Lim, turut ditahankan ialah Chandra Muzaffar, Karpal Singh, Kua Kia Soong, Ibrahim Ali dan Mohamed Fahmi Ibrahim.

"Saya tidak pernah berjumpa dengan Mahathir dan beliau tidak pernah memberikan saya jaminan bahawa saya tidak akan ditahan sebelum Operasi Lalang dilancarkan pada 27 Oktober 1987 meskipun sehari sebelum itu saya bercakap di Parlimen ketika perbahasan bajet mengenai peningkatan ketegangan kaum dan saya meminta kesemua parti bersetuju dengan (syor) moratorium selama setahun di mana tiada isu perkauman, bahasa atau agama dicetuskan atau dibangkitkan bagi setiap rakyat Malaysia memberi tumpuan ke atas keutamaan negara mencapai pemulihan ekonomi dan pertumbuhan," katanya lagi.

Kata Lim, tidak patut Dr Mahatahir mempersalahkan polis sebagai bertanggungjawab atas Operasi Lalang memandangkan beliau bukan sahaja tidak mempertahankan penahanan 106 orang di bawah Seksyen 73 Akta Keselamatan Dalam Negeri (ISA), malah beliau menggunakan kuasanya selaku Menteri Dalam Negeri di bawah Seksyen 8 akta itu untuk mengeluarkan perintah menahan selama dua tahun membabitkan 49 orang termasuk tujuh ahli Parlimen DAP.

Lim berkata, Dr Mahathir sentiasa membuat dakwaan palsu dan tidak berasas bahawa ahli-ahli Parlimen DAP ditahan bukan kerana mereka wakil rakyat atau disebabkan kepercayaan politik, tetapi kerana cuba untuk mencetuskan kerusuhan kaum.

Sebagai contoh katanya, Dr Mahathir memberitahu majalah Asiaweek keluaran 11 November 1988 bahawa beberapa orang masih ditahan kerana enggan memberi jaminan tidak akan mencetuskan perkauman lagi.

Malah kata Lim, sebenarnya salah guna ISA untuk tujuan peribadi, berfikiran sempit dan perasaan dendam adalah jelas memandangkan beliau dan anaknya Guan Eng, kini Setiausaha Agung DAP dan Ketua Menteri Pulau Pinang, adalah dua yang terakhir daripada 49 tahanan Operasi Lalang dibebaskan pada April 1989.

"Sedangkan yang lain dibebaskan bermula Jun 1988," kata beliau.

"Saya selalu mengakui memang ada ketegangan kaum pada Oktober 1987, tetapi ketegangan kaum ini bukan dicetuskan oleh ahli-ahli Parlimen DAP atau tahanan lain Operasi Lalang, tetapi oleh beberapa pihak yang mahukan kuasa politik dalam Umno," katanya.

Pada 1987 Umno berhadapan dengan krisis kepimpinan membabitkan dua puak, satu diketuai oleh Dr Mahathir manakala yang satu lagi oleh Tengku Razaleigh Hamzah-Tan Sri Musa Hitam.

"Sebagaimana dikatakan oleh Bapa Malaysia dan perdana menteri pertama (Almarhum) Tunku Abdul Rahman sejurus selepas Operasi Lalang, pada November 1987, ia bukan persoalan orang Cina menentang kerajaan tetapi parti sendiri, Umno, yang menentang beliau," kata Lim memetik akhbar The London Times edisi 9 November 1987.

Sehubungan itu kata Lim, Dr Mahathir tidak boleh memindahkan tanggungjawabnya terhadap pasukan polis, sebaliknya perlu tampil bersih dan meminta maaf kepada seluruh negara kerana mengadakan Operasi Lalang, yang disifatkan sebagai bab hitam dalam soal hak asasi manusia di Malaysia.

"Adakah Mahathir (juga) mahu mempersalahkan kehakiman, polis, Suruhanjaya Pilihan Raya, agensi antirasuah, media dan institusi-institusi utama negara atas kegagalan membantah demi melindungi, mempertahan dan menggalakkan keberkesanan, kebebasan dan profesionalisme ketika (era) kepimpinannya?" kata Lim lagi.

Dalam buku itu, Dr Mahathir yang meneraju Malaysia selama 22 tahun itu mengakui bahawa beliau berang dengan tindakan polis tersebut.

"Ya, saya akan tangani secara berbeza, tetapi polis ingin melakukan hal-hal ini (tangkapan ISA) kerana mereka menyatakan ia perlu.

Ops Lalang: Mahathir persalahkan polis

Mantan Perdana Menteri, Tun Dr Mahathir Mohamad Dr mempersalahkan polis atas Ops Lalang, yang menyaksikan 106 orang, termasuk seteru politiknya ditangkap mengikut Akta Keselamatan Dalam Negeri (ISA) pada tahun 1987.

Dalam buku terbaru mengenai Mahathir, yang berjudul 'Doctor M: Operation Malaysia - Conversations with Mahathir Mohamad', bekas perdana menteri yang meneraju Malaysia selama 22 tahun itu mengakui bahawa beliau berang dengan tindakan polis tersebut.

"Ya, saya akan tangani secara berbeza, tetapi polis ingin melakukan hal-hal ini (tangkapan ISA) kerana mereka menyatakan ia perlu...

"Saya sebenarnya berjumpa dengan semua ahli pembangkang (terlebih dahulu) dan meyakinkan mereka bahawa mereka tidak akan ditangkap. Dan awak tahu apa yang polis lakukan? Polis menangkap mereka. Kredibiliti saya hilang," katanya.

"Awak pastinya marah!" balas Tom Plate, yang mewawancara Mahathir dan mengarang buku berkenaan.

"Yeah, tapi apa yang boleh saya lakukan? Saya perlu menerima hakikat bahawa mereka adalah orang-orang yang membuat keputusan. Saya memberikan kuasa umum kepada mereka untuk bertindak," kata Mahathir.

Semasa penangkapan besar-besaran pada 27 Oktober 1987, lebih seratus orang ditangkap - sebahagian besar mereka terdiri daripada pemipin pembangkang dan segelintir ahli politik dari Umno dan MCA. Selain itu, permit penerbitan untuk akhbar The Star, Sin Chew Jit Poh dan Watan telah ditarik balik.

Kerajaan kemudian menawarkan penjelasan bahawa tangkapan ISA yang kedua terbesar sejak rusuhan perkauman 13 Mei adalah 'perlu' bagi membendung 'ketegangan perkauman' yang semakin memuncak akibat protes besar-besaran berhubung pelantikan pengetua bukan berpendidikan Cina di sekolah-sekolah vernakular Cina.

Umno pula membalas dengan juga mengadakan protes besar-besaran yang diketuai oleh ketua pemudanya ketika itu, Datuk Seri Najib Razak di Kampung Baru, beberapa hari sebelum tangkapan beramai-ramai dibuat. -mk

Chow cam anggota polis wanita dalam 30 saat

Pemilik kedai, Chow Soo Meng, yang mendakwa ditampar dan dirompak oleh anggota polis preman di Sungai Buloh minggu lalu, hari ini mengenalpasti anggota polis wanita yang didakwa mengambil wang RM20,000 dari beg tangannya.

Chow, 38, mengenalpasti anggota polis berkenaan dalam satu kawad cam di ibupejabat polis Petaling Jaya pada jam 12.05 tengahari tadi.

Pemilik kedai yang sedang mengandung lapan bulan itu ditemani ahli parlimen Segambut, Lim Lip Eng.

Menurut Lim, Chow hanya mengambil masa 30 saat untuk mengenalpasti anggota polis wanita yang didakwa menggari dan mengambil wangnya.

Sementara itu, ketika dihubungi Malaysiakini, Ketua Polis Petaling Jaya, ACP Arjunaidi Mohammed enggan memberi sebarang komen mengenai perkara itu.

Sabtu lalu, Chow telah mengenalpasti lima lagi anggota polis dalam satu kawad cam berasingan.

Polis nafi curi wang

Chow mendakwa polis telah mencuri kira-kira RM20,000 wang tunai dan beberapa barangan dari kedainya, serta menamparnya.

Dalam laporan polisnya, Chow mendakwa polis mengambil beberapa jenis rokok, enam botol minuman keras, oren mandarin dan tiga karton minuman tin.

Polis Petaling Jaya menafikan anggotanya mengambil RM20,000 dan barangan lain seperti yang didakwa oleh Chow, tetapi mendakwa hanya RM15,900 dirampas untuk tujuan siasatan berhubung kemungkinan ia keuntungan haram.

Polis juga mengesahkan memotong besi jeriji pintu kedai Chow selepas dia enggan membukanya, dan sedang menyiasat dakwaan bahawa Chow ditampar.

Forgetful Me

Of late, I have this deep fear that I might be suffering from Alzheimer's. Never in my life have I been as forgetful as I have been for the past few months. In fact, I went for a thorough medical check-up the other day and my doctor opined that I am too young to be suffering from Alzheimer's although it appears that I do have some of the Stage 4 symptoms such as listed HERE.

He has recommended 40 mg of gingko supplements daily but the problem is I keep forgetting to take it and when I do take it, I may actually be taking a double dose.

Today, I had the misfortune of forgetting the pin code for my mobile phone. I had to drive to Maxis to reset it. It was quite a hilarious situation. I parked my car by the side of the road while aunt waited there for me. I asked her to call my other hand phone in case I was blocking someone. And guess what?

She asked me for my number and for the life of me, I could not remember that mobile number. :-( So I asked her to give me her number as I had never called her from the other phone.

And she did not know her number either.

:-(

I can understand her situation for she is in her late seventies, much older than I am (see the pic in the post). But I have no excuse at all for not being able to remember my own phone number or pin code. Anyway, I decided to just go for it and came back in a jiffy with my pin code duly reset by the Maxis counter staff.

Before I drove off, my aunt was in a panic state because she could not locate her hand phone which was actually in her handbag. So I had to call that number. We drove happily to her home after she found her phone.

It can be quite a comedy when the three of us are together but it is not too funny when I realize that I am much younger than them but more forgetful.

When I wanted to go home just now, I forgot where I put the car keys and that has happened so often that my cousin has offered to buy some gadget for the keys to help me locate those misplaced keys.

Just yesterday, when I was driving my cousin to the airport to catch his flight to San Francisco, I asked about a mutual friend named A. Two minutes later, I asked about the same friend again :-(.

Two weeks ago, I forgot where I parked the car when I took Mr and Mrs Churchman out for lunch. I have even forgotten to switch on the rice cooker a few times and my poor Nick has had to patiently wait for the rice to cook.

There have been many instances when I bumped into old friends and they remember my name but I can't remember theirs! Sometimes I take a few days to recollect their names. However, I can remember how I knew them and other shared experiences. :-(

I know I have written about this many times and a few readers have also recommended gingko supplements. My doctor said that I should go for a brain scan if my condition deteriorates despite the consumption of gingko supplements. I certainly hope I will not reach that stage.

Having said that, I do admit that blogging has helped me in many ways to stay focused and to concentrate in reading, writing and analyzing data.

Life is so short. Regardless of the many things I forget, I can never forget those who mean a lot to me, who have touched my life in many ways and those who have made a difference in my life.

SHAH ALAM: Rayuan dan semakan kehakiman terhadap dua pekerja ladang yang dihukum penjara selama tujuh tahun kerana melupuskan bahan bukti pembunuhan kejam jutawan kosmetik, Datuk Sosilawati Lawiya akan diketahui pada 21 Februari ini.

Hakim Mahkamah Tinggi di sini, Datuk Wira Mohtarudin Baki menetapkan tarikh tersebut kerana memerlukan masa untuk meneliti hujahan dan nas undang-undang yang dikemukakan oleh pihak yang terlibat dalam permohonan itu.

K. Sarawanan, 20, dan U. Suresh, 27, dihukum penjara tujuh tahun oleh Mahkamah Majistret Telok Datok, Banting, di sini, selepas mengaku salah melupuskan bahan bukti pembunuhan Sosilawati dan tiga individu yang turut hilang bersamanya.

Sosilawi, 47, hilang bersama pegawai bank CIMB cawangan Kampung Baru, Noorisham Mohamad, 38, peguam Ahmad Kamal Abdul Karim, 32, dan pemandu Kamaruddin Shamsuddin, 44, selepas dilaporkan menuju ke Banting untuk berjumpa seorang peguam bagi berbincang urusan jual beli tanah.

Tidak lama selepas itu, peguam N. Pathmanabhan, 42, dan tiga pekerja ladang, T. Thiyalagan, 19, R. Matan, 20, dan R. Khatavarayan, 31, masing-masing mengaku tidak bersalah atas pertuduhan melakukan pembunuhan tersebut.

Pada 15 Oktober lalu, Majistret Hurman Hussain menjatuhkan hukuman penjara terhadap Sarawanan yang mengaku bersalah atas tuduhan membakar mayat mangsa, manakala pengakuan Suresh direkodkan bagi kesalahan membuang abu mayat ke dalam Sungai Panchau.

Sementara itu, pada prosiding Rabu, Timbalan Pendakwa Raya Saiful Edris Zainudin memohon supaya mahkamah mengekalkan hukuman penjara tersebut kerana majistret telah membuat keputusan yang betul dengan mengambil kira fakta dan peruntukan undang-undang.

"Prinsip satu transaksi dan prinsip keseluruhan bukanlah sesuatu yang mutlak apatah lagi di dalam kes ini melibatkan pembunuhan yang kejam terhadap empat individu yang tidak berdosa di mana mereka dibunuh, mayat mereka dibakar sehingga menjadi abu.

"Tertuduh bagi memastikan ketiadaan kesan ke atas perbuatan rakan mereka, telah menghapuskan bukti dengan membuang abu mayat ke dalam Sungai Panchau bagi menggagalkan siasatan polis," katanya. Turut mewakili pihak pendakwaan ialah Timbalan-Timbalan Pendakwa Raya Ishak Mohd Yusoff dan Idham Abd Ghani.

Sementara itu, peguam A. S. Dhaliwal pula menghujahkan agar pengakuan salah tertuduh diketepikan dan tertuduh dianggap sebagai tidak bersalah sehingga kes tersebut dipulangkan semula ke Mahkamah Majistret.

Terdahulu, usaha Dhaliwal untuk membawa Suresh berjumpa dengan pesuruhjaya sumpah selama 10 minit bagi mengingkrarkan afidavit gagal kerana permohonan tersebut ditolak oleh Mohtarudin.

"Saya tidak melihat mengapa afidavit diperlukan kerana Suresh tidak memfailkan rayuan dan hanya terlibat dalam prosiding melalui semakan oleh saya. Saya tidak memerlukan afidavit dalam semakan saya," kata Mohtarudin. -mstar

Police can use "reasonable" force in dispersing an illegal assembly, ruled a sessions court judge when dismissing a civil suit brought by three participants against the Malaysian government, the Royal Malaysian Police and several others for police brutality. It was one of three reasons given by Bandar Baru Bangi Sessions Court judge Mohammed Mokhzani Mokhtar today in the civil suit filed by Kajang municipal councillor Tan Boon Wah, and two brothers, Ho Chee Loong and Ho Chee Hui. The three were seeking damages for alleged police brutality inflicted on them when they participated in a 2007 protest over a barrier built by highway concessionaire Grand Saga Sdn Bhd. Others named in the suit are then-Kajang OCPD ACP Rosli Mohd Nizam, police lance-corporal Azman Atan and several IPD Kajang policemen.

The protest, participated by 40 people, was one of several by Bandar Mahkota Cheras residents against the concessionaire between 2006 and 2008 over a three-foot tall concrete barrier blocking a slip road to their township, and forcing residents to use the highway to enter and exit the area. The road was finally opened in May 2008.

Speaking to the media after the judgment, counsel Lim Lip Eng gave the three grounds for the dismissal of the suit, which saw 12 witnesses after it was first filed on Oct 15, 2007 and closed last November. "The judge ruled that that indeed there was a illegal assembly by the residents, and that the residents who took part in the illegal assembly refused to obey the instructions from authorities, especially the police. "So, as a result, the police had to take necessary action by using reasonable force on them," said Lim, who added that the plaintiffs have one month to appeal. He also pointed out that despite many arrests, criminal charges had yet to be made against any participant in the protests.

Meanwhile, Chee Loong said that despite losing, he felt proud of his actions. "I feel proud as our road is now open. I tell the rakyat that if there is a problem, we must be brave to stand up and claim our rights," he said.

However, Tan, who is also Mahkota Cheras Free Access Road Action Committee president, expressed disappointment with the decision. "We had video evidence showing the two brothers being beaten by a police officer. But the court decided in favour of the government. "I wish to stress that the constitution says Malaysians have fundamental freedoms, and we can have peaceful assemblies," said Tan, adding that they had brought no weapons that day, and the police did not give them time to disperse.

Kijang Sesat Dalam Kawasan Rumah

Aampang: Sukar dipercayai apabila petugas Jabatan Pertahanan Awam (JPAM) menerima panggilan kecemasan mendakwa seekor kijang sesat dengan melanggar bertalu-talu dinding dan pintu rumah seorang penduduk di Taman Tun Abdul Razak, di sini.

Kijang berkenaan yang dipercayai datang dari kawasan hutan berhampiran ditemui dalam keadaan cemas dan berlari-lari di dalam kawasan rumah penduduk kira-kira jam 8 malam kelmarin .

Laporan itu bagaimanapun disahkan benar apabila sepasukan empat anggota Pasukan Jabatan Pertahanan Awam (JPAM) yang tiba di banglo berkenaan dan mendapati seekor kijang berlari.

Ketua Operasinya, Leftenan Muda JPAM Shahrul Kamar Johari, berkata anggota bertugas mengepung kawasan rumah berkenaan bagi menangkap kijang betina itu.

"Kijang berkenaan melanggar pagar rumah dan dinding berkali-kali kerana panik. Ia turut melompat melepasi tembok pagar dua banglo berhampiran sebelum ditangkap seorang anggota JPAM. Usaha menangkap kijang yang cedera itu mengambil masa kira-kira 20 minit.

"Hasil pemeriksaan mendapati haiwan itu cedera di kepala, kaki dan badan selain keletihan akibat tindakannya yang agresif melanggar pintu dan tembok rumah di kawasan itu," katanya.

Beliau berkata, kijang itu dibawa ke ibu pejabat JPAM sebelum perkara berkenaan dimaklumkan kepada Jabatan Perlindungan Hidupan Liar dan Taman Negara (Perhilitan).

"Jabatan Perhilitan diketuai Timbalan Pengarahnya, Celescoriano Razond yang tiba tidak lama kemudian merawat kijang itu sebelum membawanya pulang untuk tindakan lanjut," katanya.

Katanya, penemuan kijang di taman berkenaan kejadian kedua selepas seekor kijang dilaporkan tersesat di kawasan sama pada 2007.

Beliau berkata, haiwan itu dipercayai sesat dari hutan tebal di belakang taman berkenaan yang luasnya hingga ke daerah Hulu Langat.

"Ada kemungkinan haiwan liar itu tersesat dari habitat asal atau dikejar anjing liar hingga menceroboh masuk ke kawasan rumah berkenaan.

"Kijang berkenaan akan diberikan rawatan dan dipindahkan ke Zoo Melaka," katanya. -HM


PRK Merlimau: Strategi Pondan UMNO BN Guna Harta Awam Untuk Kegunaan Parti

Setiausaha jentera pilihanraya PAS di Melaka, Bahiki Ismail kesal dengan sikap Umno/BN yang terus menerus menggunakan kemudahan awam untuk program politik kepartian.

Terbaru, dakwanya kerajaan menyalah-gunakan Dewan Politeknik Merlimau untuk program suaikenal bapa angkat dengan jawatankuasa peti undi DUN Merlimau. Program tersebut melibatkan pengerusi perhubungan Umno Melaka, Datuk Seri Mohd Ali Rustam yang juga adalah ketua menteri.

Program telah berlangsung Isnin lalu dan melibat semua ketua-ketua peti undi di DUN Merlimau.

"Umno/BN sering menuduh PAS berpolitik di masjid dan surau tanpa bukti tetapi sebaliknya merekalah yang sering menggunakan surau, masjid, sekolah dan institusi masyarakat yag lain untuk program politik mereka".

"Kita tidak kisah jika program itu adalah program kerajaan dan agensi-agensinya tetapi yang kita kesalkan ialah mereka secara terang-terang menggunakan harta rakyat yang dibiayai dengan duit rakyat untuk program politik mereka." kata Bahiki (atas, kanan) dalam satu kenyataan.

Justeru, beliau menggesa tindakan menggunakan harta awam untuk program parti dihentikan serta merta kerana ia jelas mengheret institusi awam ke kancah politik.

Bahiki juga mengingatkan semua pengarah, pengetua, guru besar dan pegawai kerajaan supaya tidak tunduk dengan tekanan politik kepartian sehingga membenarkan institusi di bawah tanggungjawab mereka digunakan sewenang-wenangnya oleh Umno/BN untuk program parti.

"Tuan-tuan dan puan-puan diberi amanah untuk menjaga harta dan kemudahan awam janganlah kerana tekanan politik kita sanggup mengabaikan amanah yang dipikul oleh kita.

"Pengunaan harta dan kemudahan awam sudah berlaku dari dulu, kini dan mungkin selamanya namun kita kesal kerana pihak berwajib seperti polis, SPRM, SPR dan sebagainya tidak berani mengambil tindakan walaupun sudah acapkali kita membuat laporan agar tindakan di ambil ke atas pihak terbabit" katanya.

Beliau berharap Umno/BN tidak mengulangi kesilapan itu pada kempen pilihan raya kecil DUN Merlimau kerana ia perbuatan menyalah-gunakan duit rakyat.

"Umno/BN wajar mencontohi PAS yang menjalankan program di premis parti kerana PAS tahu etika dan undang-undang.

"Jika perkara ini berulang, PAS juga sepatutnya dibenarkan untuk mengadakan program di semua institusi awam kerana PAS juga parti berdaftar" kata Bahiki lagi. -mk

Ia menyalahi undang-undang dan sekalipun diketahui nanti SPR akan tidak akan berbuat apa-apa malah membela UMNO/BN, tugas kita membuat aduan dan pendedahan kepada rakyat perlu dilakukan.

Setidak-tidaknya Tuhan Mengetahui kita telah "berusaha" untuk menunjukkan ketempangan perjalanan sistem pilihanraya di negara kita sekian lama. Dan Dia Maha Berkuasa untuk membantu pihak yang teraniaya dan dizalimi.


Kohilan - a MGR in Cairo's ordeal!

He didnt bath for 2 days and was holed up at the Cairo airport with Malaysians and foreigners trying to get out of strife-torn Egypt. What an experience, and what a horrifying ordeal!

I think Deputy Foreign Minister Senator A Kohilan Pillay deserves a 'datukship' for his bravery and good job. Stranded for 2 days at a fully air-conditioned international airport and without shower, makes him a 'hero', dont you think so (here).

With him were PM's sec-pol Datuk Shahlan Ismail dan a few National Security Council officers.

Try to compare his ordeal with this - retiring deputy sec-gen of Ministry of Information Datuk Mohammed Mohd Daud was our trade commissioner to Kuwait in 1990 when the US launched the 'Desert Storm' operation.

He was assigned to lead about 200 Malaysians and Singaporeans to safety. Know what? He managed to take them from Kuwait City to Baghdad in an 18-hour journey filled with obstacles, among which were booby traps, bombs and gunfire.

And he didnt tell Malaysians or the Press about it.

Back in 1982, I was in Iraq, covering the Iran-Iraq war, moving with the UN and Iraqi armies from north border t0wn of Suleimaniyeh to Kirkuk, Khanaqin, Mosul, Karbala and south port of Basrah. Together with Indonesian 'Kompas' editor Petrus Suryadi, we slept in tents or bunker dug beneath army tanks, exposed to extreme cold weather and night and burning hot during the day, no shower for a week and had to survive on limited food and water supply.

I remember the adjacent building of El-Mansour Melia hotel was shelled at 10pm, two hours after we checked-in, killing 9 people and injuring dozens others.

Try talk to former NST senior journalist Ben d'Cunha who joined me in Iraq in 1984. We embarked on a 12-hour midnite train from Baghdad to Basrah, accompanied by 3 Iraqi officers, only to discover on arrival that the train was carrying about 300 corpses!

And that was part of the stories which was not published by our editor then. Why, we went there on our own expenses and at our own accord! (During that era, Malaysians were barred from visiting any Communist country while a trip to Eastern Europe or any Socialist country would be deemed as not appropriate).

Many other Malaysians, especially former students and embassy staffs in Baghdad during the 1980s were subjected to various difficulties. Ask our Ambassador to China Datuk Norulzaman whom I first met in Baghdad in 1982 when he was the Second Secretary to the mission. Ambassador was Nadanarajah.

To our Deputy FM, it was nothing what you had experienced. It was your job, like it or not. If you want to know about real ordeals, talk to our war veterans, including those who used to serve in Congo, Somalia, Lebanon and in other countries.
