Tumbuk Estate is located near the fishing village of Tanjung Sepat. It is a scenic view if one is to drive there, as one would pass by the Morib beach as well as a stretch of mangrove trees. During high tide, the sea water would splash along the road. Beautiful and breathtaking. But this scenic value gets distorted when one goes close enough to see the housing of the plantation workers who lived in Tumbuk Estate along the same road.
Tumbuk estate was at one time owned by Maika Holdings – the investment arm of MIC. One would expect a model estate since MIC is supposed to be the vanguard of the Indians. Yet Tumbuk estate remains pathetic. Except for the school, the houses for the estate workers are in bad shape, they do not have inbuilt toilets, drainage broken and houses depressing. I always wondered why didn't MIC make this their model estate with the best facilities.
Then they could have challenged other plantation companies to do so. The situation is similar when the National Union of Plantation Workers (NUPW) took a case against the Planters MAPA on the question of monthly wages. One of the reason for NUPW to lose the Industrial case against MAPA was that they themselves did not implement monthly wages in the estates which they owned themselves. Therefore it is difficult to champion the plight of the plantation workers if MIC itself is not prepared to do so.
On April 8, 2006, Maika Holdings and NUPW signed an agreement for a housing scheme for the plantation workers. The scheme is to build semi-D houses for 29 remaining families in Ladang Tumbuk. The agreement said that Maika shall commence construction of the houses in April 2008. Workers were also shown several layout plans of the houses to be built. The beautiful agreement had everything in it except it did not have a date of completion for the proposed housing scheme. The houses never got built and workers have remained in their deplorable quarters ever since. Not only were houses not built, MIC too faded from the scene.
In 2010, Maika after several scandals and controversy was taken over by G-Team. G Team under millionaire Gnanalingam had no patience. His task was to sell all assets of Maika Holdings and wind up the company. They told the workers that based on the agreement, there is nothing binding as there is no dateline. They offered the workers RM25,000 each. Take it or leave it and went on to sell pieces of the estate to individuals who were interested to buy. Meanwhile, water was being disrupted to the workers quarters.
At this point of time, the matter did get referred to the Selangor State Government under the excoship of YB Xavier. YB Xavier met two camps of workers and told them to decide which would they prefer – money or housing. This seems to be the offer on the table. Take the money and leave versus the group who wanted the initial agreement fulfilled. The following weeks ended with more in-fighting between these two groups.
It was at this time that PSM was approached. We went in at the time when the local union leaders had already left the estates, when the people were divided into several camps and when they were under pressure from thugs to take the offer and leave.
More than half the workers took the G-Team offer of RM 25,000 and left the estate, leaving behind 12 families who were determined to get housing as the initial agreement stated. Since October 2010, the harassment was building up on the remaining 12 to take the offer. On Nov 21, 2011, water was completely cut off. PSM then went to the ground, organised the workers, lodged several police reports against the threats, highlighted their plight in the media and held a protest outside the labour department.
The labour department then held several meetings. They were not comfortable dealing with the more confrontational PSM and JERIT and wanted the workers to choose NUPW to handle the negotiations. The workers opted for PSM as PSM had been consistent in fighting for them. Meetings in the labour department was tough with both parties shouting and standing by their ground. A combination of street protest, police reports, negotiations as well as legal option in putting a caveat on the land was employed by the workers.
These actions finally restored the water supply and after a few more meetings, the agent dealing on behalf of the new land owners agreed to build houses for the workers. It was a victory of sorts and it took many meetings between PSM representatives and a company dealing with the owners of the land. Though the housing issue was sort of resolved, other matters such as the temple, etc. remained problematic.
The land owners managed to remove the caveat in the land but they had one more bigger obstacle, that is to get the State Government approval to sub-divide the land as the land is more than 100 acres. The land owners were now finding ways to solve the problems and have allocated two acres of the land to relocate the 12 families and the temple.
As the problems from the land owners slowly subsided, a new kind of problems began to prop up. The remaining 12 families started to split into two new groups and more mistrust and unnecessary miniature fights took place. On the one hand, the new owner cannot develop the land unless he solves the workers housing problem. The land owner claims that the workers kept shifting the goal post every time a settlement is in sight.
YB Xavier, the Pakatan Rakyat State exco was firm in his dealings. He said that the Estate Land Board (ELB) approval will not be given unless the housing issues of the 12 remaining workers are resolved. A field visit by Xavier further shocked him. He could not understand how come the houses are in such a bad shape and had agreed to top up and do up the houses. He agreed to put State Government money in making built-in toilets, doing up the drainage, etc. Xavier said that the State Government will make the houses in a liveable and humane condition.
PSM worked hard to work out a proper settlement so that the remaining workers future will be protected and they will not go into a limbo like the previous agreement. After a few more meetings with the Land Owners, lawyers, etc. finally an agreement was reached and the signing took place on March 26, 2013 at the Ladang Tumbuk school.
With this agreement, 12 workers will get a free 2,600sf piece of land, eight of them who participated in the earlier scheme and who have contributed were paid a further RM25,000 each as well as will be given a renovated unit of their current houses. The temple will also be given 5,000 square feet of land free and a compensation of RM 40,000.
At the signing in ceremon,y many workers were relieved that their issue is finally settled.
Besides the involvement of the State Government, many other people also played their part in solving the issue such as representatives from JERIT, legal advisers for the workers, K Arumugam and Pasupathi, the company dealing with the owner Tamil Selvam and Vannir Selvam. The workers put their signature on 21 copies of the agreement. It is hoped that this agreement will not end up like the previous one.
It was a relief that the agreement has finally been signed in spite of the many internal conflict. Estate workers cannot go on fighting for housing every time an estate goes for development. There must be legislation protecting them. We are lucky in Selangor that the State Exco refused to approve unless housing rights for the workers are given.
Similarly the estate workers future cannot be left in the hands of the State Exco perse but needs to be protected by a legislation.
Najib's father Tun Razak started the Workers House Ownership Scheme but less than 5% of plantation implemented this. Today Sime Darby which is owned by the Government is the biggest plantation company, yet when it comes to building houses for their workers, they just end of being stingy as the game of profits and returns rules their decision. They forget about the workers who put them there. From ruins to settlement. This is the tale of Ladang Tumbuk. Soon the work to restore the houses is being done. The scenic view along this sea side village can only get better.

Investigations, Accountability Needed to Deter Future Attacks
April 1, 2013
(Bangkok) – The Burmese government should thoroughly investigate and hold accountable those who incited and committed deadly violence in Meiktila in central Burma from March 20 to 22, 2013. Decisive government action to combat impunity, end discrimination, and promote tolerance among religious groups is needed to end the tide of attacks against Muslim communities.
"The government should investigate responsibility for the violence in Meiktila and the failure of the police to stop wanton killings and the burning of entire neighborhoods," said Brad Adams, Asia director. "Burma's government should have learned the lessons of recent sectarian clashes in Arakan State and moved quickly to bolster the capacity of the police to contain violence and protect lives and property."
Meiktila (Main Damage Area 1)
Meiktila (Main Damage Area 2)
According to a needs assessment released by the United Nations Office for the Coordination of HumanitarianAffairs (OCHA), over 12,000 people were displaced by the violence in Meiktila and are in shelters around the town.
Burma's 2008 Constitution contains provisions that ensure religious freedom and states that the government should "assist and protect the religions it recognizes to its utmost." President Thein Sein's office on March 28 called for "earnest effort[s] to control and address all forms of violence including instigations that lead to racial and religious tensions in the interest of the people in accord with the Constitution and existing laws."
Such efforts need to be accompanied by strong measures, including holding those who planned, organized, and carried out the recent violence accountable, irrespective of the person's position or the community from which they originate. The government should also make it clear that it will not tolerate incitement to violence, especially by clergy or others in positions of authority.
The government should also take urgent steps to ensure that the police respond impartially to violence. During the violence in Arakan State in June and October, police frequently sided with the majority Buddhist community against the minority Rohingya Muslim population. Frequently the police did nothing to stop the violence against Muslims and in many cases joined with Buddhist mobs to attack predominantly Muslim villages.
"Burma's government and political, religious, and community leaders should demand an end to the hate speech that has fuelled violence and discrimination against communities in Burma's fragile multicultural society," Adams said. "Decisive government action according to the rule of law is critically important to deter extremists and anyone else using violence to further economic, religious, and political agendas."

DATELINE PETALING JAYA:
RECENTLY IT WAS REPORTED THAT THE KLUANG MUNICIPALITY (MPK) had strangled a stray dog to death whilst their dogcatchers were trying to nab the canine.
We in PETPOSITIVE still do not know what exactly happened at the event. It was alleged by animal lovers that the council has been making it a practice to kill other strays in such a way.

Why do senior politicians relish getting limelight and attention for all the wrong reasons? As the nation progresses, mentality of some regresses in tandem with their memory or selective memory. Suffice to say politics in Malaysia has degenerated to childishness as leaders frolick in childish bickering.
Consider the following articles by various online news portals::
LKS: Born 1941, Age 72+ Joined the political scene in 1966. After 47 years in politics, a long and much deserved rest is needed.
TDM: Born 1925, Age 88+ Joined the political scene in 1964. After 53 years in politics, he should enjoy his sunset years with his family, horses and favourite pursuits.
Verdict: Let young blood contest.
2. TCY vs LGE
Why is there so much publicity and media coverage for this supposed 'battle'?
Why are both imposing conditions on the other?
The debate about who will be CM back in the pre-2008 election period caused much collateral damage to Gerakan.
Both leaders should just think of how to serve the rakyat better instead of indulging in such trivial pursuits.
Just two questions:
a. Why do some politicians have this sudden urge to switch constituencies?
Running away from potential failure due or the possibility of being kicked out because they have not served their constituents efectively and faithfully?
Treating the elections as some kind of lottery so they place their bets oops I mean they contest in places where they perceive they have a better chance of winning?
b. Is there some kind of communication breakdown? Should there not be open and transparent discussion and consultation between component parties be carried out before major decision are made?
etc etc etc
Ladies and gentlemen, what we are witnessing is none other than the infantilization of politics.
We see leaders taunting each other to do this and/or that or contest here or there. Before our eyes, key relationships are soured via irrational decision making and guess what? Along the way, the next government is supposed to be elected.
Hmm....not a comforting thought at all, is it?
Now what do politicians from both sides of the divide love to do?
1. Instead of doing good, honest service for those who elected them to office, are some thriving in cattle excrement by reinventing themselves or their party and then polishing up so that it can be repackaged to the electorate as many grades above the pile of community sanitary output than it already is.
Doesn't it amaze you how both sides are promising almost the same thing and dangling carrots in front of our noses?
Instead of all this, don't you wish that we have a bull-shit free competing turf where only the best step forward to offer themselves for service?
Wait a minute....is that possible? Can that ever happen?
Would we be better off without all that politicking?
Have we had ebough of the empty and superfluous platitudes, fake plastic smiles, spider web-thin intra-party ties between leaders and the hastily applied plastic surgery manouveres to make it seem as though all are trying to thrive in unity?
What an insult to our intelligence!
OK. Let's get down to basics.
Remove the charisma, the smiles, the friendly but fake overtures, the empty promises and riding on past glories or that of others or the previous party glories and hey presto - what do we have? Groomed, elegant and gentlemanly brainy, tech savy politicians or kiddoes throwing temper tantrums that their preferences have not been considered.
Can you stomach it? I can't. That is why I am in overdrive in verbal diarrhoea ranting here today after a loooong period of self-imposed silence with all the madness raging around!
So what do many do? Indulge in feel good slogans, give freebies, pressies and consider how we can see a little bit of b.s. here and there...until oh heck - we realize that yea baby - our system is full of b.s.
No wonder Kee Thuan Chye has written two books on this!
Both sides seem convinced that if the other side takes over, there will be chaos. Greg Rudd says that politics is a childish farce which is worsening. He argues HERE that strategic planning is being sacrificed in the name of political expediency.He argues:
"I'm convinced that 95 per cent of people are unhappy with the outcomes of our political process at the moment. Everyone bitches about it but what I'm convinced of is that left to themselves political parties won't change a thing because it's not in their interest.
"My view is that, is that one thing politicians do listen to is public sentiment. If it starts to ramp up and they listen to the public and they listen to the media…
Rudd says that the public needs to put pressure on both sides of government in the lead up to the next election to agree on some core, bipartisan issues which can be advanced in the nation's interest.
The ball, it seems, is in your court. CLICK HERE to read his views.
In closing, allowing me to quote Catherine Mayer:
Democracy is an exercise in adulthood.
We don't want our elected leaders to style themselves, as despots so often do, the fathers of our nations, but we assume them to be responsible grown-ups, focused on carrying out the mandates we have granted them. It's a nice idea.
Unfortunately the more we find out about our political masters—and in this twittery, wittering, wikileaking world, scarcely a day goes by without a politician being exposed or exposing himself—the more we are forced to confront the unpalatable truth. Our politicians really do represent us—in all our fallibility.
And while most official histories are narratives of great men (and more occasionally great women) making big decisions, the real histories look rather different. Principle plays a part but so does spite.
Childish feuding is a potent force in public life. Read more here.
Childish feuding? How true.
We, dear Malaysians, are witnessing the infantilization of politics right before our very eyes.
My apologies for flooding my blog with four written posts on socio-politcal issues today. I have bottled up my anger and frustration for over a year and it has truly been a very cathartic experience to rant. I stopped writing on such issues on Jan 2nd, 2012. This time, I am taking a firm people-centred centrist view.
No offense meant. I love my country and my state and as it is, I am very concerned because of what I can see happening before me and I am sure you are too. Please leave a comment to share your responses. Thanks.

The DAP has unveiled a 14-point plan, billed the 'Gelang Patah Declaration', that is aimed at alleviating the socio-economic status of Indian Malaysians, a demographic whose vote is considered critical to the ruling BN's desire to retain power in the face of a determined attempt by the opposition Pakatan Rakyat to eject them.
The plan was announced in Johor Bahru yesterday on the heels of an often acrimonious debate between the more assertive activists of the minority community and opposition parties accused of slighting the dire needs of the Indian poor by subsuming them under the rubric of a general alleviation of the Malaysian poor.
The DAP's 14-point plan is integral to the Pakatan plan to ease the Indian plight, such as resolution of the problem of stateless within 100 days of a Pakatan takeover, but in some aspects it accentuates some features while adding newfangled ones for good measure:
1. To resolve the problem of the stateless Indians within 100 days of a Pakatan administration;
2 To establish a National Housing Board which will build decent and affordable housing for marginalised groups, especially for displaced Indian plantation workers;
3. To ensure that all national-type Tamil schools become fully-funded and the infrastructure of every single school is up to par with 'sekolah kebangsaan' (national schools);
4. To invest in technical and vocational training coupled with apprenticeship programmes to provide an alternative education and career path for school dropouts from low-income Indian families;
5. To provide jobs and raise the wages of low-income Indians by implementing a-RM1,100 minimum wage scheme;
6. To increase the number of Indians in GLCs (government-linked companies), local councils, and public services;
7. To alienate land for existing Hindu temples and burial grounds and find replacement land for temples and burial grounds which have to be relocated;
8. To provide microcredit and other financial assistance schemes to Indian small businesses, with a special focus on women, youths and home-based business;
9. To put in place the Independent Police Complaints and Misconduct Commission (IPCMC) and to eliminate deaths in police custody and custodial deaths;
10. To establish a special fund to promote Indian equity ownership in the country;
11. To establish a commission to address urban poverty and social problems faced by the Indian community;
12. To establish policies that could economically enable single mothers, including house ownership scheme;
13. To establish or enroll in existing residential schools outstanding Indian students from plantation and urban poor families;
14. To abolish all anti-rakyat legislation and to get rid of discrimination.
The 14-point plan was announced to a DAP gathering at a hotel in Gelang Patah that was attended by party adviser Lim Kit Siang and senior Indian leaders led by M Kulasegaran, the Ipoh Barat MP. Others who attended were DAP MPs Charles Santiago, M Manogaran and state assemblyperson S Sivanesan.
Kulasegaran said the 14-point plan represents the commitment of the opposition to find a permanent solution to the problems faced by the Indian community.
"What the BN has done in the last four years under Prime Minister Najib Razak was to woo Indian voters with action that is ad hoc and not aimed at the deeper ailments of the community," asserted the DAP national vice-chairperson.
"Indian problems need fixes that are deeper and permanent than band-aids," remarked Kulasegaran. "Our 14-point plan, if implemented, would root out Indian poverty root and branch," he opined. Malaysiakini

This is Part 3 of my Monay rant on the deplorable state of affairs in education.
Thanks to Encik Kassim who sent me the following post on The COW AND THE ICE CREAM which is possibly one of the best theories as to how change might not happen if voters do not think carefully about the bigger picture when they go to the polls. Apparently, this was sent to him by a teacher. I have edited it a bit...
"We are worried about 'the cow' when it is all about the 'Ice Cream.'
The most eye-opening civics lesson I ever had was while teaching year 3 students.
The last Parliamentary election was heating up and some of the children showed an interest.
I decided we would have an election for a class captain.
We would choose our nominees. They would make a campaign speech and the class would vote. To simplify the process, candidates were nominated by other class members.
We discussed what kinds of characteristics these students should have. We got many nominations and from those, Mat and Salleh were picked to run for the top spot.
The class had done a great job in their selections. Both candidates were good kids.
I thought Mat might have an advantage because he got lots of parental support.
I had never seen Salleh's parents.
The day arrived when they were to make their speeches.
Mat went first.
He had specific ideas about how to make our class a better place. He ended by promising to do his very best.
Everyone applauded and he sat down.
Now is was Salleh's turn to speak.
His speech was concise.
He said, "If you will vote for me, I will give you ice cream."
He sat down.
The class went wild. "Yes! Yes! We want ice cream."
He surely would say more. He did not have to.
A discussion followed.
How did he plan to pay for the ice cream?
He wasn't sure.
But no one pursued that question. They took him at his word. (which is exactly what is happening in our own backyard because many don't bother to think, question, analyze or to challenge.)
Would his parents buy it or would the class pay for it...He didn't know.
The class really didn't care.
All they were thinking about was ice cream...
Mat was forgotten. Salleh won by a landslide.
Every time leaders opened their mouth they offered ice cream and many Malaysian voters reacted like nine year old's.
They wanted ice cream.
The rest of the voters knew they were going to have to feed the cow and clean up the mess."
Leaders from BOTH sides have promised us different types of ice-cream except one side has access to more $$$ than the other. So if people do not think and vote only based on their responses to offers, what will happen to Malaysia?
Remember, the government cannot give anything to anyone that they have not first taken away from someone else.
How many of us will be voting for the ice cream?
That my friend, is how labour got elected last time! I hope not many!
In the past, they comprised hose who wanted everything free or preferred to be free riders as and when it suited them.
Let's hope it doesn't happen again

There was a time I could at least fool a minimum of 10 people before lunch on April 1st but not anymore. It's 3pm and I haven't fooled even one poor soul right up to this moment.
Sigh. April Fool's day has become so well known that everyone is prepared for it weeks in advance. Now even if I tell someone a true story they'll just go,
'Wei, you think I so stupid, ha? It's the 1st of April la!'
I guess even telling them I'm going to give them a brand new guitar that they can collect free of charge at the baritone guitar guitar center simply will not fool anyone. But if you're still gullible enough, give me a buzz and I'll send you GPS coordinates to collect your guitar ... hahaha!

In my earlier post, I was lamenting how the dire state of education in our land has caused us to lose international competitiveness in our effort to develop the nation and ourselves. Not only that, many have lost the ability to think because it is too tiring, too tedious, inconvenient and confusing hence there is the tendency to subject ourselves to balderdash and moronic claims, promises, accusations etc. We have been deprived of capable leadership that can steer the country in the right direction.
Just the other day, my husband was driving us to the vet for my dog's vaccination. Along the way, he received a SMS and requested me to read it to him. I opened the message and to my horror, I read:
hello! i am miss thee....
I thought to myself - oh wow! He has an admirer who is trying to use Shakespearean English???? What the...????
Maintaining my composure, I read on....and it was actually:
hello! i am miss thee. mr teh asked me 2 call u @ ****** which he etc etc
So the message was actually:
Hello! I am Miss Thee. Mr. Teh asked me to call you about etc etc etc!!!
Considering the current state of eduation, don't be surprised if one day, not too far in the future, employers receive such CVs from job applicants.

To further illustrate, take a look at this paragraph written by an Upper Six student from a premier school in Penang whom I was helping for eight times.. I told her guardian that I cannot help her any more because she does not want to help herself. Mind you, this was her third attempt to answer a very simple question where she was required to give her opinion of materialism.
Note: She misspelled materialism with a double 'l' and apart from other mechanical errors such as tenses and sentence structure, wrote import instead of important and Ipohe instead of iPhone and only corrected it when I pointed it out to her after asking her to check this page for three consecutive times because she just could not see the errors. There are more errors than what I marked in red.
Quo vadis, Malaysia?
May God help and bless our nation and deliver us from egomaniacal leaders, mercenary characters and self-serving miscreants disguised as Samaritans.
May our education system be revamped to empower our nation to soar ahead again.
I am really fed up of seeing nonsensical work from many students across the board. Seriously, I am going to devote a few hours each week to compile the Little Book of English Horrors to document all the evidence I have collected through the years, especially in the 21st century.
Please leave a comment to share your views.
This is Part 2 of my post on Education and Selection Process Determine Quality of Leadership.
Part 3 will be posted at 3.30p.m. today. Please swing by later. Thanks!
