Touching the heart of Malaysian Race Relations

A Malaysian politician dares to speak truth to power  
In one of the most important political speeches delivered in Malaysia in recent years, former de-facto law minister Zaid Ibrahim touched on the heart of race relations when he gave a rendition on the evolving racial politics in Malaysia that has so bedevilled the nation for the past few decades.
Delivering a speech titled "Malaysia – a lost democracy?" at the Law Asia conference in Kuala Lumpur a few years ago, Zaid recounted how "a shining example of a working democracy" founded half a century ago on the principles of democracy and egalitarianism has degenerated into an authoritarian racist state that is now characterized by incessant racial and religious dissension and economic malaise.
When the country achieved independence in 1957, then Malaya was a model of parliamentary democracy, governed under a written constitution "that accorded full respect and dignity for each and every Malayan."  If at all there was a social contract – which should mean the pre-independence consensus reached among the founding fathers representing the various communities – it must be one "that guaranteed equality and the rule of law," as subsequently reflected in the federal constitution.
The racial riots in 1969 changed the balance of political power, and the United Malays National Organisation, through the enlarged coalition of Barisan Nasional, eventually assumed absolute control of the country.  With its coalition partners unable to put up any resistance, UMNO became increasingly racist and the master affirmative action plan known as the New Economic Policy (NEP), which was intended to eliminate poverty and redress economic imbalance, became synonymous with Malay privileges.  By the 1980s, UMNO's supremacist ideology became entrenched and found expression in "Ketuanan Melayu" (Malay supremacy) and it was then that the term "social contract" started to be flashed around to justify its racist conduct.
In parallel with the growth of racism was the steep rise in authoritarianism through amendments to the constitution and tightening a host of repressive laws.  The rule of law became so subverted that democracy in Malaysia became history.

Ketuanan Melayu
Zaid said: "the Ketuanan Melayu model has failed."  This is because "it has resulted in waste of crucial resources, energy and time and has distracted from the real issues confronting the country." 

Citing the rise of Muhkriz Mahahir (who considered judicial reforms threats to Malays) as a sign of UMNO leaning to the right, he said such trend would mean "more inefficiency, more corruption and a more authoritarian style of government."  He further said; "We are a deeply divided nation, adrift for our having abandoned democratic traditions and the rule of law in favour of a political ideology that serves no one save those who rule."

To cope with globalization, Zaid calls for Malays to discard Ketuanan Melayu and re-embrace democracy and the rule of law to spur an economic renaissance of reviving innovation and creativity through co-operation and competition.

Predictably, UMNO's reaction to Zaid's speech was a chorus of abusive language from its leaders, ranging from "traitor to his race" to "apologize and repent, or get out of rumpun Melayu (Malay group)".  And characteristically, none of these vocal critics engaged Zaid on any substance of his wide-ranging speech, which also touched on religion, judiciary, the economy etc., true to UMNO's traditional role as a bully good at telling people to shut up but unable to articulate why.

UMNO has not only told Zaid to shut up, but his speech has also been largely blacked out by the local press, which is another manifestation of how tightly the press has been controlled to shield the incumbent power from any unfavourable exposure. 

That UMNO has not the slightest intention to carry out any reform that may alter the status quo of entrenched racism and corruption is evident not only from its angry rejection of Zaid Ibrahim's speech, but also from the thumping support given to party ultras in the current round of nominations for leadership post for the coming party election, signaling a resurgence of the Mahathirist type of rule, and needless to say, more Ketuanan.  BN component parties, which cherished false hope of political survival through a reformed UMNO, would therefore be well advised to take note of this development.

Racial Equality
UMNO's rejection aside, this Zaid speech must be studied by all Malaysians, for it touches the bottom line of race relations, which have given us so much heartache and headache in the past and yet still proved to be elusive for a proper solution even to this day.

At the heart of the issue is racial equality.  This may be a non-issue in most countries in the world, where racial equality is taken for granted, but not in Malaysia.  Due to historical factors, and due to the intertwining of race and religion and economic disparity among the races, racial equality is a sensitive subject in Malaysia.

Suffice it to say that all races recognized the need for some kind of affirmative action in favor of the Malays and the natives of Sabah and Sarawak as they were conspicuously lagging in the educational and economic field at the earlier stage of our nationhood, hence the birth of NEP.

However, the problem arose when UMNO/BN became too powerful and ruled without any checks and balances.  That bred unbridled racism and corruption in UMNO, and the NEP, in addition to being used to uplift educational and economic level of Malays, was hijacked to enrich party leaders and cronies, who used it abundantly as master key to open up all kinds of channels to state wealth.  As UMNO's hegemony grew, and through mass indoctrination, many had come to regard NEP privileges as birth rights of Malays, though this belief is fallacious. 

The line between constitutional rights and the privileges derived from a political agenda such as the NEP has thus become blurred and indistinguishable.  It has deteriorated to the point that even a cabinet minister (Amirsham Aziz) was unable to answer a question from Lim Kit Siang in Parliament on Oct 29 as to whether the NEP could be equated with Article 153 of the Constitution, which provides for the special position of Malays and natives of Sabah and Sarawak.  The answer is: no.

It might be thus asked: is there racial equality under our constitution?  The answer is yes, as this is clearly and unambiguously guaranteed under Article 8 and other articles of the Constitution.  The existence of Article 153 does not detract from this guarantee.  The racial privileges granted under Article 153 are limited to the provision of quotas.  And these quotas, which fall in the fields of public service, education and commerce are meant as protective measures, and are to be applied to the extent deemed necessary and reasonable by the Yang di-Pertuan Agong.  One must also understand that Article 153 mandates the Agong to safeguard not only the special position of Malays and natives of Sabah and Sarawak, but also the legitimate interests of other communities. 

It will be seen from a study of our constitution that many racial privileges and racial discriminations couched under the umbrella of NEP that have been implemented by BN, particularly those accorded to party leaders and cronies, are extra-constitutional. 

Then, should Malays worry when NEP is removed as suggested by the oppositionPakatan Rakyat coalition?  Certainly not, affirmative action programs will continue to be implemented, except that these are need-based instead of race-based, which should engender more equitable distribution, promote justice, enhance national unity and eliminate abuses.  The anticipated result of this policy should see ordinary Malays enjoying more benefits as the money that would otherwise have been leaked through massive corruption and cronyism could be redirected to the needy.

To UMNO's recalcitrant leaders who are hell-bent to cling on to this racial supremacist ideology for their personal political survival, they should realise that such racial ideology has already become extinct since South Africa abandoned its apartheid policy two decades ago.  It has no place in this globalised world.  It is an affront to universal values, besides conflicting with fundamental values of all religions including Islam.  Finally, it is detrimental to common Malays for whose interests these leaders have professed to champion, as continued racial hegemony will require increased repression which in turn will cause more political unrest and further economic retardation.  In such a downward spiral, no community will be spared.

Mantan anggota Parti Kebebasan, berhaluan kanan dan berfahaman anti-Islam di Belanda, Arnoud van Doorn, telah mengejutkan banyak pihak dengan pengumumannya memeluk Islam baru-baru ini.

Van Doorn yang juga merupakan rakan karib kepada pemimpin parti itu, Geert Wilders, sebelum ini pernah mengakui dia telah keluar daripada parti tersebut pada penghujung 2011.

Menurutnya, dia mahu melakukan perubahan dengan mewarwarkan keputusannya kepada dunia melalui pengucapan kalimah Syahadah yang dimuatnaik di laman Twitter miliknya.

"Tiada tuhan melainkan Allah dan Nabi Muhammad pesuruh Allah," katanya dalam laman sosial tersebut.

Van Doorn juga mengumumkan dalam bahasa Belanda bahawa dia ketika ini 'memulakan kehidupan baharu sebagai seorang Islam.'

Dalam wawancaranya bersama, van Doorn mengesahkan berita mengenai tindakannya itu.

"Sesiapa yang kenal saya secara dekat boleh membuat terkaan terhadap keputusan saya. Lebih setahun saya menperdalami Islam melalui buku dan ceramah.

"Ramai yang terkejut dengan keputusan ini, terutama mereka yang tahu mengenai pendirian anti-Islam saya," katanya.

Menurutnya, keputusan itu dibuat selepas dia menperdalami Islam tanpa paksaan.

The Nation, the Party or the Individual - Who Reigns?

I am still very surprised at the turn of events on nomination day. At a time when unity is needed to attain the mission and vision of a better Malaysia, it is certainly very worrying to see the emergence of independent candidates from both sides of the divide. In 2008, there were 115 candidates but this time round, 270 independent candidates filed their papers yesterday. That is an increase of 134%!

To date, these include:

1. Jenice Lee (DAP) incumbent Teratai state assemblyman who was sacked by the DAP disciplinary board for fielding as an independent. She has been given 14 days to make an appeal.

2. MP Sim Tong Him, who is contesting for the parliamentary seat in Kota Melaka under the DAP banner, was sacked for fielding himself as an independent in the Kota Laksamana state seat.

3. Former Agriculture and Agro-based Industries deputy minister Datuk Seri Mohd Shariff Omar has been sacked from UMNO for contesting as an independent in the Tasek Gelugor parliamentary seat in Penang.  He is also contesting as a Pakatan-friendly independent in Tasek Gelugor and also the Sungai Dua state seat.

4.Fadzil Hanafi who submitted his nomination papers to stand as an independent candidate for the Alor Mengkudu state seat in Kedah has been sacked by Umno for breaching party discipline.

5. Barisan Nasional candidate for the Pasir Mas parliamentary seat Che Johan Che Pa did not to submit his nomination papers in Kelantan, paving way for a straight fight between Perkasa president Datuk Ibrahim Ali and Nik Aziz's son, Nik Abduh Nik Abdul Aziz.

6.Tapah PKR chief Ridzuan Bani has entered the race as an independent candidate. He said his supporters and party members – not him – were unhappy with the leadership's chosen candidate, K. Vasantha Kumar.

7. Umno Wanita deputy chairman Datuk Kamilia Ibrahim also joined the fray as an independent. She has since announced she was resigning from Umno.

8. There will be a six-cornered fight for the Machang Bubuk state seat in Penang between

  • Gerakan's Tan Lok Heah
  • PKR Lee Khai Loon
  • Kita "Datuk" Dr Vicky Vikneswaran
  • Datuk Tan Hock Leong
  • Wan Balkis Wan Abdullah
  • Ooi Suan Hoe.
According to Dr Bridget Welsh, 39.2 percent of the parliamentary seats and 35.8 percent of the state seats have an independent or smaller party from outside of the two coalitions running. Hence, it is clear that the following patterns have emerged:

1. As individuals break out to stand independently, more dirty linen is being washed publicly.

2. The selection process/criteria in certain cases seem suspect.

3. Some leaders are not listening to members and would rather think of the collective good of the party than that of individual members.

4. Pandora's box has been opened as such developments have revealed how in some cases, there is alleged party mismanagement, weak party discipline as evidenced by the reluctance to abide by decisions of the leadership concerned, resentment stemming from unresolved internal party-infighting.

5. For sure, it raises the question of the quality and calibre of party leadership, members and also candidates, not forgetting their perspectives and priorities.

With such an uproar across the board, it is timely that leaders of all parties reveal their selection criteria for citizens to have confidence in the candidates offered. There has to be obedience, discipline, respect and open communication so that conflicts can be resolved privately, not publicly.

Naturally, it is expected that each party would have its own internal rules and procedures.Ideally, candidates are recommended by leaders/members Nomination is the legal process by which election authorities and then the selection committee/board would consider, approve/reject the candidacy application and submit the names/papers on nomination day.

The opportunity to represent a party in an election is not a birthright or membership right but is an honour bestowed by the party's leadership after the relevant procedures have been followed.

Obviously, we cannot have every member standing for election so it is imperative that there are open processes to assess a candidate's experience, character, service record, talent, strengths and weaknesses, suitability, grass root support etc over a period of time to ascertain that only the best are selected.

Of course there is the other consideration of the state and then national levels for both state and parliamentary seats.

To me, the most important aspect for an incumbent would be his/her service/track record that the relevant quarters can use as a base for assessment, not forgetting the candidate's eligibility whereby they must consider's character and to check if there are any questionable issues of ethics, honesty etc.

Through it all, conflict resolution must be undertaken with respect to observe and maintain party unity. There must be ethical rules and regulations put in place and also avenues for open debate with regards to the final selection. Assuming that these are in place in all parties, why did these individuals choose to go solo?

Is this a healthy trend for the nation?

Where does one draw the balance? Promoting the nation, the party or the self?

At the same time, we do see unhealthy patterns and tension surfacing between PKR and PAS allies over a few seats.

1. Sungei Acheh state seat
a. Penang PAS selected its Youth chief Mohd Yusni Mat Piah to stand for the Sungei Acheh seat. PAS claimed it was originally a PAS seat that was "loaned" to PKR in the 2008 polls.
b. PKR is fielding Badrul Hisham Shaharin or Chegu Bard for the Sungai Acheh state seat despite
c. The incumbent assemblyman Datuk Mahmud Zakaria from Barisan.

Why must selfishness rear its ugly head here? Surely the coalition would have discussed seat allocation years ago! Then why this three-way fight when it should ideally be only two?

2. Labuan
a. PKR is fielding Tan Sri Ibrahim Menudin
b. PAS candidate is Hadnan Mohamad
c. Umno fresh face candidate here is  Rosman Isli.

3. Terengganu
PAS is fielding three candidates in state seats which were originally meant to be a straight fight between ally PKR and Barisan.
a. Kota Putera
PAS - Adam Mat Said
PKR - Mohamad Abdul Ghani Ibrahim
BN - Mohd Mahdi Musa

b. Bukit Besi
PAS - Roslan Ismail
PKR - Mohd Shamsul Mat Amin
BN -Roslee Daud.

c. Seberang Pakir state seat
PAS - Zakaria Dagang
BN - incumbent Datuk Ahmad Razif Abdul Razak
PKR -  Ahmad Nazri Mohd Yusof.

All these seats were previously won by Barisan candidates.

While many activists and politically conscious Malaysians are campaigning rigourously with the slogans, taglines via social media and paraphernalia for a better nation, at the end of the day, which is the most important factor in the equation - the nation (rakyat), the party or the individual? Have they forgotten that it is the rakyat who is the boss?

Is this political maturity and intelligent strategy at its best or political lunacy? Whither Malaysia if budding leaders worship selfishness?

OIC Urges UN Action on Burma Muslims

JEDDAH – Appealing for UN intervention to stop attacks on Muslims in Burma, a world Muslim body has urged the Burmese government to allow in a ministerial delegation to discuss anti-Muslim violence in the Buddhist country.

The Organization of Islamic Cooperation calls on "Burmese authorities to strongly respond to the organization's appeal and allow a ministerial OIC delegation to visit" Burma, the OIC said in a statement cited by Agence France-Presse (AFP).

More than 43 people were killed and several mosques burnt in a week of sectarian violence in the central city of Meiktila earlier this month.

The anti-Muslim violence started by an argument between a Buddhist couple and gold shop owners and later spread to several towns in central Burma.

Monks were blamed for inciting hatred against Muslims by preaching a so-called "969 movement" which represents a radical form of anti-Islamic nationalism that urges Buddhists to boycott Muslim-run shops and services.

The violence followed attacks on Bengali-ethnic Muslims, known as Rohingya, in a deadly bout of sectarian clashes in western Burma.

"Such violence is a clear indication of the government's negative approach in dealing with ethnic and religious tensions that erupted last summer," OIC Secretary General Ekmeleddin Ihsanoglu said in his speech at an emergency meeting of the OIC Contact Group on Sunday, April 14.

The OIC chief criticized the refusal of the Burmese government to allow an OIC delegation to visit Burma to check on reports of anti-Muslim violence.

"Despite our attempts to establish communication with the authorities in Myanmar (Burma) by selecting a prominent figure from a neighboring country to visit Myanmar and open discussions with officials, the government was not responsive."

Formed in September, the Contact Group includes 11 of the OIC's 57 members — Afghanistan, Saudi Arabia, Bangladesh, Brunei, Djibouti, Egypt, United Arab Emirates, Indonesia, Malaysia, Sudan and Turkey.

In October, the OIC tried to open an office in Burma to help Muslims there, but the move was blocked by President Thein Sein following massive protests by Buddhist monks.

UN Intervention

The world Muslim body has also appealed to the United Nations to intervene to stop attacks against Muslims in Burma.

"Security Council must protect rights and lives of Rohingya Muslims," Ihsanoglu told the meeting.

He told Saudi Gazette that the OIC will ask the UN Human Rights Council to send fact-finding mission to investigate all human rights violations in Burma.

Wakar Uddin, Director-General of Arakan Rohingya Union (ARU), called for Muslim support to stop attacks against Burmese Muslims.

"This is no longer a Rohingya issue," Uddin said.

"It's becoming an Islamic issue because the radical elements in Myanmar are trying to eliminate Islam from the country."

Burma's Muslims — largely of Indian, Chinese and Bangladeshi descent — account for an estimated four percent of the roughly 60 million population.

Muslims entered Burma en masse for the first time as indentured laborers from the Indian subcontinent during British colonial rule, which ended in 1948.

But despite their long history, they have never fully been integrated into the country.

Ramai Calon Bertembung Di Pasar Pagi Untuk Temu Rakyat

Kedua-dua orang calon bagi N27 Merlimau hari ini secara kebetulan tersemperak di Pasar Tani Merlimau.

Kedua-dua calon berkenaan, Hj Yuhaizad Abdullah (PAS) dan Roslan Ahmad (BN) bertembung di kawasan pasar tani di Bandar Baru Merlimau apabila masing-masing menjalankan program kempen untuk merapatkan diri dan bermesra dengan masyarakat setempat yang hadir di pasar berkenaan pagi tadi.

Sebenarnya ini adalah kali kedua Hj Yuhaizad dan Roslan bertemu di dalam pilihanraya. Kali pertama ialah semasa pilihanraya kecil pada 6 Mac 2011 ekoran kematian wakil rakyatnya, Datuk Mohamad Hidhir Abu Hasan dari UMNO.

BN berjaya mengalahkan PAS di dalam PRK tersebut.

Semasa PRK tersebut berlaku juga beberapa "pertembungan" seperti gambar yang dirakam di atas. Namun yang paling diingati ialah apabila kedua-dua calon menghadiri majlis kematian dan memikul keranda jenazah Allahyarham Ali Basha secara bersama-sama.

Calon DAP, BN, bertembung di Pasar Awam Juru

Para peniaga dan pengunjung di Pasar Awam Perkampungan Juru di sini menjadi teruja apabila melihat para calon Barisan Nasional (BN) dan DAP berkunjung ke pasar itu hari ini.

Mereka terdiri daripada Pengerusi BN Negeri Teng Chang Yeow yang akan bertanding di kawasan Dewan Undangan Negeri (Dun) Bukit Tengah dan calon bagi kerusi Parlimen Batu Kawan, N. Gobalakrishnan.

Bagi pihak pembangkang, mereka terdiri daripada calon kawasan Parlimen Batu Kawan, P. Kasthuriraani, Dun Bukit Tengah, Ooi Chin Wen dan calon Dun Perai, P. Ramasamy.

Kehadiran mereka sebagai sebahagian program kempen dan suai kenal dengan pengundi diterima mesra para peniaga dan pembeli.

"Lawatan pagi ini lebih untuk berkenalan dengan penduduk setempat. Setakat ini mereka tidak menyuarakan apa-apa permintaan. Saya gembira kerana lawatan ini mendapat sambutan baik penduduk," kata Teng kepada pemberita yang turut mengikuti lawatan itu.

Gobalakrishnan pula berkata selepas ini beliau akan mengadakan gotong royong dengan penduduk Taman Inderawasih.

Seorang peniaga P.Daviny, 38, gembira kerana gerainya dilawati bakal-bakal calon kedua-dua parti.

"Saya gembira mereka datang, boleh kenal-kenal," katanya.

Subramaniam, Lee bertembung Chua, sempat bergurau senda

SEGAMAT - Kehadiran masyarakat berbilang bangsa ke pasar malam setiap Sabtu di pekarangan Pasar Awam di sini menjadi pilihan utama jentera parti Barisan Nasional (BN) dan Parti Keadilan Rakyat (PKR) untuk berkempen bagi calon masing-masing.

Kedua-dua jentera kempen parti itu secara kebetulan bertembung ketika masing-masing sibuk bermesra dengan masyarakat setempat, namun tiada berlaku sebarang tindak-tanduk di luar kawalan daripada penyokong mana-mana parti.

Jentera BN yang berkempen untuk penyandang kerusi Parlimen Segamat Datuk Seri Dr S. Subramaniam dan penyandang kerusi Dewan Undangan Negeri (DUN) Jementah Dr Lee Hoong Tee, yang tiba pada 6.30 petang, turut menyapa calon PKR Datuk Dr Chua Jui Meng, yang tiba kira-kira setengah jam kemudian.

Subramaniam, Dr Lee dan Chua kemudian berjabat tangan dan bergurau senda antara satu sama lain kira-kira lima minit sebelum masing-masing meneruskan aktiviti berkempen di situ.

Terdahulu, Subramaniam, yang juga Menteri Sumber Manusia, menyertai aktiviti kemasyarakatan di kompleks membeli-belah One Segamat dengan bertemu setiap peniaga dan penjaja di pasar malam itu bagi meyakinkan mereka sebelum meninggalkan kawasan bekenaan kira-kira sejam kemudian.

Chua pula meneruskan agenda kempen dengan mengedar risalah manifesto PKR negeri kepada peniaga serta pengunjung pasar malam sebelum beredar sejam selepas itu.

Terdahulu, ketika diminta mengulas pertindihan calon antara PAS dan PKR di DUN Panti, Chua berkata perkara itu berlaku di luar pengetahuan beliau dan pihaknya akan berbincang berhubung perkara berkenaan secepat mungkin.

Katanya, beliau tidak mengetahui bagaimana kedua-dua calon mendapat surat watikah sedangkan pucuk pimpinan pusat sebelum ini bersetuju memberi pencalonan kerusi itu kepada PKR.

The Organization of Islamic Cooperation (OIC) has blasted the Burmese government for reneging on its commitment to allow the group to open an office in Burma, saying that it is not serious about humanitarian issues.

Speaking to The Irrawaddy on Tuesday from the OIC headquarters in Jeddah, Saudi Arabia, the director of the Muslim Minorities and Communities Department, Talal Daous, said, "It is an unfortunate thing to happen, because this office is only for humanitarian purposes.

"We have already signed an agreement, but it seems the government of Myanmar [Burma] is not serious about humanitarian issues," he said.

Naypyidaw's move to backtrack on its agreement with the Islamic bloc came after Buddhist monks led demonstrations in several cities across the country to protest the decision to allow the OIC to open an office.

The President's Office in Naypyidaw issued a statement on its website on Tuesday saying that it is the wishes of the people that the OIC not be given the right to set up an office in Burma.

However, Talal Daous said that the OIC had not received any official statement from the Burmese government and is still waiting for an answer.

The OIC signed an MoU with the Burmese government on Aug. 11 to open offices for humanitarian purposes in Rangoon and Sittwe. A delegation from the OIC then traveled to Arakan State in September to inspect the aftermath of communal clashes between Muslims and Buddhists in the strife-torn region.

The OIC said that it intends to distribute humanitarian aid to victims from both the Arakanese Buddhist and Muslim Rohingya communities without discrimination.

"We are also urging the international community to help the victims," said Talal Daous. "From a humanitarian point of view, we are seeking to help all people who were effected by violence."

He said that the victims continue to suffer.

Hla Thein, a Muslim community leader in Rangoon, said, "The current announcement by the President's office not to allow the OIC to base [in Burma] is favorable only to the Rakhine people.

"No one will trust this government," he said. "The Myitsone dam was a similar case when they signed an agreement, but then withdrew it again. In fact, they should not sign an agreement in the first place if they're going to act like that."

Chris Lewa, an NGO coordinator working with the Rohingya in western Arakan State, said, "I can understand why people feel threatened by an OIC presence in Sittwe, although I don't see why the OIC should not have a diplomatic presence in Yangon [Rangoon] as other regional bodies do.

"The Burmese government has now changed its mind as it already has too many conflicts on its hands and does not want to antagonize people, especially monks with a strong moral authority, and it wants to avoid at all costs any further unrest [which] could be exploited and spread beyond Arakan."

Lewa, who visited Sittwe as a consultant for Refugees International in September, said, "A lot of humanitarian funding has already been pledged but so far little has actually materialized through the UN and the Myanmar Red Cross Society. The serious dilemma is the issue of segregation. That is why aid has focused on emergency assistance for the displaced—building shelters, food relief and drinking water. But there is an urgent need to also provide better sanitation, health services and education."

Hla Thein said that Rohingya refugees who do not have enough food will face starvation.

According to Lewa: "The segregation policy in Sittwe is shocking and unacceptable and it will only increase tensions. The government should take drastic action to stop and prosecute extremist Rakhine elements harassing the Muslim population and actively work for a solution and to restore peace and the rule of law.

"Humanitarian assistance alone is not a solution," she said. "Development assistance should help both communities in the long term once life in Arakan State returns to normalcy. If people in Burma feel that the OIC presence is an interference in the internal affairs of the country, they and the monks should immediately and urgently take responsibility to resolve the conflict peacefully."

An UMNO member and as promised, my votes are for BN in Pekan Parliament and Dun..even though reluctantly..

It's getting to be rather sickening.

First I heard that in Raub yesterday MCA minders who were not supposed to be in the nomination hall were there to probably heave Dato' Seri Ho Khai Mun on their shoulders because they were so pompously sure they would win by default.

It's so pathetic when we cannot wait to see the downfall of a Malay politician whose political career was short circuited so quickly by our 'virtuous' khalifah, who is not only super powerful because he hails from a highly aristrocratic family but his wealth is way beyond imagination.

Why should anybody want to eagerly bring down a lame 'dog' who is barking at the 'mountain'?

Also, come on..when Dato' Ariff was in BN, they did solat hajat in full public view too before entering the dewan penamaan calon..nobody complained!
So stop that bloody crap of jeering at them!

NUS probing tweets with confidential patient info

THE National University of Singa­pore's (NUS) Yong Loo Lin School of Medicine said that it is investigating tweets containing confidential patient information which caused an uproar after a screenshot was posted online.

The two tweets, posted on April 7 from a final year medical student's Twitter account, had information about a patient's pregnancy and abortion history, including a line "Don't even wna look at this patient".

A screenshot of the posts appeared on citizen journalism website Stomp yesterday. The contact given by the Stomper was a group e-mail address for the school's current final year medical students.

These students at the medical school are currently doing their electives, where they are attached to hospitals to shadow senior doctors and may come into contact with patients.

"If the student who allegedly tweeted about patient information is indeed from the NUS Yong Loo Lin School of Medicine, he/she will be counselled and will also be subjected to disciplinary proceedings," the school said in a statement.

The Straits Times understands that the school is investigating other possibilities, such as whether the Twitter account had been hacked.

A check found the account has been deleted.

The school said the importance of safeguarding patient confidentiality is constantly emphasised throughout clinical training.

Students have to sign confidentiality agreements before embarking on clinical training in the hospitals.

It added: "Students at the NUS medical school have always been taught to safeguard their patient's records and confidences. They have been taught that confidentiality is central to the trust patients place with them and it is an important ethical and legal principle."

The post on Stomp attracted over 6,800 views with some commentators questioning the student's professionalism while others excused it, saying the patient was not named in the tweets.

A student at the medical school, who spoke on condition of anonymity, said he was shocked.

"Right from the start, the school stressed the importance of patient confidentiality," he said.

"In Year 1, there's a module called Health Ethics, Law and Professio­nalism where we were regularly reminded that we cannot talk about the patient's condition at all, even if we don't mention a name or age." — The Straits Times/ Asia News Network

"Barisan Nasional mencatat permulaan yang baik bagi menghadapi kempen Pilihan Raya Umum ke-13 apabila menang tanpa bertanding bagi kerusi Dewan Undangan Negeri Senggarang, Johor.

Berita itu memetik kata-kata Muhyidin yang memperlekeh calon PAS kononnya tidak pandai mengisi borang pencalonan.

Terbukti berita itu palsu apabila SPR mengesahkan penyertaan calon PAS Dr Ramli Kari di situ.

Nomination day in Bukit Mertajam on GE13

I was supposed to go support a friend at a Nomination Day function somewhere on the island today but somehow, my plans changed almost at the last minute. With time a little free on my hands, I then decided to throw in my support for the Pakatan Rakyat parliamentary and state candidates in Bukit Mertajam.

So at nine o'clock in the morning, I found myself walking to the Jalan Song Ban Kheng-Jalan Betik road junction. The side of the main road was already filled with cars and supporters. Found a vacant spot and managed to squeeze my car into it.

Possibly about 200 people - a mix of Chinese, Malays and Indians - were already there at the junction, mostly garbed in yellow T-shirts while I sported the Ubah T-shirt that I had bought days earlier from the DAP Penang headquarters about a week back. The flags of the DAP, PKR and PAS were flying everywhere, and the people were clearly enjoying themselves. Party mood.

Shortly after nine o'clock, the Pakatan Rakyat candidates entered the roadblock which the Police had set up. Only the candidates and their seconders were allowed through and they walked a short distance to the Public Works Department Office.

However, I found it disconcerting that barbed wire had also been stretched across the road block. Was it really necessary when everyone were in carnival mood?

From my vantage point, I could see a similar roadblock set up about a hundred metres away to block off the Barisan Nasional supporters. Very difficult to estimate how many of their supporters were there but it didn't really mattered.

About 10 minutes later, we noticed that from the other end of the road, the candidates from the Barisan Nasional had also arrived at the nomination centre.

I didn't wait for 10 o'clock. That was the time when nominations would end. I didn't wait because, well, the little time on my hands had ended and there were other things to do. So I took leave of this group of people, glad that I had at least now experienced the atmosphere during nomination day.

WHEN filing your taxes, it helps to know which incomes are taxable and where or how you can get rebates. So, from rental income to stock gains, KPMG Tax Services executive director Datin Pauline Tam tackles some of the queries raised by Sunday Star readers.

Your wife is entitled to claim the net deposits (but limited to a maximum of RM6,000) in the three accounts registered under her own name. Likewise, you are entitled to claim the same for the accounts registered under your name. The claim is only allowed for Years of Assessment 2012 to 2017.

An individual can claim an aggregate amount of payment of deferred annuity or contribution to the PRS or both up to maximum of RM3,000 for a year. However, effective from Jan 1 this year, the withdrawal of contributions from a PRS by an individual before he reaches the age of 55 would be subject to a withholding tax at the rate of 8%. In addition, contributions to a PRS may involve some terms and conditions which may not offer you the flexibility to switch over to another PRS in the subsequent year. The claim for deduction for contributions to PRS is from Years of Assessment 2012 to 2021.

With regard to the deduction for deposits in the SSPN account, the allowable deduction is limited to the net deposit (after taking into account the withdrawals during the same year) and up to a maximum of RM6,000. Further, we understand that there could be some restriction on the quantum that you could withdraw from the SSPN account. The claim for deduction for net deposit into the SSPN account is from Years of Assessment 2012 to 2017.

As an alternative, if the charges were paid via his credit card, the credit card receipt (as well as a clear photocopy in case the original receipt fades over time) and the hospital bills should be kept as evidence of payment.

> I have a question on the RM10,000 deduction for interest on housing loan (which has a three-year expiring period commencing from the date in which the interest is first expended). I bought my house in 2009 under a developer interest bearing scheme (DIBS) and took delivery of the house in mid-2011. I made my first (interest deduction) claim in assessment year 2011 and am making the second claim for assessment year 2012. Is this claim my last?

We note from Section 46B(2) of the Income Tax Act 1967 (" the Tax Act") in relation to the deduction of interest on housing loan, that the wordings used are "…a period of three consecutive basis years beginning from the basis year in which the interest referred to …is first expended by that individual". Applying the above in your circumstances, if the first year you expended interest is 2011, then you are eligible for the claim of interest for 2011, 2012 and 2013.

> Does the RM500 broadband deduction cover fixed broadband and mobile Internet?

Based on the Inland Revenue Board guidelines issued on April 12, 2011, the relief can be given for fees paid for Internet connection via cable or Digital Subscriber Line with the speed of 256kbps or more but not for fees paid for dial-up service (56kbps) for Internet connection. The fees must be paid by the individual for broadband subscription that is registered under his own personal name. The deduction is only allowed for Years of Assessment 2010, 2011 and 2012.

> If my income is RM30,000 per annum and my calculations show that I don't have tax payable after deduction rebate, do I still need to submit tax assessment to IRB?

You are required to submit a tax return by the due date even if you do not have any chargeable income under the following circumstances – you have chargeable income in the immediate preceding year; or you have submitted a tax return in the immediate preceding year; or you are required to submit a tax return (but failed to submit) for the immediate preceding year. However, you do not need to submit a tax return if you are able to obtain a waiver from the IRB.

> As my EPF has exceeded the maximum of RM6,000, I claim 60% on my insurance under medical. However, I only did this last year. Can I make a claim for all the previous years that I did not submit this 60%?

You could claim a relief not exceeding RM3,000 on insurance premiums in respect of medical or education benefits for yourself or your spouse or your child. If you have omitted to claim for the past years, you could make an appointment to meet with an IRB official at the IRB's branch where your tax file is maintained and submit an official letter with the original supporting documents to make the claims for the past six years.

> I bought an iPad in 2011 and during the year, I was not entitled to tax deduction as I had already claimed for a computer bought in 2008. Can I claim tax deduction on the iPad in year 2012?

The claim for the purchase of a personal computer is allowed once in three years. As you have made your last claim in 2008, you could make the next claim in 2011. Personal computer means a desktop computer, laptop computer and handheld computer and does not include computer accessories. We understand that with recent innovations in IT, the definition has expanded to include mobile computers like tablet PC, as long as the gadget does not include the features of a mobile phone.

With regard to whether the claim of iPad as purchase of a personal computer is allowed, it is still not clear. Since you made the purchase in 2011 and you should have submitted your 2011 tax return, you may wish to check with the IRB's branch where your tax file is maintained whether you could make a revised claim against your 2011 income in respect of the purchase of iPad in 2011.

> I retired in Malaysia in August 2011, and was subsequently offered a one-year contract till August 2012 in Cambodia. During the tenure of my contract, I paid income tax to the Cambodian government (there is no double taxation agreement between Cambodia and Malaysia), and none to the Malaysian Government.

Since I did not have any employment income in Malaysia for assessment year 2012, I should be submitting a NIL return for my tax filing. However, since I have received Malaysian corporate tax-deducted shares dividends in 2012, I will be filing my tax return for the shares dividends income. Need advice/clarification on the following:

a) In 2012, I continued to contribute to EPF in Malaysia via my employer in Malaysia. Can I claim the EPF contributions as rebate/deduction in my tax filing? I have the EPF statement as proof of the contribution.

You are eligible to claim your EPF contributions as a personal deduction under "Life insurance and provident fund" in your tax return if you qualify as a tax resident in 2012. The claim for EPF contributions and life insurance premiums is limited to RM6,000. If you have taken a loan to finance your investment in shares, the interest expenses incurred by you would be deductible against the dividend income.

b) In the income tax form, there is a column/category: "Interest on loan employed in the production of gross dividend income" eligible to be deducted from total dividend received. How can I enjoy this deduction? What type of bank documents are required as proof of the loan employed, if any?

Documented evidence such as the offer letter from the bank and the bank statements indicating the flow of funds for financing the share investments would be required to prove that the funds have been utilised to finance the acquisition of the share investments.

All taxpayers are subject to tax audits. Therefore, the supporting documents to substantiate the utilisation of funds for the purchase of the share investments and interest expenses incurred by you are required to be kept for seven years from the end of the year in which you have made a claim for the interest expenses.

> My husband has already submitted his tax assessment. Later, we noticed that he did not fill a column for rebate on disabled spouse, which is RM3,500. I submit my tax separately from him. Is he entitled for the rebate if we write to IRB?

It appears that you have elected for separate assessment. In this respect, your husband is not entitled to claim a deduction for a disabled spouse.

> My spouse has quit her job to become a full-time housewife with no income. a) Am I better off filing under joint or separate assessment?

Based on your circumstances, the type of assessment (indicated in the tax return) that is applicable on you is under category 4 (if the individual is married with a spouse who has no income/no source of income or has income which is tax exempt).

b) Does she have to fill in too (assuming if I'm better off in separate assessment)?

Your wife is required to submit a tax return by the due date even if she does not have any chargeable income under the following circumstances – she has chargeable income in the immediate preceding year; or she has submitted a tax return in the immediate preceding year; or she is required to submit a tax return (but failed to submit) for the immediate preceding year.

However, she does not need to submit a tax return if she is able to obtain a waiver from the IRB. The type of assessment that she should indicate in her tax return is category 1 (joint in the name of husband) to allow you to claim the personal relief for spouse and children.

> I am a pensioner. I opted for early retirement at the age of 40 and I turned 55 last year. Do I have to declare the full year's pension for last year or until April (my birth month)?

Pensions that you received up to the date before you turned 55 are taxable and only that portion is required to be declared.

> I am a pharmacist. In 2012, I took a professional exam. There were no classes involved. I bought the e-book for US$300 (RM906) online, which I will claim under Books. I also paid US$700 (RM2,115) exam fees. Is this fee tax deductible? Do I claim it under education?

According to Section 46(1)(f) of the Tax Act, a maximum of RM5,000 is deductible in respect of fees expended by the taxpayer on himself in any institution or professional body in Malaysia recognised by the Government or approved by the Finance Minister, as the case may be, for the following:

(i) on any course of study up to tertia­ry level, other than a degree at Masters or Doctorate level, undertaken for the purpose of acquiring law, accounting, Islamic financing, technical, vocational, industrial, scientific or technological skills or qualifications; or

(ii) any course of study for a degree at Masters or Doctorate level undertaken for the purpose of acquiring any skill or qualification.

Please check whether your course of study falls within the above to determine your fees are deductible under "Education Fees".

> Do I need to declare profit from buying and selling shares as an income?

Whether the profit from buying and selling of shares is regarded as a taxable income would depend on the facts and circumstances of the case. If the transaction can be demonstrated as a realisation of a capital investment, it can then be regarded as a capital gain not subject to income tax. On the other hand, if the transaction is derived from an adventure in the nature of a trade, then the profit from buying and selling of shares would then be seen as a revenue gain subject to income tax.

> I have a few properties, one of which is occupied by my son. Do I have to declare that as rental income? If there is another house left empty, do I have to declare that as well?

You only declare when you start to let out your properties.

> I receive a rental income from my new apartment. What are the deductions I can claim and are there limits?

Expenses which are allowed deduction from rental income are the direct expenses that are wholly and exclusively incurred in the production of the rental income.

Examples of such expenses are as follows – assessment and quit rent, interest on loan and fire insurance premium, expenses on rent collection, expenses on rent renewal, expenses on repair and service charges. However, only expenses incurred after the new apartment has been rented out are deductible from the rental income. Initial expenses are not deductible. Examples of initial expenses are the cost incurred to obtain the first tenant, such as advertising cost, legal cost to prepare rental agreement, stamp duty and commission for real property agent.

> I have two properties under joint ownership with my wife. The rental agreement is in my wife's name and she collects all proceeds. She is unemployed and we have separate assessments as she was working previously.

Do we need to submit rental income in both our tax submissions equally divided or can she report all the rental income ?

The registered owners (as evidenced in the title deeds or any equivalent documents to demonstrate ownership) of the properties are the rightful recipients of the rental income. Thus, both you and your wife would be required to declare your respective portion of the rental income in your individual tax returns based on the ratio of your joint ownership.

> I am currently working overseas but own three properties in Malaysia. Do I need to declare anything to the Inland Revenue Board (IRB)?

Generally, Malaysian-derived income is subject to Malaysian income tax. As the properties are located in Malaysia, the rental income from the letting of properties is regarded as Malaysian-derived income. Therefore, you are required to declare the rental income to IRB by completing and submitting the relevant tax return form. The type of tax return to be submitted is dependent on your tax residence for the year concerned. Generally, tax resident individuals are subject to the progressive tax rates and entitled to personal reliefs/deductions and rebates. Non-tax residents are taxed a flat rate of 26% without any personal reliefs/deductions and rebates.

> If I have two properties purchased under the DIBS during the qualifying period for housing loan interest deduction, say house A in 2009 (completion 2011) and house B in 2010 (completion 2014), can I claim deduction for house A from 2011 to 2013, and house B from 2014 to 2016? At any one time, I intend to claim deduction for one house only.

The current tax laws only allow an individual who is a Malaysian and tax resident to claim interest expenses on housing loan provided certain conditions are satisfied. One of the conditions is the claim is limited to only one unit of residential property. If you have claimed interest expenses for house A in your 2011 tax return, you will be eligible to claim the interest expenses for house A in your 2012 and 2013 tax returns provided you have fully complied with the stipulated conditions. You would not be able to claim any deduction for house B.

> A father and son jointly purchased a house in 2010. Assuming the house was rented out and the son received the rent and used it to repay the housing loan, is the father required to declare any rent received? If so, how should the father compute his net income from rent?

As the property is jointly owned by the both the father and son in the title deed or any equivalent document, the rental income would be regarded as the income of both registered owners. Both would be required to declare their share of the net rental income (after deduction of the relevant expenses) in accordance to the ratio of the ownership of the property. The net rental income is arrived at after deduction of the interest on loan, fire insurance, assessment and quit rent, and repairs and maintenance. However, only the expenses incurred after the letting of the property are deductible.
